    The paper deals with the question whether Article 6 of the European Conventionon Human Rights relates also to arbitration. The author rejects the view that by concluding an arbitration agreement the ... parties waive the right to court which is guaranteed by the Convention, because it is not in accordance with the notion and purpose of arbitration. When the parties consent to resolve their disputes by arbitration they only choose a different way of judicial protection which is in its effects equal to the judicial protection given by state courts. Therefore, according to the author, the standards of "fair" trial which derive from Article 6 of the Convention must be observed also in arbitration. While an arbitral tribunal is not a statebody the arbitration proceeding cannot directly be subject to the Convention control. However, the parties must have the right to bring their case before the Convention's bodies when they have not succeeded to redress the violations made by arbitral tribunal in a proceeding before a state court.
