  • Procedural aspects of regulating the right to information [Elektronski vir]

    The right to (access public) information is of key importance in contemporary society and represents a fundamental principle of democracy that allows individual citizens, NGOs, business entities, and ... other parties to acquire information influencing public governance. Such right is regulated with the aim of ensuring predictable and stable democratic control of public bodies and to enhance public participation and the transparency of the decision-makingprocess, mainly following the US model of the Freedom of Information Act with a special law further defining the characteristics of administrative procedure. The comparative analysis of selected countries (USA, Ireland, Sweden, Austria, Germany, Slovenia, Croatia) included here in proves that procedural institutions, such as set time limits and legal remedies (appeal to an independent commissioner or judicial review), contribute to a significantly higher level of implementation of the right to information in practice.
