Kedai Ngopihub berdiri pada tahun 2021. Kedai ngopihub memiliki banyak varian menu kopi. Beragam kopi digunakan oleh ngopihub, dari jenis robusta hingga arabika. Untuk seduhannya ada berbagai jenis ...menu seperti americano, v60, vietnam drip dll. Selain kopi juga ada menu non coffee yang meliputi taro, redvalvet hingga lemon tea. Dikarenakan pesatnya penjualan yang ada, ngopihub akan membuka pendaftaran franchise atau waralaba sebagai upaya pengembangan usaha. Para investor dapat mendaftar dan bergabung pada waralaba ngopihub ini. Untuk kemudahan dalam pendaftaran dan pengembangan franchise ngopihub maka dibuatlah sebuah sistem franchise berbasis website. Sisem ini dapat menjalankan program pendaftaran dan pembelian stok barang. Sistem ini dibuat dengan metode waterfall. Dalam membangun sistem ini menggunakan PHP dan Mysql dengan menggunakan system berbasis website. Pengujian dilakukan pada fitur gabung dan fitur registrasi menggunakan pengujian blackbox. Hasil pengujian menunjukkan data valid dalam aplikasi ini.
In spite of similarities between franchise as a contract and agency, there are differences between them which have theoretical and practical aspects. In this paper we are discussing this similarities ...and differences from a comparative perspective. In many of countries, the commercial agency has regulated but the franchise contract has not this base. Because of this, using statutes about agency for resolving or analyze of problems arising from or for franchise is inevitable. This practice could endanger the rights of the parties of franchise contract. Among other things, the relationship between the franchisee and the original is not a fiduciary relationship. The franchisee does not act on behalf of the franchisor and has the right to exercise any proprietary possessions. In addition, the subject matter, obligations, degree of independence and responsibility towards third parties are different in these two contracts. In fact, the franchise contract is not compatible with the commercial agency contract and has its own nature and effects.
The purpose of this study is first to find out the pattern of dispute resolution in the franchise practice of Teh Poci, the second is to describe what the ideal pattern should be. In accordance with ...the characteristics of the existing problems, the most relevant form of approach to analyzing the above problems is empirical legal research. This research sees law as a reality in society, meaning how the law is practiced. The settlement of default on the agreement in the Tea Poci product franchise business in Ponorogo is the cancellation of the contract as a result of default and is settled on the principle of peace, namely by consulting and negotiation techniques. Ideally, under such a mechanism the franchisor should develop an internal procedure for handling complaints. However, this procedure is not stipulated in the franchise agreement and meets certain minimum standards. This standard should provide a procedure for resolving disputes. If a dispute arises, either party can initiate a complaint handling procedure under the Code of Conduct, or under a franchise agreement.Tujuan dari penelitian ini adalah pertama untuk mengetahui pola penyelesaian sengketa dalam praktek waralaba Teh Poci, kedua untuk mendeskripsikan pola yang ideal yang seharusnya. Sesuai dengan karakteristik permasalahan yang ada, bentuk pendekatan yang paling relevan untuk menganalisis permasalahan di atas adalah penelitian hukum empiris. Penelitian ini melihat hukum sebagai realitas dalam masyarakat, artinya bagaimana hukum itu dipraktikkan. Penyelesaian wanprestasi atas kesepakatan dalam usaha waralaba produk Teh Poci di Ponorogo adalah batalnya akad akibat wanprestasi dan diselesaikan dengan prinsip damai yaitu dengan teknik konsultasi dan negosiasi. Idealnya, di bawah mekanisme seperti itu pemilik waralaba harus mengembangkan prosedur internal untuk menangani keluhan. Namun, prosedur ini tidak diatur dalam perjanjian waralaba dan memenuhi standar minimum tertentu. Standar ini harus menyediakan prosedur untuk menyelesaikan perselisihan. Jika timbul perselisihan, salah satu pihak dapat memulai prosedur penanganan keluhan berdasarkan Kode Etik, atau berdasarkan perjanjian waralaba.
This article aims to understand how the entrepreneurial orientation (EO) of the franchise system may impact franchisor–franchisee relationship quality, given the conflicting forces for ...standardization/uniformity and franchisee desire for autonomy. A cross-sectional research design, involving a mail questionnaire survey, was employed to collect data from a sample of franchisors operating in the UK. The hypotheses specified in the study were tested using regression (including moderated regression) analyses. The results revealed that EO was significantly and positively related to relationship quality (as perceived by the franchisor). In addition, the recruitment of entrepreneurial franchisees was found to have a positively significant impact on relationship quality. The structural support systems used by franchisors to encourage franchisee entrepreneurial activities were not found to moderate the relationship between EO and relationship quality. The results suggest that systems with EO and entrepreneurial franchisees may enjoy better relations.

