This article focuses on copyright and related rights related to music and near-music works (literary, scientific) in the media environment. The key legal issues of right holders and users are ...investigated on the basis of the modern Russian law (Civil Code), and on examples from practice of broadcasters, leading music education institutions and scientific databases. The emphasis is on the music art, literature and science in the digital space of Internet, which today is associated with the largest number of creative innovation, and in which accordingly, there is the greatest number of violations of copyright and related rights. In this regard, the author proposes to amend the current Russian legislation to allow the creation of the organization managing the intellectual property rights in the web on a collective basis.
Hrvatsko knjižničarsko društvo provodi jednogodišnju Nacionalnu kampanju za osobe s teškoćama čitanja i disleksijom “I ja želim čitati!” (2016.–2017.). Suorganizatori Kampanje su Nacionalna i ...sveučilišna knjižnica u Zagrebu i Knjižnice grada Zagreba. Kampanja ima brojne partnere među kojima se ističu Edukacijsko-rehabilitacijski fakultet, Hrvatsko logopedsko društvo, Hrvatska udruga za disleksiju, sve vrste knjižnica, škole, vrtići i nakladnici. U članku se predstavlja Kampanja, njezin nastanak, ciljevi, ciljne skupine stanovništva kojima je namijenjena, partneri, pregled aktivnosti i komunikacija u Kampanji te vizualni identitet i zagovaranje Kampanje. Kampanjom se informira, educira i senzibilizira šira javnost o problemima i potrebama osoba s teškoćama čitanja i disleksijom te se nastoji poboljšati kvaliteta života te skupine ljudi. Predlaže se izmjena postojećeg Zakona o autorskom pravu i srodnim pravima (NN 167/03, čl. 86) u dijelu koji se odnosi na korištenje autorskih djela za potrebe osoba s invaliditetom, tj. njegovo proširenje na osobe koje iz bilo kojeg razloga ne mogu čitati standardni (crni) tisak. Zalaže se za poboljšanje međuinstitucionalne suradnje stručnjaka koji se bave osobama s teškoćama čitanja i disleksijom te povećanje broja knjižnica koje provode posebne programe za tu skupinu korisnika.
Croatian Library Association is managing a year long National Campaign for Persons with Reading Difficulties and Dyslexia “I Want to Read Too!” (2016.-2017.). National and University Library in Zagreb and Zagreb City Libraries are co-organizers of the Campaign. The Campaign has a multitude of partners amongst which are the distinguished Faculty of Education and Rehabilitation Sciences, Croatian Logopedic Association, Croatian Dyslexia Association, all types of libraries, schools, kindergartens and publishers. The paper presents the campaign, its inception, objectives, activities, key social groups to which the campaign is aimed at, as well as the visual identity and promotion of the campaign. The campaign informs and educates people as well as sensitizes the broad public about the problems and needs of people with reading difficulties and dyslexia that are print disabled. The campaign also strives to improve of the quality of life for this group of people. The campaign also suggests an amendment of the current Copyright and Related Rights Act (Article 86) which refers to the use of the authors’ work for the needs of people with disabilities. The suggested change in the legislation aims to make the Copyright and Related Rights Act also include people who, for any reason, cannot read standard print. The Campaign aims to improve interinstitutional cooperation of experts who work with people with reading difficulties and dyslexia who are print disabled and to increase the number of libraries who conduct special programmes for this group of users.
La normativa actual sobre derechos de autor en Ecuador protege el guion de teatro, las obras dramáticas o teatrales, las coreografías y pantomimas. Por otro lado, los derechos conexos protegen las ...actuaciones del artista, intérprete o ejecutante de una obra previamente existente. Sin embargo, quienes hayamos asistido alguna vez como espectadores a alguna obra teatral, ópera, espectáculo circense, ballet, etc., sabemos que la obra escénica bien puede apreciarse como un todo, es decir, como un solo espectáculo, pero también como un conjunto de elementos con un menor o mayor grado de creatividad que merecen una protección suficiente. Las normas jurídicas nacionales, comunitarias e internacionales brindan diferentes formas y niveles de protección a los titulares de derechos de autor y derechos conexos en la medida en que sus obras (en el caso de los autores) o sus actuaciones e interpretaciones (en el caso de los artistas, intérpretes o ejecutantes) sean originales o alcancen un alto nivel de creatividad. El presente ensayo pretende entonces identificar la legislación aplicable a las artes escénicas y sus elementos creativos en Ecuador y el alcance de su protección.
