Chiar dacă formula nu se regăseşte ca atare în textul lui Noica, ea exprimă fidel ideile acestuia: „satul ştia să tragă în cuprinsul său toate celelalte feluri omeneşti de a integra lumea"), ...concluzia astfel formulată de Emil Cernea în ultimul pasaj al sintezei din anul 2008 deschide calea înţelegerii perioadei de un secol şi jumătate dintre instaurarea regimului fanariot şi intrarea în vigoare a codurilor care dau expresie deplină dreptului român modern în timpul domniei lui Alexandru loan Cuza. Pe urmele lui Cernea, profesorul Aurel-Jean Andrei, titular al cursurilor de Istoria statului român şi a dreptului românesc şi de Drept roman la Facultatea de Drept a Universităţii din Bucureşti, înfăţişează în volumul de faţă de manieră succintă reperele istorice ale procesului la capătul căruia obştea ca formă de viaţă comunitară specific românească şi Legea ţării înţeleasă ca „dreptul neamului românesc" (A.-J. Fără a fi neglijate în contexte precum programele Revoluţiilor de la 1821 şi 1848, „ideile iluministe cu privire la drepturile naturale ale omului, contractul social, libertăţile fundamentale şi egalitatea între oameni" (p. 54) nu sunt totuşi evidenţiate de o manieră sugerând înscrierea profesorului Andrei printre urmaşii spirituali ai lui Eugen Lovinescu, iar capitolul care deschide lucrarea şi care priveşte „Formarea relaţiilor de producţie de tip capitalist în Muntenia şi Moldova şi specificul capitalismului românesc" (p. 11-42), acoperind perioada scursă până în 1918, sugerează mai degrabă o afinitate profundă a autorului cu abordarea dezvoltată de Ştefan Zeletin în Burghezia română (1925) şi în studiile din volumul purtând titlul Neoliberalismul (1927). Aşa cum analizele mai atente ale ideilor spengleriene au invalidat această interpretare fatalistă, nu este exclus ca şi reluarea dezbaterii în jurul construcţiei modernităţii politico-juridice româneşti să conducă la rezultate similare. încercând în cele ce urmează o schiţă cât se poate de sumară şi incompletă a ceea ce ar putea constitui un program colectiv de studiu al istoriei (gândirii) politicojuridice româneşti inspirat de prezenta lucrare, vom porni de la teza lui Emil Cernea citată la începutul acestei recenzii observând că ea se înţelege pe sine totodată şi ca răspuns polemic dat unei linii de gândire prin care „se neagă unitatea vechiului drept românesc" în materia instituţiilor de drept privat, precum şi relevanţa Legii ţării pentru instituţiile dreptului public, a cărui dezvoltare în cadrul Legii ţării, scrie tot Emil Cernea, „este contestată în mod absurd de către Val. Cititorul care va urma trimiterea lui Cernea la locul indicat de acesta din urmă nu numai că nu va găsi formulările astfel citate, ci, parcurgând întregul studiu şi extinzând eventual cercetarea şi la alte lucrări ale lui Valentin A. Georgescu, va dobândi serioase îndoieli cât priveşte întemeierea reproşului formulat în termeni atât de categorici, iar consecinţele opoziţiei fundamentale create de Cernea între Valentin Al.
Resulting from the frontal collision of two criminal law systems at the level of the legislation, theory and practice of criminal law, the crisis of the (science of) criminal law in Romania is a ...crisis of the „technical-legal method”. This crisis resulted from the lack of thoroughly analysing the foundations of this method configured in terms of general juridical theory in the context of the Historical School of Law from Germany, received in the particular matter of the theory of criminal law thanks to the contribution of the Italian criminal specialists (Arturo Rocco) and which became a traditional method of the Romanian science of criminal law due to its reception in Italy by Vintilă Dongoroz. In the broader plan of the general theory of law, the same crisis proves to be a crisis of the idea of science of law, explicable by the vicissitudes of the reception of the Historical School of Law in Romania over the last 150 years.
Departing from a paper published in 1956 by the influential politician Ion Gheorghe Maurer, at that time director of the Legal Research Institute in Bucharest, Traian Ionascu and Eugen A. Barasch ...have written in 1964 an important paper regarding the problem of the relation between form and substance in law. In dealing with this paper the following text will try to establish the connection between Ionaşcu, Barasch and the German Pandektensystem and to underline the political effects of the (tacite) reception of this system into the Romanian legal theory of that epoch.
Departing from the Romanian Constitutional regulation of property from 1923 to 1934 controversies on the nature of the property as subjective right and/or social function, the present paper aims to ...reconstruct an unitary theoretical framework within the legal thought which could explain more widely the Romanian Constitution from 1923 as a solidarist constitution. We shall try to show that Otto von Gierke´s doctrines on Genossenschaft and Sozialrecht could aptly fulfill that role although (or rather because) it is not so well known among the Romanian legal scholars. The first part here will deal with the controversy on the nature of property by rising some questions, while the second to follow should offer some answers from Gierke´s work.
While the first part of this article documented the positions taken by important Romanian scholars on solidarism (I) and especially on the issue of property conceived as social function following the ...theory of Leon Duguit but also the relevant provisions of the German Weimar Constitution (II.1), this second and last part will try to demonstrate the relevance of Otto von Gierke´s social law paradigm for the Romanian Constitution from 1923
The political thought of conservative historian and stateman Nicolae Iorga (1871-1940) has been widely acknowledged within the Romanian cultural and political discourse as permeated by romantic ...organicism as well as by a nostalgy for the Middle Age preventing a realist perception of his present time. This perception lacks on consistence, since Iorga’s approach on the Romanian medieval order – structured around the Roman concepts of libertas and auctoritas – reveals itself as genuine Romanian repristination of the Roman Principate according to its nature of res publica restituta. Romanian political tradition should according to Iorga be conceived as essentially Roman and also the Romanian political thought should leave behind all political theories based on idealist premises in order to regain the specific Roman form of political thinking which is no other that Iorga’s own organic realism’focusing on political praxis.
Die Beziehungen zwischen dem sozial-politischen Werk des großen rumänischen Dichters Mihai Eminescu und der Hiatorischen Rechtsschule in der rumänischen Fachliteratur durchaus bekannt. Völlig ...unbekannt scheint hingegen die Tatsache zu sein, daß Eminescu wie kein zweiter Jurist in Rumänien den Rechtswissenschaftsbegriff v. Savignys als solchen bewußt rezipierte. Dabei dürfte ein berūhmtes Hòlderlin-Fragment aus dem Roman Hyperion als wichtiger Vermittler gespielt haben.
Der vorliegende Beitrag versucht, eine Erklärung für das Fehlen der sog. Wissenschaftlichen Rezeptio des römischen Rechts aus der rumänischen Rechtsgeschichte und Rechtswissenschaft. Dafür wird die ...Unterscheidung zwischem Form und Inhalt des Rechts in verschiedenen Zusammenhängenn erörtet, und schließlich die strukturelle Ähnlichkeit zwischen der Schutzfunktion der rechtshistorischen Lehre von der wissenschaftlichen Rezeption des römischen Rechts in der Zei des Nationalsozialismus und der Aufbaufunktion der rechtswissenschaftlichen Lehre von den sog. Konstanten des Rechts in Bezug auf die Konstruktion freiheitlicher Rechtszustände unter dafür günstigen politischen Bedingungen während der kommunistischen Zeit.
