The problems of 'precarious' or failing states have become a central focus of international politics. Most of the recent UN-peace missions constitute attempts of 'post-conflict peacebuilding', i.e. ...attempts to react to phenomena of degenerating & eroding statehood. The outcome of these missions is rather mixed. International law has managed in the course of a complex learning-process to develop more or less reliable legal & institutional structures of 'post-conflict peacebuilding'. Many problems remain unsolved, however. Primary concern here is the fundamental issue of the legal legitimation of any attempt to restructure a state in the course of an external peacebuilding intervention As long as this basic question has not found an agreed answer, it will be difficult to identify clear legal limits to the scope of external intervention in the political self-organization of the polities concerned. Die Zuverlässigkeit der Verkehrsbedienung ist gefährdet und ...unbeteiligte Dritte haben oft das Nachsehen. Der Wissenschaftliche Beirat beim Bundesminister für Verkehr und digitale Infrastruktur hat eine Stellungnahme vorgelegt, die Empfehlungen ausspricht, wie das Streikrecht im Verkehrswesen neu geregelt werden kann.
Of late, Germany has been hit by unprecedented strike actions by airline and railway staff. Lufthansa's pilots staged 13 walkouts between April 2014 and September 2015, resulting in the cancellation of 8,500 flights and affecting around one million passengers. The one week strike by Lufthansa's cabin crews in November 2015 forced the company to cancel another 4,700 flights. The trend towards industrial action in the German transportation sector is not limited to airline pilots and cabin crew, however. In addition, security agents and ground staff at several airports have gone on strike, and most of all, train drivers walk out with increasing frequency. In this article, measures are proposed to balance the legal, and legitimate, right of workers to use strikes as a tool of last resort in wagebargaining processes with the no less important right of customers to have access to reliable transportation services. While many other Western countries have regulations in place for the conduct of wage bargaining, including rules on work stoppages in core public service sectors, no such rules exist in Germany.

Der Beitrag geht der Frage nach, inwieweit eine Ausdehnung von Mechanismen des Völkerstrafrechts durch die Unterwerfung bestimmter terroristischer Straftaten unter die Jurisdiktion des in Entstehung ...befindlichen “Standigen Internationalen Strafgerichtshofes” einen sinnvollen Beitrag zur Eindämmung des Terrorismus leisten kann. Ein Blick auf die vorhandenen Ansätze einer international koordinierten Bekämpfung des Terrorismus zeigt, dass sich im Zuge der Weiterentwicklung bestehender Abkommen zu zwischenstaatlicher Zusammenarbeit und Auslieferung bzw. ersatzweiser “stelivertretender Strafrechtspflege” zwar ein Konsens über die grundlegende Definition des Terrorismus abzeichnet, dass aber immer noch für unterschiedliche Problemfelder sehr unterschiedliche Schutzlagen bestehen. Angesichts der noch fragilen Stellung der internationalen Strafgerichtsbarkeit wird man Plänen einer Ausdehnung ihres Jurisdiktionsbereichs auf Fälle des Terrorismus daher eher Skepsis entgegenbringen müssen. The article deals with the question whether an extension of the mechanisms of international criminal jurisdiction by bringing acts of terrorism under the jurisdiction of the planned "Permanent International Criminal Court" could really deliver a sensible contribution to the containment of terrorism. Looking to existing approaches of an internationally coordinated struggle against terrorism demonstrates that recent developments in international treaty law on international cooperation and extradition have brought the international community near to a substantial consensus concerning the definition of "terrorism", but that there still exist different needs of protection for the various categories of terrorist victims. Taking the fragile position of the new international criminal jurisdiction into consideration, a great deal of scepticism with regard to the idea of extending its jurisdiction to terrorist crimes seems to be justified.
