Posljednjih desetljeća mnogo znanstvenih istraživanja sugerira da pravedno i korektno postupanje prema osumnjičenicima tijekom ispitivanja može potaknuti te osobe na suradnju i pružanje informacija ...relevantnih za istragu. Polazeći od navedenog, u radu se najprije skreće pozornost na razvoj i temeljne odrednice etičkog pristupa ispitivanju osumnjičenika koji u potpunosti odbacuje akuzatorske metode prisile i manipulacije tijekom ispitivanja. Etičko ispitivanje promiče poštovanje ljudskih prava kako bi se prikupile točne i pouzdane informacije od osumnjičenika i minimizirao rizik od lažnih priznanja. Zaključno, u radu se sagledava univerzalna perspektiva znanstveno utemeljenog modela etičkog ispitivanja na temelju predstavljanja Méndezovih načela učinkovitog intervjuiranja te naglašava važnost globalne tranzicije prema pravičnosti i odgovornosti tijekom ispitivanja.
Human trafficking has been identified as a growing concern across the globe, however, little is known regarding the attitudes of criminal justice actors, notably prosecutors. To address this gap, ...prosecutors from Bosnia and Herzegovina were surveyed to gain an understanding of their experiences and attitudes related to sex trafficking. Findings suggest that over half of the prosecutors surveyed had worked with sex trafficking victims. Results also indicate a small portion of prosecutors held punitive attitudes for victims, but a significant majority held them for traffickers and customers. In addition to the presentation of findings related to training and knowledge held by prosecutors, limitations and implications are also discussed.
Over the past five decades two parallel bodies of literature have emerged; one examines intimate partner violence (IPV), the other examines the overlap between victimization and offending. Until ...recently, these two bodies of literature had yet to intersect. The current study provides an exploratory investigation into the overlap between victimization and offending within IPV with a Bosnian adult sample. Utilizing self-report data, 200 Bosnian adults were classified into one of four distinct groups: nonviolent (no history of IPV victimization and/or IPV perpetration), victims (history of IPV victimization only), offenders (history of IPV perpetration only), and victim–offenders (history of IPV victimization and IPV perpetration). Over half of the sample (54%) indicated no prior experiences with IPV within their intimate relationships (current or past). For individuals who characterized their intimate relationships as volatile, analyses indicated that more individuals were involved in mutually violent (having experienced both victimization and perpetration) relationships than solely exclusive behaviors (having experienced only victimization or engaged in perpetration but not both). Moreover, a series of bivariate and multivariate analyses revealed important demographic and behavioral differences between the groupings. Policy implications, as well as suggestions for future research, are presented.
Bosnia and Herzegovina has taken a prohibitionist stance when it comes to the commercial sex trade. In the last decade, legislation has been passed outlawing the solicitation, procurement, and ...enticement of prostitution. Yet, the country continues to be criticized by the international community for failing to adequately address the sex trade within the country, which is cited as a contributing factor in the country’s delayed accession into the European Union. Furthermore, little is known regarding how criminal justice (CJ) practitioners (current and future) view the sex trade, including their support for current legislation prohibiting prostitution. This is an important line of inquiry as prior research indicates practitioner behavior may be influenced by attitudinal beliefs. As such, this study set out to evaluate practitioners’ support for various CJ responses to the sex trade (e.g., legalization of prostitution, the arrest, imprisonment, and/or deportation of various actors within the sex trade) as well as uncover what factors are related to this support, including professional experience and/or participant sex. Bivariate and logistic regression results primarily indicate differences between the groups with regard to their attitudes toward prostitution and misperceptions of human trafficking. Implications from these findings as well as limitations and suggestions for further research are discussed.
This paper describes a concept of community policing in Bosnia and Herzegovina, and analyses domestic and international efforts to implement community policing in this country. Furthermore, the paper ...is based on the interview results of 90 police officers of Canton Sarajevo, where findings indicate that officers are very much confused about the meaning of community policing. However, with the aim of refocusing the work of law enforcement agencies from traditional policing to community-based policing, several practice-oriented projects have been carried out by local and international actors and a Community Policing Strategy has been adopted as well.

Iz brojnih razloga tradicionalni mehanizmi oduzimanja imovinske koristi ostvarene kaznenim djelom nisu uspješni u zahvatu u imovinu počinitelja kaznenih djela te tako ugrožavaju učinkovitost cijeloga ...sustava kaznenoga pravosuða i legitimiranje pravnoga poretka. Prošireno oduzimanje imovinske koristi pribavljene kaznenim djelom, kao poseban modalitet oduzimanja nezakonito stečene imovinske koristi, načelno ima svojih prednosti, poput oslobaðanja države od dokazivanja konkretnih kaznenih djela i prebacivanja tereta dokazivanja, barem djelomice, na počinitelja. U radu su analizirane odredbe dva europska zakonodavstva koja imaju različite pristupe u pravnom ureðenju proširenoga oduzimanja imovinske koristi, a ujedno su meðu prvima uzakonila prošireno oduzimanje. Tri su elementa konstrukta proširenoga oduzimanja kroz koja je smisleno diskutirati o relevantnom pravnom okviru: a) za koja se kaznena djela može primijeniti taj režim oduzimanja, b) koje okolnosti upućuju na deliktno podrijetlo imovine, odnosno u kojoj je mjeri opravdan zahvat u imovinu, te c) koja prava ima držatelj stvari ili prava u objašnjavanju podrijetla imovine za koju se sumnja da je nezakonito stečena. Načelno se čini da je rizik zahvata u imovinu koja je zapravo zakonito stečena i time nepravednosti sustava oduzimanja veći ondje gdje se primjenjuju pravne pretpostavke o deliktnome podrijetlu imovine, dakle ondje gdje je na snazi potpuni obrat dokazivanja zakonitosti podrijetla imovine. Snažne postupovne garancije i fokus na vrjedniju, odnosno imovinu koja je u nerazmjeru sa zakonitim prihodima počinitelja značajno reduciraju takve rizike. Oba su pristupa (potpuni i podijeljeni obrat dokazivanja) načelno izdržala test pravičnosti, razmjernosti i racionalnosti u postupcima pred najvišim sudbenim instancama. Ostaje otvoreno kriminalnopolitičko pitanje učinkovitosti u suprotstavljanju kriminalitetu, pogotovo teškim oblicima.

Research/paper limitations: The paper is based on a review of research, and typically for this type of research offers only some perspectives on possible interpretations of the current developments of police cooperation practices in Europe.
Results/Findings: Police co-operation in Europe has a long and rich history, and over a long period of time of various police co-operation initiatives, the continuity and development of the legal framework and practices of co-operation has been noticeable.
General conclusion: Due to a number of historical, political and wider social processes, Europe is an authentic source for the emergence and development of very important mechanisms of international police cooperation that are further developing.
