The international community is not taking the action necessary to avert dangerous increases in greenhouse gases. Facing a potentially bleak future, the question that confronts humanity is whether the ...best of bad alternatives may be to counter global warming through human-engineered climate interventions. In this book, eleven prominent authorities on climate change consider the legal, policy and philosophical issues presented by geoengineering. The book asks: when, if ever, are decisions to embark on potentially risky climate modification projects justified? If such decisions can be justified, in a world without a central governing authority, who should authorize such projects and by what moral and legal right? If states or private actors undertake geoengineering ventures absent the blessing of the international community, what recourse do the rest of us have?

Cet article de Richard Falk et Andrew Strauss paru dans Foreign Affairs (vol. 80, n? 1, janvier-février 2001) imagine la construction d’un parlement mondial. Bien qu’un tel projet puisse évidemment ...sembler utopique, les auteurs entendent en montrer la nécessité historique et politique. Depuis une dizaine d’années, cette proposition a été très largement débattue dans le champ des études politiques contemporaines anglo-saxonnes. L’article proposé ici est le point de départ de ce débat. À la suite de sa parution, les auteurs n’ont cessé d’approfondir leur conception d’une nouvelle assemblée mondiale qui s’ajouterait à l’assemblée générale des Nations unies, pour démocratiser la gouvernance mondiale.

Twenty-two years after their seminal article, Toward Global Parliament, published in Foreign Affairs Magazine, Andrew Strauss and Richard Falk revisit the contemporary prospects for a Global ...Parliament. The authors make the case that despite the formidable global rise of ethno-nationalism, the initiation of a Global Parliament is still possible in today's world. With an orientation of openness to novel possibilities that are not subject to predictive analysis, they base their hopeful assessment on an examination of the impact of the rise of China, the perceived urgency of securing national democracies, the resilience of globalisation and its accompanying governance imperatives, and changing global religious sensibilities.
R2; Objective: To evaluate the efficacy of acupuncture in treating chronic non-specific low back pain. Methods: Ten patients with chronic low back pain were selected to receive 9 acupuncture ...treatments over a three-week period with point selection based on syndrome differentiation in Chinese medicine. The BROM Instrument for assessment of back range of motion; subjective evaluation with Visual Analog Scale of Pain (VASP) ratings, Oswestry Disability ratings, objective measurements including Algometry, and Flexion and Extension ratings to investigate the range of motion were used for comparing the large, medium and small effect sizes of baseline, treatment and follow-up phases. Results: Clinical significance of pain relief was shown in all parameters assessed. A large effect size was detected in VASP, Oswestry and Algometry. A small effect size was demonstrated in Flexion/Extension. Needling over short period time (3 weeks) could relieve the pain, but the muscular-skeletal function measured by BROM persists. To treat patients exclusively by needling for statistical purposes can not be justified, because by merely relieving pain, permanent improvement in function may not be achieved. Conclusion: Acupuncture offers an effective alternative for the clinical management of chronic low back pain, significant improvement in most of the parameters evaluated, but the functional improvement was not as satisfactory as pain relieving. Further study with larger sample size focuses on long-term efficacy and functional improvement for chronic low back pain is recommended.

Courts have emerged as a crucial battleground in efforts to regulate climate change. Over the past several years, tribunals at every level of government around the world have seen claims regarding ...greenhouse gas emissions and impacts. These cases rely on diverse legal theories, but all focus on government regulation of climate change or the actions of major corporate emitters. This book explores climate actions in state and national courts, as well as international tribunals, in order to explain their regulatory significance. It demonstrates the role that these cases play in broader debates over climate policy and argues that they serve as an important force in pressuring governments and emitters to address this crucial problem. As law firms and public interest organizations increasingly develop climate practice areas, the book serves as a crucial resource for practitioners, policymakers and academics.
INTRODUCTIONIn March 2003, I wrote an article for the Environmental Law Reporter surveying potential international judicial forums where victims of global warming could bring lawsuits. In the ensuing ...six years, numerous lawsuits have been brought in the United States and in other countries, and environmentalists can now celebrate their first significant victory. In April 2007, based upon its finding that greenhouse gases are pollutants under Section 202(a)(1) of the U.S. Clean Air Act, the Supreme Court in Massachusetts v. EPA held that the U.S. Environmental Protection Agency (EPA) has the authority to regulate greenhouse gases.Though we are still in the early days of global warming litigation, these lawsuits are having a significant impact on the legal and political climate. In response to a good deal of popular and academic discussion suggesting that those most responsible for the global warming problem be held legally accountable, corporations in the carbon sector are becoming concerned about the extent of their potential legal liability. This concern is one reason they are coming to publicly accept the reality of anthropogenic-caused global warming, and the corresponding need for regulation of greenhouse gas emissions.Despite the significance of this litigation, however, global warming actions thus far have almost all been brought in domestic rather than international forums. The only exceptions are a petition by the Inuit to the Inter-American Commission on Human Rights, and petitions by environmental groups and others to UNESCO's World Heritage Committee to include various natural sites as world heritage endangered by global warming.
