  • Constitutional procedural guarantees in arbitration proceedings

    The author analyses on a comparative basis the exercise of the right to be heard in arbitration proceedings, particularly in light of Article 6 of the European Convention on Human Rights which ... guarantees a certain quality of relationship between the party and the body deciding its rights. Furthermore, the author analyses the issue allowing review of arbitral awards by constitutional courts, submissions in arbitration proceedings, particularly when applying stricter arbitration rules i.e. revising the request that all relevant correspondence shoul be personally delivered to the party, the guarantee of active participation and influence on the course of events and the result of the proceedings, restrictions of the rights of the parties or arbitrators to regulate the evidentiary proceedings, problems of use of illegally obtained evidence, conducting the proceedings in the manner the arbitrators deem appropriate, exclusions in relation to presentation of facts and evidence, the right of a party to state its views on facts and evidence and the right to express its legal standpoints, duties or rights of the tribunal to explain its legal views to the parties and giving grounds for arbitral awards.
