Constitutional Patriotism offers a new theory of citizenship and civic allegiance for today's culturally diverse liberal democracies. Rejecting conventional accounts of liberal nationalism and ...cosmopolitanism, Jan-Werner Mller argues for a form of political belonging centered on universalist norms, adapted for specific constitutional cultures. At the same time, he presents a novel approach to thinking about political belonging and the preconditions of democratic legitimacy beyond the nation-state. The book takes the development of the European Union as a case study, but its lessons apply also to the United States and other parts of the world. Mller's essay starts with an engaging historical account of the origins and spread of the concept of constitutional patriotism-the idea that political attachment ought to center on the norms and values of a liberal democratic constitution rather than a national culture or the "global human community." In a more analytical part, he then proposes a critical conception of citizenship that makes room for dissent and civil disobedience while taking seriously a polity's need for stability over time. Mller's theory of constitutional patriotism responds to the challenges of the de facto multiculturalism of today's states--with a number of concrete policy implications about immigration and the preconditions for citizenship clearly spelled out. And it asks what civic empowerment could mean in a globalizing world.
This book prompts a fresh look on immigrant integration policy. Revealing just where immigrants and their receiving societies interact everyday, it shows how societal inclusion is administered and ...produced at a local level. The studies presented focus on three issue areas of migration policy - citizenship, welfare services and religious diversity - and consider cities in very different national contexts. Spanning Switzerland, Italy, Germany, the Netherlands and Canada, the cases display great variety in their theoretical and methodological approaches. In all the countries considered, we see that the local level has an undeniable relevance despite differences in state structures, models of integration and centre-peripheral relations. Particularly for future migration policy research, such a complex comparative exercise thus yields an important universal realisation: the local dimension of migration policymaking matters.
A commonly expressed view is that the citizens and the Member States are destined to be overcome by the European Union. There is a sense that the Union of today is not what was intended to be created ...or acceded to by the Member States or its citizens. The Outer Limits of European Union Law brings together a diverse group of legal scholars to consider aspects of EU substantive, constitutional and procedural law in a manner highlighting the many senses in which the European Union is or can be limited and so demonstrating that the fear of being overcome is largely a false fear. By exploring the mechanisms and devices used to limit the European Union, the contributors also reveal not only the strengths of the various limits, but also and more crucially the weakness of the limits , thereby demonstrating that the prospect of being overcome may be a genuine risk to be guarded against. By considering general themes (eg legitimacy) and core subject areas (eg policing, free movement of goods, remedies) the book reveals the various techniques used by the Court of Justice, Community institutions and Member States to define and modify the outer limits of the European Union and European Union Law.

The development of competition law in the EU can be explored through three interrelated perspectives: the extent to which controversies in economic thinking affect the design of the law; how changing ...political visions about the objectives of competition law have caused shifts in the interpretation of the rules; and the institution in charge of applying the rules. The economic and political debates on competition law show that it is a contested terrain, and the way courts and competition authorities apply the law reflects their responses to the objectives and economics of competition law. By characterising the application of competition law as a continuous response to policy and economic debates, the author casts fresh perspectives on the subject. Written with competition law students in mind, Monti sets out economic concepts in a non-technical manner and explores the policy dimension of competition law by referring to key cases and contemporary policy initiatives.
Working through Barriers deals with the role host countries institutional characteristics play in the labour market integration of immigrants in the European Union. Drawing on existing research it ...develops a comprehensive conceptual framework of factors (and underlying mechanisms) affecting immigrant structural integration in the European Union-15. It maps the European countries with respect to three institutional aspects central to immigrant integration, immigration policies, labour market structure and welfare regimes. Further, it presents a descriptive picture of the labour market situation of the immigrant population in the European Union and seeks to explain the variation in labour market outcomes, namely unemployment risk and occupational status, with reference to differences in the characteristics of the immigrant populations on the one hand, and by differences in labour market structure, immigration policies and welfare regimes in European Union countries, on the other. In-depth analyses of a selected number of EU countries are carried out, with the aim of investigating the extent to which immigrants have succeeded or failed in different institutional contexts.

For the European Union of the 21st century, the search for sustainable prosperity and stability includes the challenge of reconciling democratic ideals and practices with the construction of a ...European constitutional order. From the 2001 Laeken Summit to the 2009 Lisbon Treaty and beyond EU leaders have repeatedly set out to bring citizens closer to EU governance by making it more democratic and effective yet several national ratification referendums have shown that publics are divided about whether and why to endorse or veto complex EU reform packages imposed from the top down. Despite these limitations people do effectively engage in the making of a European polity. By initiating national court proceedings active citizens are promoting fundamental European rights in Member States' practices. As party members they contribute to shaping mass media communication about, and national publics' understanding of, European political alternatives. As civil society activists citizens help build social networks for contesting certain EU reforms or advocating others. Last but not least, as voters in national and European elections they choose between competing party visions, and national parliamentary stances regarding the role of democratic citizenship. This original contribution to the debate about democratic citizenship vis-Ã -vis the challenges of economic globalization and European political integration presents critical explorations of different fields of direct, representative, participatory and deliberative democratic citizenship practices that affect the transformation of Europe.
