AbstractOne of the ways to increase the financial capacity of village-owned enterprises is to strengthen their own assets. Sharia Banking, as a financial institution that carries out intermediation ...and social functions, has a strategic function in strengthening the assets of village-owned enterprises. Assets strengthening of village-owned enterprises, which can be carried out by Sharia banking through its intermediation and social functions, has become an interesting subject to research. This research combines normative legal research with analytical descriptive research parameters, especially research on secondary data in the form of primary, secondary, and tertiary legal materials, by collecting systematic information regarding relevant facts and rules. Strengthening the assets of village-owned enterprises can be carried out through the intermediation function of Sharia Banking, namely through murabahah, mudharabah, and musyarakah financing. Meanwhile, through the social function of Sharia Banking, strengthening the assets of village-owned enterprises can be sourced from grant funds and other social funds or can come from cash waqf funds and utilized through managing the potential business activities of village-owned enterprises. This research is expected to be useful for village-owned enterprises and Sharia Banking, especially in terms of increasing the assets of village-owned enterprises.
Government policies related to notary institutions from the beginning of their emergence until now, it has not been able to provide certainty related to the independence of the Notary Position in the ...order of the National legal system. Is it purely as a public official like a state official, or is the legal profession, and or is a Public Official combined with a legal profession position because it influences his responsibilities. This study aims to find out how the position and responsibilities of a notary in the current national legal system, this research method uses a juridical normative approach method that is analyzed descriptively analytically on the basis of data that is processed in a juridical way qualitatively, logically and systematically. From the results of the study note that the Notary has a position as a "Public Official" based on “the provisions of Article 1868 of the Civil Code”, UUJN, and other relevant laws. Notary public is also said to be a "professional position" because it has the skills and is done continuously to serve the interests of the community in the sphere of civil (Private). The notary's responsibility as a "Public Official" arises when the notary carries out the authority regulated under the UUJN and is responsible for carrying out his position to the client as well as to the government that has appointed him. The professional responsibility of a notary public arises when applying his skills in serving the community and being responsible to himself and his professional organization.Abstrak: Berbagai kebijakan pemerintah sehubungan dengan lembaga kenotariatan dari awal kemunculannya hingga saat ini, belum dapat memberikan kepastian terkait dengan independensi kedudukan notaris dalam tatanan sistem hukum nasional. Apakah murni sebagai pejabat umum layaknya pejabat negara, ataukah profesi hukum, dan ataukah pejabat umum yang dipadukan dengan jabatan profesi hukum karena hal tersebut berpengaruh terhadap tanggung jawabnya. Penelitian ini bertujuan untuk menemukan kedudukan serta tanggung jawab notaris dalam tatanan sistem hukum nasional saat ini, metode penelitian yang digunakan adalah metode pendekatan yang dilakukan secara yuridis normatif yang dianalisis secara deskriptif analitis atas dasar data yang diolah secara yuridis kualitatif, logis dan sistematis. Dari hasil penelitian diketahui bahwa notaris mempunyai kedudukan sebagai “pejabat umum” didasarkan pada ketentuan “pasal 1868 kuhperdata”, uujn, serta perundang-undangan terkait lainnya. Notaris juga dikatakan sebagai “jabatan profesi” karena memiliki keterampilan dan dilakukan secara terus menerus untuk melayani kepentingan masyarakat dalam lingkup keperdataan (privat). Tanggung jawab notaris sebagai “pejabat umum” muncul ketika notaris melaksanakan kewenangan yang diatur berdasarkan uujn dan bertanggungjawab terhadap pelaksanaan jabatannya kepada klien serta kepada pemerintah yang telah mengangkatnya. Tanggung jawab professional dari seorang notaris muncul ketika menerapkan keterampilannya dalam melakukan pelayanan pada masyarakat dan bertanggungjawab kepada diri sendiri serta organisasi profesinya.
The ex-Gratia Compensation Scheme was introduced by the Government of Indonesia in 1994 to provide compensation, which is not covered by any prior legislation, for all its workers suffering from ...injuries and illnesses due to work. This study explores a key aspect of insurance policies in Indonesia, e.g., ex gratia payment to the insured individual by their insurance company. This study argues that several issues still exist in the insurance business in Indonesia that require a change in policies and regulations by the government for the welfare of the Indonesian people, especially the vulnerable. This paper seeks to address the question of how the ex gratia rule can be used to solve insurance claim disputes. In other words, are insurance claims always approved by insurance companies under the ex gratia rule? This study reveals that despite more than 10 years of implementation, the ex gratia claims filing is still minimal and unpopular. This is mainly due to the population's unawareness of the provisions of ex gratia and its benefits.

Bankruptcy requirements as a legal basis for bankruptcy applications are only based on the burden of proof in a simple manner which results in the debtor being easily declared bankrupt by the court. ...This impedes the realization of the principle of justice that has been mandated in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (SDPO). This article aims to analyze the basis of justice related to the bankruptcy of the debtor and the implementation of the bankruptcy test in relation to the request for bankruptcy submitted to the debtor. This study is a normative juridical research method that uses descriptive-analytic research. This study also uses library research to collect data and analyzes data with qualitative juridical methods. The results show that the debtor's bankruptcy application did not apply the Bankruptcy test. It is believed that insolvency test on the debtor's bankruptcy petition is as a manifestation of the principle of justice that is in accordance with Pancasila by providing balanced protection among creditors, debtors and other stakeholders.

