Elle invite à prendre en considération la projection dans l’autre sexe, non pas seulement comme une opportunité, mais comme une impérieuse exigence.

century in France. In a society marked by sexual binarity, one can nevertheless discover in unpublished archives women who lived as men and, exceptionally, men who lived as women. These transgender existences exhibit all social backgrounds, especially the poorest people. The performative intensity can be read first of all in the physical appearance recomposed by the clothing and the haircut. But more than that, it can be appreciated through the ability to integrate the sociability of the chosen gender into daily life. It is striking, especially among the most humbles, by its fullness and duration, by its irrevocable character when it is not forced, by the audacity and freedom that nourish it. It invites us to take into consideration the projection into the other gender not only as an opportunity but as an imperious necessity.

En revanche, en annihilant tout esprit de famille et en préférant des affections electives â ses liens biologiques, La Bigne méprise les regles de succession qui protegent, notamment â travers ...l'héritage des enfants, la transmission familiale des patrimoines. Elle acheve ainsi dans la coherence son existence transgressive de courtisane de la upper class (Houbre 16). Rédigé pour ľessentiel les 24 et 25 février 1906, puis amende par une dizaine de codicilles s'échelonnant entre le 6 mai 1906 et le 29 juillet 1910, le jour méme de sa mort, le testament apparaît, au fil de ses seize pages manuscrites égrenant la distribution réfléchie ou emotive des legs, comme une ultime et puissante figure d'un art de ľamitié singulier. Cette dynamique invite â réfléchir sur les modalitás du dispositif mis å l'œuvre, ses oscillations et leur expression dans une culture materielle de ľamitié.
In the nineteenth century French tribunals repeatedly had to rule on requests for marriage annulments by husbands and wives complaining of having been deceived concerning the true sex of their ...spouses. The legal pretext – mistaken identity – was based on divergent interpretations of the sex of the offending spouse because of biological characteristics argued to be insufficiently clear to establish the sexual alterity required by the institution of marriage. Unusual and scandalous, these trials caused a great stir well beyond the localities in which they took place, as well as sparking open andsometimes heated debates between jurists and physicians. By evoking the details of these cases of marriage annulment and comparing the views of the judges and the medical practitioners with the attitudes of the subjects in question, this article aims to contribute to rethinking the fragility and porosity of the physical, social and symbolic boundaries between the sexes.
Au XIXe siècle, les tribunaux français ont eu à statuer de façon récurrente sur des demandes en nullité de mariage introduites par un mari ou une femme s’offusquant d’avoir été trompé avant la cérémonie quant au sexe véritable de son époux. Le prétexte juridique de l’« erreur dans la personne » reposait en fait sur des lectures divergentes du sexe du conjoint incriminé, en raison de caractéristiques organiques présentées comme trop peu probantes pour que soit établie l’altérité sexuelle réclamée par l’institution maritale. Insolites et scabreux, ces procès ont fait grand bruit, bien au-delà des localités qui en ont été le théâtre, tout en suscitant des débats contradictoires, parfois vifs, entre juristes et médecins. Vingt-trois affaires permettent ici d’apprécier l’importance individuelle et collective du mariage au XIXe siècle. À travers l’exercice singulier de la justice auquel elles ont prêté, se fixe à la fin du siècle une conception juridique de l’institution clef de la société qui, en dépassant sa fonction fondamentale de reproduction, la détache du biologisme ambiant. En acceptant qu’une conformation organique atypique ou/et une impuissance et une infécondité ne disqualifient pas de sa qualité d’homme ou de femme et n’insultent pas le mariage au point de l’annuler, les magistrats suggèrent une définition de l’identité de sexe moins normative et moins rigide que celle des médecins.

In fact, courts of that time repeatedly had ...to rule on requests for marriage annulment by husbands and wives complaining of having been deceived concerning the true sex of their spouses. The legal pretext - mistaken identity - was based on divergent interpretations of the sex of the offending spouse because of biological characteristics argued to be insufficiently clear to establish the sexual alterity required by the institution of marriage. The focus of these trials, especially between 1816 and 1884 when divorce was impossible, was therefore to evaluate the degree of irregularity of genital formation, which might or might not call into question the legal sex of the accused spouse and thus the marriage. Unusual and scandalous, these trials caused a great stir well beyond the localities in which they took place, as well as sparking open and sometimes heated debates between jurists and physicians. The judges, discomfited by cases that revolved around suspect genital organs, sometimes decided to appeal to medical expertise and to consider biological factors, even after legislators had expunged this possibility from the Civil Code of 1804. In effect, contrary to older law, the new Code - which at the request of the emperor Napoleon compiled laws pertaining to persons, property and relationships between private persons - abolished impotence as a definitive obstacle to marriage.3 The magistrates thus encountered the growing interest of physicians in individuals whose morphology, physiology and behaviour complicated a clear division between the male and female sexes