The intellectual property rights (IPR) are intangible in nature and gives exclusive rights to inventor or creator for their valuable invention or creation. In present scenario of globalisation, IPR ...is the focal point in global trade practices and livelihood across the world. These rights boost the innovative environment by giving recognition and economic benefits to creator or inventor whereas the lack of IPR awareness and its ineffective implementation may hamper the economic, technical and societal developments of nation. Hence dissemination of IPR knowledge and its appropriate implementation is utmost requirement for any nation. The present paper highlights various terms of IPR such as patents, trademarks, industrial designs, geographic indications, copyright, etc with their corresponding rules, regulations, their need and role especially pertaining to Indian context. Further, status of India’s participation in IPR related activities across the world has been discussed in brief.
In retrospect, perhaps the most significant innovation to have been introduced into the law of copyright and related rights by the WIPO Copyright Treaty and the WIPO Performers and Phonograms Treaty ...of 1996 was the new restricted act of "making available to the public" for both copyright in the strict sense and for related rights in sound recordings and fixations of performances, although for copyright such restricted act is also included within the broader restricted act of "communication to the public". Enacted in the European Union by Directive 2001/29/EC on the Copyright in the Information Society, this type of restricted act has been the subject of more case law at the Court of Justice of the EU than any other provision of this Directive, which has in turn been the subject of more case law than all other EU copyright and related rights Directives together. This article reviews how such case law has developed, and how the Court of Justice has sought to modify its initial formulation of this type of restricted act in the context of its application to various activities on the Internet.
El 17 de mayo de 2019 una nueva Directiva sobre derechos de autor y derechos conexos en el entorno digital fue publicada en el Diario Oficial de la Unión Europea. Con el objetivo de reequilibrar ...fuerzas en el mercado de derecho de autor, esta Directiva confiere nuevas responsabilidades a los prestadores de servicios en línea que brindan acceso a contenidos cargados por sus propios usuarios, así como un nuevo derecho a las editoriales de prensa sobre sus publicaciones. Dado que es probable que en otras jurisdicciones se pretenda seguir esta iniciativa, es pertinente efectuar un análisis sobre sus posibles efectos jurídicos y económicos. Para ello, en este artículo se propone realizar una comparación entre la regulación anterior a esta Directiva y los cambios que ella plantea en relación con los prestadores de servicios en línea y las editoriales de prensa. Asimismo, se traen a colación observaciones sobre los posibles impactos en el mercado. Al final se concluye que, si bien la Directiva ofrece soluciones para proteger industrias creativas, es posible que erija obstáculos para el desarrollo de modelos empresariales innovadores en internet.
At present, the press publisher is in such an uncomfortable situation when it provides funding and the organization of the press, and at the same time isn’t able to protect the resulting content. ...This is the result of legislation that is aligned with current business models using press content created by others. The article presents an analysis of various normative acts that shape the legal situation of publishers. The text highlights the most important collisions of legal regulations and reality. The article discusses a draft regulation amending the copyright law at European Union level, proposing the introduction of rights related to the publisher. In addition, consideration was given to the possibility of applying or implementing the proposed EU regulation in Polish reality.
In this paper the author discusses the legal policy reasons for the introduction of different forms of copyright and related rights' protection of publishers, existing in Serbian and comparative law: ...right of first publisher of previously unpublished work, publisher's right to a levy, right of publisher of critical and scientific publications, and right of online news publishers. It is argued in favour of a separate regulation of each of publisher's rights and pointed out to their different subject, content and object of protection. Although related rights of publishers are generally prescribed with a view to ensuring the protection of a commercial undertaking, the author also identifies certain reasons of cultural policy which led the legislator to provide for the legal protection of publishers of works already in public domain. Only the need to recompense the person who made available to the public a work which would otherwise remained practically unknown could justify such intervention into the public domain. Finally, it is concluded that the protection of online news producers in case of the making available of the parts of their media coverage by news aggregators could be seen as an instrument of protection against unfair competition.
How to reconcile the free flow of information on the internet and copyright protection? That is the fundamental issue underlying the preliminary questions referred to the CJEU in the GS Media case. ...After Svensson and BestWater, this case again offered an opportunity for the Court to clarify how hyperlinks to works protected by a copyright should be treated under the EU copyright law framework. In these previous cases, the Court had already established that the provision of a hyperlink to a website where a work protected by a copyright was freely available with the consent of the copyright holder was not an infringement of EU copyright law. In GS Media, the CJEU had to decide whether the posting of a hyperlink to such a work published on a website without the authorisation of the copyright holder was an infringement of EU copyright law, in particular of the right of communication to the public, ensured by Art. 3, para. 1, of the Directive 2001/29, of certain aspects of copyright and related rights in the information society.
This text will analyse how the remuneration for authors and owners of related rights in music, film and similar entertainment industries should be determined. Since they can exercise their rights ...individually and collectively, the systems and criteria for setting the amounts of remuneration in individual and collective management will be examined. This analysis will be put in a traditional and in the online context.