This normative legal research analyses court verdicts in a forest and land fire case qualitatively. It aims to describes the role of scientific evidence to the proof process in the adjudication that lead to the court verdict for environmental recovery of burned forests and land. Scientific evidence in the form of scientific studies and expert opinion admitted by the court has a role in proving land and forest fire occurrence, environmental damage and loss, and the causality element of the case.
The Indonesian bankruptcy law system adheres to the debt collective principle which is general seizure (sita umum) of the debtor’s property as guarantee for the payment of debt through the bankruptcy ...institution. The principle of debt collective stresses that the debtor’s debt shall be paid immediately from the property owned by the debtor. Based on such principle, bankruptcy serves as a means of coercion to materialize the creditors’ rights through liquidation of the debtor’s assets. Bankruptcy law in Indonesia does not recognize the principle of debt forgiveness, among others, the implementation of debt relief granted to the debtor to pay off debts that are truly incapable of being fulfilled. According to the Bankruptcy Law, after the completion of the bankruptcy process, the debtor is no longer in a state of bankruptcy, because the end of bankruptcy has revoked the status of insolvent debtors, hence debtors are considered as being competent to take care of their property. However, the termination of bankruptcy does not necessarily absolve the debtor from the remainder of the debt; creditors are entitled to collect it and debtors are obligated to pay it off. Upon the completion of the bankruptcy process, debtors or their heirs may apply for rehabilitation. However, rehabilitation is only to be granted if all creditors state that they have obtained payment in a satisfactory manner, meaning that recognized creditors will not file claims against the debtor concerned again even though they may not have received payment on all of their outstanding receivables. Request for rehabilitation can only be granted if the debtor has completed the entire scheme of bankruptcy and creditors were satisfied with the payment.
Perseroan Terbatas di Indonesia seiring dengan berkembangnya bisnis, perlu mendirikan kantor cabang demi perluasan daya jangkau dan peningkatan kuantitas serta kualitas dari kegiatan usahanya. Tidak ...jarang Perseroan Terbatas memasuki ranah pengadilan oleh karena adanya perbuatan hukum, tetapi pada penerapan hukumnya, seringkali pimpinan kantor cabang menjadi pihak dalam sebuah perkara, padahal kantor cabang tidak memiliki legal standing sebagai subyek hukum. Penelitian ini bertujuan untuk mengetahui kedudukan pimpinan kantor cabang suatu Perseroan Terbatas untuk mewakili Perseroan Terbatas dan legalitas pimpinan kantor cabang suatu Perseroan Terbatas untuk mewakili Perseroan Terbatas pada perkara perdata di dalam pengadilan. Metode penelitian yang dilakukan adalah yuridis normatif melalui tahap penelitian kepustakaan dan penelitian lapangan. Berdasarkan hasil penelitian, kedudukan hukum pimpinan kantor cabang tidak dapat melakukan perbuatan hukum secara sah tanpa adanya kuasa cabang. PT dapat tidak bertanggung jawab kepada kesalahan atau kelalaian yang dilakukan oleh pimpinan kantor cabang sepanjang dapat dibuktikan tindakan yang diperbuat melampaui kuasa yang diberikan dan legalitas pimpinan kantor cabang PT sebagai pihak pada perkara perdata di pengadilan yang didasari pada kaidah hukum yang terkandung dalam Yurisprudensi tetap yang menyatakan bahwa pimpinan kantor cabang dapat ditarik sebagai pihak dalam perkara perdata adalah kurang tepat, karena kantor cabang bukan merupakan subyek hukum, maka yang dapat menggugat atau digugat adalah kantor pusatnya.
This study aims to explain descriptively about the implementation of ex-gratia claims on life insurance agreements, how to pay and settle ex-gratia claims and ex-gratia claim terms. In the Life ...Insurance agreement, the insured party when experiencing an unexpected risk of obtaining its rights in the settlement of claims. The occurrence of rejection of claims on life insurance, becomes the cause of a lack of understanding of the actual articles and regulations must be understood before deciding to use insurance. In fact, not all losses suffered by the insured in the insurance agreement can be paid according to the agreement. It is caused by several factors that are considered to violate the principles of insurance and regulations that have been determined in the insurance agreement, resulting in the cancellation of the insurer pays its obligations to the insured or commonly called rejected claims. But customers sometimes still demand that the company pay, therefore the insurance company takes the initiative to pay claims rejected through Ex-gratia. But many people do not know about the ex-gratia claim. Some insurers take the initiative to pay ex-gratia rejected claims. Implementation of ex gratia claims can be done by negotiation, good faith from the insurer to the insured.

Laboratory test reports are often used as one of the pieces of evidence needed in proving civil environmental justice cases. This study analyses court decisions and their ability to elaborate ...problems in transmitting these reports as scientific evidence in such cases in Indonesia. They can be qualified as written and expert testimony evidence, with their use left entirely to the judge's discretion. Furthermore, in judicial practices, judges' criteria in assessing these reports are formality and relevance. Conclusively, the research found that the report's relevance, which included validity and reliability, and support from expert testimonies, are critical points in their use as valid legal evidence with probative value in justice cases.
