Certification trainings for court-annexed mediators have been conducted in Indonesia since 2003; however, the curriculum fails to include domestic and family violence and the impacts of gender and ...the abuse of power on women and children, which are crucial in a patriarchal country such as Indonesia. The authors contend that it is imperative to include these topics in the curriculum to raise mediators' awareness of the influence of patriarchy, on themselves and the disputants and on the process and outcomes for women and children. The authors assess the development and training of court annexed mediators in Indonesia and recommend changes to the current certification training curriculum, the development of national competency standards and a code of ethics and funding for research.
The present paper reports on the findings of a research project involving a literature review and telephone interviews with children whose parents had separated or divorced. The aim of the research ...was to hear children's accounts of their experiences and needs during the transition in order to inform the development of a child-centred model of service delivery. The author recommends a number of strategies to assist service providers to enhance the wellbeing of children experiencing family separations.

She is the inaugural and continuing President, Asia Pacific Mediation Forum and has trained mediators worldwide. Elisabeth Porter is Head of School of International Studies at the University of South Australia. Research indicates that the most commonly reported form of abuse of older people in Australia is financial abuse and the majority of perpetrators are family members. The number of people aged 65 ...years and over in Australia is growing rapidly and the challenges of aging often require support and assistance from family members, so it is important to develop strategies to prevent this form of abuse. This article analyses data from two national online surveys that examined this issue. The first, conducted in 2009, explored service providers' (n=214) knowledge and understandings of financial abuse of older people. The second, conducted in 2010, investigated older people's and their family members' (n=113) views and experiences of financial abuse. In our sample, service providers' knowledge of risk factors for financial abuse of older people mirrored the experiences of older people and their family members in Australia and also confirmed factors identified in the literature. However, our findings also showed that many older people were not mindful of the potential risks to their financial wellbeing, particularly when and if they experience diminished capacity. Therefore, service providers may find it difficult to engage them in preventative strategies.

This article examines different perceptions of justice and rights in relation to land disputes in Cambodia. The concept of economic land concessions (ELCs) has created contesting and conflicting ...discourses as different groups and individuals give diverse meanings to land and development. Research demonstrates how the meanings given to "justice" and "rights" in relation to ELCs reflect ways in which power circulates and is exercised and there is a lack of procedural justice in the formal and informal dispute resolution processes available to the rural Cambodians who are affected. Those who have more power benefit from ELC development, while local villagers are marginalized and oppressed in the development process.

A Western model of court-annexed mediation was introduced into the Indonesian courts in 2003, but has been relatively unsuccessful. The authors argue that one factor contributing to this is the ...failure of mediators to use culturally appropriate approaches and emphasize the need for mediators to be trained to be culturally fluent and self-reflexive. They analyze cultural factors relevant to mediation with participants from diverse cultural backgrounds and implications for training. 'Musyawarah mufakat', the indigenous way of resolving disputes, is compared to a Western interest-based model of mediation and a case study illustrates how the process can incorporate an indigenous approach.
Sharia court-annexed mediation was first implemented in the Indonesian judiciary system in 2008. The majority of mediators in Sharia courts are male judges who are obligated by civil procedure law to ...initially settle disputes amicably prior to the litigation process. The authors argue that court-annexed mediation has the potential to be the champion of Indonesian legal reform as it has similar characteristics to 'musyawarah', the indigenous way of resolving conflicts. However, given the prevalence of violence against women in disputes arising from separation and divorce, mediators must have appropriate awareness, knowledge, skills, and techniques to identify, understand, and handle these cases.
