The capacity to abuse, or in general affect the enjoyment of human, labour and environmental rights has risen with the increased social and economic power that multinational companies wield in the ...global economy. At the same time, it appears that it is difficult to regulate the activities of multinational companies in such a way that they conform to international human, labour and environmental rights standards. This has partially to do with the organization of companies into groups of separate legal persons, incorporated in different states, as well as with the complexity of the corporate supply chain. Absent a business and human rights treaty, a more coherent legal and policy approach is required.
Faced with the challenge of how to effectively access the right to remedy in the European Union for human rights abuses committed by EU companies in non-EU states, a diverse research consortium of academic and legal institutions was formed. The consortium, coordinated by the Globernance Institute for Democratic Governance, became the recipient of a 2013 Civil Justice Action Grant from the European Commission Directorate General for Justice. A mandate was thus issued for research, training and dissemination so as to bring visibility to the challenge posed and moreover, to provide some solutions for the removal of barriers to judicial and non-judicial remedy for victims of business-related human rights abuses in non-EU states. The project commenced in September 2014 and over the course of two years the consortium conducted research along four specific lines in parallel with various training sessions across EU Member States.
The research conducted focused primarily on judicial remedies, both jurisdictional barriers and applicable law barriers; non-judicial remedies, both to company-based grievance. The results of this research endeavour make up the content of this report whose aim is to provide a scholarly foundation for policy proposals by identifying specific challenges relevant to access to justice in the European Union and to provide recommendations on how to remove legal and practical barriers so as to provide access to remedy for victims of business-related human rights abuses in non-EU states.

In General Principles for Business and Human Rights in International Law Ludovica Chiussi Curzi offers a critical analysis of the relevance of general principles of law in the multifaceted business ...and human rights field.
This article analyses the challenges that online marketplaces and e-commerce pose to traditional product liability doctrines. It uses a comparative perspective to examine whether an online platform ...can be liable to a consumer for a defective product purchased on its platform, and the adaption of product liability law to this challenge in a series of jurisdictions. It reflects on the role of litigation and regulation, focusing on Europe and the United States, and considers reform in a number of jurisdictions in this area. It concludes with proposals for increasing the accountability of online marketplaces for products sold on their websites.
This fully updated second edition of Corporate Accountability in International Environmental Law examines systematically all international sources of corporate accountability standards with specific ...reference to environmental protection, and elaborates on their theoretical and practical implications for international environmental law.
This book presents a comprehensive comparative analysis of the substantive and procedural aspects of compensation for wrongful convictions in European countries and the USA, as well as the standard ...derived from the case law of the European Court of Human Rights. The collection draws comparative conclusions as to the similarities and differences between selected jurisdictions and assesses the effectiveness of the national compensation schemes. This enables the designing of an optimum model of compensation, offering accessibility and effectiveness to the victims of miscarriages of justice and being acceptable to jurisdictions based on common law, and civil law traditions, as well as inquisitorial and adversarial types of criminal process. Moreover, the discussion of the minimum European standard as established in the case law of the European Court of Human Rights enables readers to identify how the Strasbourg Court can contribute to strengthening the compensation scheme. The book will be essential reading for students, academics and policymakers working in the areas of criminal law and procedure.
Although the National Transportation Safety Board has strongly recommended the application of collision avoidance warning systems and automated emergency braking (CAWS/AEB), the transit industry has ...lagged behind autos and trucks. CAWS/AEB for buses is more complex than for cars and trucks and represents a niche market. If bus manufacturers and suppliers are to invest in developing this technology, they will need to be convinced there is a market for it. Transit agencies also will need to be convinced that the technology works and is affordable. For both vendors and purchasers, a business case could be made that some or all of the expense of procuring and deploying the technology can be recovered through savings from reduced insurance premiums and claims payouts by preventing or mitigating collisions. This paper describes two methods for estimating the business case for equipping transit buses with CAWS/AEB. First, industrywide data on the numbers of collisions and casualty and liability expenses incurred by transit agencies were examined, and statistical relationships were modeled to determine whether reducing the numbers of collisions would reduce casualty and liability expenses. Second, individual collision claims records for specific transit agencies were examined to determine whether the collisions could have been prevented by CAWS/AEB, and the potential savings.

New perspectives on the role of collective responsibility in modern politics States are commonly blamed for wars, called on to apologize, held liable for debts and reparations, bound by treaties, and ...punished with sanctions. But what does it mean to hold a state responsible as opposed to a government, a nation, or an individual leader? Under what circumstances should we assign responsibility to states rather than individuals? Leviathan on a Leash demystifies the phenomenon of state responsibility and explains why it is a challenging yet indispensable part of modern politics.Taking Thomas Hobbes' theory of the state as his starting point, Sean Fleming presents a theory of state responsibility that sheds new light on sovereign debt, historical reparations, treaty obligations, and economic sanctions. Along the way, he overturns longstanding interpretations of Hobbes' political thought, explores how new technologies will alter the practice of state responsibility as we know it, and develops new accounts of political authority, representation, and legitimacy. He argues that Hobbes' idea of the state offers a far richer and more realistic conception of state responsibility than the theories prevalent today, and demonstrates that Hobbes' Leviathan is much more than an anthropomorphic "artificial man." Leviathan on a Leash is essential reading for political theorists, scholars of international relations, international lawyers, and philosophers. This groundbreaking book recovers a forgotten understanding of state personality in Hobbes' thought and shows how to apply it to the world of imperfect states in which we live.
Rights review in public law typically pits the rights of the individual against the interests of the government. However, the recent introduction of fundamental rights into private law raises the ...question as to how competing rights- based claims may be reconciled, given that both parties are able to plead the protection of fundamental rights in support of their respective positions. This article proposes that the 'double proportionality' test, which enables the interference with the rights of both parties to be assessed respectively to determine whether it is proportionate, represents the most promising solution to this difficulty. The test allows the courts to give sufficient attention to the rights of all involved, and just as importantly, enables courts to be seen as doing so. The article will also examine the jurisprudence on this area and criticise the courts' failure to apply the double proportionality test satisfactorily (or at all) in conflicting rights cases. Keywords: double proportionality; balancing fundamental rights; constitutionalisation of private law; horizontal effect of fundamental rights.
Contract law affects behavior not just directly, by ordering damages, but also indirectly, by providing information on how the parties to the dispute behaved. Information from litigation can then ...help third parties decide whether to do business with the disputants going forward. Contract law thus affects behavior by shaping reputations and facilitating market discipline. This Article examines contract law's liability standards, defenses, and remedies doctrines from an information-production perspective, and generates the following three contributions.