Research on contractual governance has traditionally viewed exchange hazards as having mutual effects on contractual design at the transaction level. To advance our understanding of contracting ...decisions in interorganizational relationships, I depart from the traditional emphasis on the mutual aspects of interorganizational relationships by examining how exposure to idiosyncratic exchange hazards may impact the divergent contractual arrangement interests of each side of the dyad. Viewing the locus of exchange hazards and contract design as dyadic broadens the conventional emphasis on the add-on perspective of governing relationships to further emphasize how excluding contractual rights selectively may be an alternative way for controlling the threat of exchange hazards. Through an analysis of franchise disclosure documents and contracts for 136 restaurant franchise systems in the U.S., I found that, when confronted with exchange hazards, a firm can strengthen its own protection not only by enhancing contractual rights in its own interests but also by limiting contractual rights in favor of its partner. With a dyadic perspective, my paper sheds new light on the discriminating alignment principle and generates new insights into the strategic implications of intentionally leaving gaps in contracts.

Franchising is an important form of entrepreneurship, but literature explaining franchising strategy and performance is scarce. This study adapts the resource-based view and relationship-marketing ...theory to explain franchising strategy and performance differences in chain stores. This study develops and tests a model explaining franchisees' performance antecedents and their intention to remain in the franchise system. The model describes how franchisees' strategies relate to knowledge sharing, trust, conflict management, brand reputation, and performance in chain stores. The study uses data from 246 active franchisees from a chain-store franchise system in Taiwan. Data analysis uses structural equation modeling (SEM) and fuzzy set qualitative comparative analysis (fsQCA). Results show that knowledge sharing, trust, conflict management, and brand reputation are key factors in reinforcing franchisees' intention to remain and financial performance within the franchise system. The study ends with a discussion of theoretical and managerial implications.

The objective of this work is to initiate research on franchising in Morocco. It focuses on the internationalization of Moroccan franchise networks, both international Moroccan networks and domestic ...networks that intend to internationalize in the coming years. It focuses on measuring the factors influencing the intention to internationalize by Moroccan franchisors. The objective is to analyze the environmental factors that explain the intention to internationalize by Moroccan franchisors. To do this, A survey conducted to 43 managers of international development of Moroccan franchise networks revealed that 30% of Moroccan networks are already present abroad are considering new locations, and 70% of the networks active on the national territory alone wish to go abroad in the next few years. Using the discriminant analysis method, this research highlights the influence of institutions and external agents on the intention to internationalize of Moroccan franchisors. L’objectif de ce travail est d’initier des recherches sur la franchise au Maroc. Il met l’accent sur l’internationalisation des réseaux marocains de franchises, à la fois des réseaux marocains internationales ou encore des réseaux domestiques qui comptent s‘internationaliser dans les années à venir. Il porte sur la mesure des facteurs influençant l‘intention de s’internationaliser chez les franchiseurs marocains. L’objectif est d’analyser les facteurs environnementaux explicatifs de l‘intention de s‘internationaliser chez les franchiseurs marocains. Pour ce faire, une enquête menée auprès de 43 responsables de développement international des réseaux marocains de franchise a révélé que 30% des réseaux marocains sont déjà présents à l'étranger envisagent de nouvelles implantations, et 70% des réseaux actifs sur le seul territoire national souhaitent s'y lancer dans les prochaines années. En utilisant la méthode de l’analyse discriminante, cette recherche met en évidence, l’influence des institutions externes et des agents externes sur l’intention de s’internationaliser chez les franchiseurs marocains.
