The present article contributes to the debate on the failure or success of European Works Councils (EWCs) as an institution of European industrial relations. To this end it takes stock of EWC ...performance from various points of view. First, a quantitative evaluation of the development of EWCs, based on the ETUI database, is used to show that EWCs have become an essential element of European industrial relations. Second, we show that EWCs are a dynamic, constantly developing institution of employee representation. Their significance is assessed, including by looking at their institution-building capacity on various levels. The article also considers the future of EWCs. In this context the recent recast Directive 2009/38/EC is briefly discussed. Functional developments of EWC practice (signing company-level transnational agreements) are identified as new challenges for the coming years. The article concludes by arguing that the firm position of EWCs in European industrial relations can be viewed as a self-evident success, and has had positive spillover effects resulting in provisions on employee representation in other EU instruments.

À cette fin, il fait le point sur les performances des CEE selon différents points de vue. Tout d’abord une évaluation quantitative de l’évolution des CEE, fondée sur la base de données de l’ETUI, est utilisée pour montrer que les CEE sont devenus un élément essentiel des relations industrielles européennes. Ensuite, nous montrons que les CEE sont une institution dynamique de représentation des travailleurs, en constante évolution. L’évaluation de leur importance inclut l’examen de leur capacité de construction institutionnelle à différents niveaux. L’article examine également l’avenir des CEE. Dans ce contexte, il analyse brièvement la récente refonte de la directive 2009/38/CE. Les développements fonctionnels des pratiques des CEE (la signature d’accords transnationaux au niveau d’une entreprise) sont identifiés comme de nouveaux défis pour les années à venir. L’article conclut en affirmant que la position solide des CEE dans les relations industrielles européennes peut être considérée comme une preuve évidente de succès dont les retombées positives se sont traduites par l’insertion de dispositions sur la représentation des travailleurs dans d’autres instruments de l’UE.
Dieser Beitrag befasst sich mit der Frage, ob der Europäische Betriebsrat (EBR) als Institution der europäischen Arbeitsbeziehungen erfolgreich oder gescheitert ist. Um dies zu ermitteln, wird eine Bilanz der Leistung der EBR unter verschiedenen Gesichtspunkten gezogen. Zunächst wird auf der Grundlage der Datenbank des Europäischen Gewerkschaftsinstituts die quantitative Entwicklung der Europäischen Betriebsräte bewertet und gezeigt, dass diese zu einem wichtigen Element der europäischen Arbeitsbeziehungen geworden sind. Anschließend zeigen wir, dass der Europäische Betriebsrat eine dynamische, sich ständig weiterentwickelnde Institution der Arbeitnehmervertretung darstellt. Wir bewerten die Bedeutung der Betriebsräte und befassen uns dabei auch mit ihrer Kapazität zur Institutionenbildung auf verschiedenen Ebenen. Im Hinblick auf die Zukunft der EBR wird kurz auf die überarbeitete Richtlinie 2009/38/EG eingegangen. Die Weiterentwicklung bestimmter Funktionen von EBR, wie die Unterzeichnung von transnationalen Vereinbarungen auf Unternehmensebene, wird als Herausforderung für die Zukunft gesehen. Abschließend wird darauf hingewiesen, dass der feste Platz der EBR in den europäischen Arbeitsbeziehungen für ihren Erfolg spricht und sie sich auch dadurch positiv ausgewirkt haben, als sie dazu beigetragen haben, dass auch in anderen EU-Instrumenten Vorschriften über die Arbeitnehmervertretung aufgenommen wurden.

Overdue by nine years, contested by employers and awaited by trade unions, a review of the European works council Directive 94/45/EC finally became reality in 2009. This article presents ...background information about the positions of the European social partners and other institutional EU actors in order to understand the outcome of the events of 2008–09. Focus is directed towards providing a general overview of the new elements in the recast directive on European works councils (EWCs). Keeping the different views on EWCs of the social partners in perspective, the article argues that the recast directive, despite its shortcomings, represents progress rather than superficial cosmetic surgery.
This paper aims at discussing some facets of the emerging European level of collective negotiations. The paper argues that in general the acquis communautaire and other international acts can already ...accommodate this new category of agreements. At the same time it finds out that lack of a specific legal framework may have negative implications for the binding force of the agreements in question and for their enforcement. The existence of those agreements beyond or parallel to law causes hence confusion in regard to roles that the social partners at the national and the European level should play. Thus, in order to put some structure into the debate, it is argued that a differentiation between, on the one hand, national collective bargaining and transnational collective agreements or negotiations, and, on the other hand, consultation and negotiation powers should be applied. Consequently, the author provides an answer to the title question by stating that even though the growing engagement of European Works Councils into transnational collective negotiations represents a functional development of their practice, it is an example of transgressing their information and consultation competences. Dieser Artikel setzt sich mit verschiedenen Facetten der entstehenden europäischen Ebene von Kollektivverhandlungen auseinander. Es wird argumentiert, dass der acquis communautaire im Allgemeinen dieser neuen Kategorie von Vereinbarungen bereits Rechnung trägt. Gleichzeitig wird festgestellt, dass der Mangel an einem spezifischen rechtlichen Rahmen negative Auswirkungen auf die Bindungskraft dieser Vereinbarungen und auf ihre rechtliche Durchsetzung haben kann. Die Existenz der Vereinbarungen in einer rechtlichen Grauzone bzw. parallel zum Rechtsrahmen sorgt für Verwirrung in Bezug auf die Rollen der sozialen Partner, sowohl auf der nationalen als auch auf der europäischen Ebene. Um die Debatte besser zu strukturieren, wird deshalb argumentiert, dass zwischen nationalen Tarifverhandlungen und grenzüberschreitenden Kollektivvereinbarungen bzw. -verhandlungen auf der einen Seite und zwischen Anhörungsrechten und Verhandlungskompetenzen auf der anderen Seite unterschieden werden sollte. Der Autor stellt abschließend fest, dass, obwohl die Einbeziehung der Europäischen Betriebsräte in grenzüberschreitende kollektive Verhandlungen eine funktionelle Weiterentwicklung ihrer Arbeitsweise darstellt, dies gleichzeitig ein Beispiel für die Überschreitung ihrer Informations- und Anhörungskompetenzen darstellt.
