This third book in the Criminalization series examines the constitutionalization of criminal law. It considers how the criminal law is constituted through the political processes of the state; how ...the agents of the criminal law can be answerable to it themselves; and finally, how the criminal law can be constituted as part of the international order. Addressing the ways in which and the grounds on which types of conduct can be justifiably criminalized, the first four chapters of this volume focus on the questions that arise from a consideration of the political constitution of the criminal law. The chapters then turn their attention to the role of the state, its institutions and officials, and their role not only as creators, enactors, interpreters, and enforcers of the criminal law, but also as subjects of it. How can the agents of the criminal law also be answerable to it? Finally, the discussion turns to how the criminal law can be constituted as part of an international order. Examining the relationships between domestic laws of different nation-states, and between domestic criminal law and international or transnational law, the chapters also look at the authority and jurisdiction of international criminal law itself, and its relationship to other dimensions of the international order.
This book aims to honour the work of Professor Mirjan Damaška, Sterling Professor of Law at Yale Law School and a prominent authority for many years in the fields of comparative law, procedural law, ...evidence, international criminal law and Continental legal history. Professor Damaška’s work is renowned for providing new frameworks for understanding different legal traditions. To celebrate the depth and richness of his work and discuss its implications for the future, the editors have brought together an impressive range of leading scholars from different jurisdictions in the fields of comparative and international law, evidence and criminal law and procedure. Using Professor Damaška’s work as a backdrop, the essays make a substantial contribution to the development of comparative law, procedure and evidence. After an introduction by the editors and a tribute by Harold Koh, Dean of Yale Law School, the book is divided into four parts. The first part considers contemporary trends in national criminal procedure, examining cross-fertilisation and the extent to which these trends are resulting in converging practices across national jurisdictions. The second part explores the epistemological environment of rules of evidence and procedure. Criminal Policy in Transition comes along at a time when the literature in criminology is desperately short of “global” perspectives. The authors write knowledgeably about their home societies without being prematurely bounded by comparative criteria. As a result,they develop a complex and uneven image of similarities and differences, of divergence and convergence through time. In this sense the collection offers a model of how international collaborative work should proceed. The book is the product of a workshop held at the International Institute for the Sociology of Law (IISL) in Onati, Spain. The IISL is a partnership between the Research Committee on the Sociology of Law and the Basque Government.
Il saggio affronta il tema del ne bis in idem
internazionale, sintagma con il quale si designa l efficacia
preclusiva che un provvedimento giudiziale emanato dall organo
giurisdizionale di un ...determinato Paese assume in diverso
ordinamento statuale. L introduzione si sofferma innanzitutto
sull emersione storica del principio del ne bis in idem negli
ordinamenti europei, cercando di cogliere inoltre profili
dogmatici e risvolti di stringente attualità della figura. Si delinea
poi l attuale scenario internazionale dove ancora persistono
resistenze notevoli all affermazione della regola come norma
di diritto internazionale generale. Del pari, si sottolineano gli
sviluppi relativi in particolare all esperienza dei tribunali
internazionali e del c.d. spazio giuridico europeo. Tale disamina
procede ab imis: si tracciano i principali sviluppi normativi che
segnano la creazione di uno spazio giuridico europeo il cui
collante risiede nella tutela dei diritti fondamentali. Aspetto che
assume peculiare rilievo nel c.d. terzo pilastro dove si asserisce
l esistenza di una dialettica tra i vari custodi del patrimonio di
valori su cui si fonda la regione europea. Nel catalogo dei
principi converge anche il ne bis in idem che attraverso una
graduale evoluzione normativa e giurisprudenziale assurge a
diritto fondamentale dell individuo, ricavabile da un generale
principio di affidamento che salvaguardia la posizione giuridica
del già processato. L indagine cerca inoltre di sottolineare i limiti
necessari della regola ravvisati nel possibile abuso consistente
nella scelta di un forum conveniens e nel rispetto delle regole
del giusto processo che altrimenti mutano il principio
nell indebito riconoscimento di un giudicato iniquo. Il saggio
si chiude con l osservazione dell atteggiarsi della regola sul
piano della cooperazione giudiziaria, con peculiare riguardo per
il mandato di arresti europeo, strumento di recente conio che
consegna un edizione del ne bis in idem assai distante dalla
tradizionale dimensione estradizionale del principi.
