Syphilis is a disease preventable through sexual protection barriers, and curable with a simple treatment. Despite this, between 2010 and 2019, its incidence almost tripled in Argentina, reaching ...56.1/100 000. The most affected are young people (15-24 years old), with a higher percentage of women, especially among pregnant women, in whom it increased from 2.3% to 5.8%, with a peak of 7.7% between 15 and 24 years old. Cases of secondary or tertiary syphilis, detected by control tests, are on the rise. The increase in syphilis is linked to HIV. For this reason, rapid detection tests must be carried out jointly at the first level of care, which facilitates access to the diagnosis and treatment of positive cases, with the corresponding guidance and control. Treatment with penicillin, for which no resistance has been found, is the key component of control. Doxycillin is also used (not in pregnant women), or ceftriaxone. The resistance of Treponema pallidum to azithromycin is increasing, so its use should be avoided. In 2022, 696 cases of congenital syphilis were reported. The national rate is 1.3 per 1000 live births. The majority of reported cases come from the public sector. Maternal syphilis is, in low-income areas, the most common cause of stillbirths. Strict application of existing regulations, strengthening the primary care system, and prevention during pregnancy can contribute to controlling and eliminating the syphilis problem in Argentina.
Based on the analysis of various approaches, the conditions of effectiveness of the mechanism of goal-setting norms of administrative law are outlined: concepts and varieties, and the author's point ...of view is expressed on some fundamental aspects of the problem.
It is noted that the conditions for the effectiveness of the goal-setting mechanism of administrative law norms in comparison with the effectiveness of the legal regulation mechanism, the effectiveness of administrative law norms or their implementation have their own specifics, but in general, the same theoretical models are the basis of their delineation. As the author notes, the conditions for the effectiveness of the goal-setting mechanism of administrative law are circumstances and/or features of reality of a general and special nature that ensure the effectiveness of the goalsetting process of administrative law. Secondly, it is advisable to divide the specified conditions into general and special ones.
Among the general conditions for the effectiveness of the mechanism of goal-setting norms of administrative law, in particular, the following are outlined: compliance of the specified mechanism with general laws and principles of self-organization of society and other systemic phenomena; correlation of the goal-setting mechanism of administrative law norms with the needs of social development; compliance of the goal-setting mechanism with the specific historical conditions of the functioning of administrative law; compliance of the goal-setting mechanism with the real needs and interests of those subjects, the relations between which are regulated by the norms of administrative law, etc.
Among the special factors of effectiveness of the mechanism of goal-setting of norms of administrative law, the following can be mentioned: the objective determination of the activity of the law-making subject during the determination of the goal and the assignment of norms of administrative law or their groups; features of administrative lawmaking as a result of the creative process; the level of legal awareness of subjects of relevant administrative legal relations; conformity of the goal-setting mechanism of administrative law norms to the theoretical and practical results of scientific research (social, precise, natural, technical, etc.), the objects of which are simultaneously objects of administrative legal relations, etc.
На підставі аналізу різноманітних підходів окреслено умови ефективності механізму цілепокладання норм адміністративного права: поняття та різновиди, а також висловлено авторську точку зору з ...деяких принципових аспектів порушеної проблематики. Зауважено, що умови ефективності механізму цілепокладання норм адміністративного права у порівнянні із ефективністю механізму правового регулювання, ефективністю норм адміністративного права або їх реалізації мають свою специфіку, але загалом в основі їх окреслення лежать ті самі теоретичні моделі. Як зауважує авторка, умови ефективності механізму цілепокладання норм адміністративного права - це обставини та/або особливості реальної дійсності загального та спеціального характеру, що забезпечують результативність процесу цілепокладання норм адміністративного права. По-друге, вказані умови доцільно поділяти на загальні та спеціальні. Серед загальних умов ефективності механізму цілепокладання норм адміністративного права, зокрема, окреслено: відповідність зазначеного механізму загальним закономірностям та принципам самоорганізації суспільства та інших системних явищ; кореляція механізму цілепокладання норм адміністративного права з потребами суспільного розвитку; відповідність механізму цілепокладання конкретно-історичним умовам функціонування адміністративного права; відповідність механізму цілепокладання реальним потребам та інтересам тих суб'єктів, відносини між якими регулюються нормами адміністративного права тощо. Серед спеціальних факторів ефективності механізму цілепокладання норм адміністративного права можна названо такі: предметна визначеність діяльності правотворчого суб'єкту під час визначення мети та призначення норми адміністративного права чи їх груп; особливості адміністративної правотворчості як результату творчого процесу; рівень правосвідомості суб'єктів відповідних адміністративних правовідносин; відповідність механізму цілепокладання норм адміністративного права теоретичним та практичним результатам наукових досліджень (суспільних, точних, природничих, технічних тощо), об'єкти яких є одночасно й об'єктами адміністративних правовідносин тощо.
It is noted that in the search for answers to questions about the peculiarities of the norms of administrative law, as an object of goal setting, the issue of their structure is one of the key. That ...is why this question has always been in the field of view of both domestic and foreign researchers. In this regard, the determination of the theoretical and legal foundations of the definition of the structure of the administrative-legal norm is considered relevant, which, in turn, will make it possible to determine the specifics of the formation of the goals of the norms of administrative law. This indicated and determined the formulation of the goal of the study - based on the analysis of various approaches, to determine the theoretical and legal foundations of the formation of the structure of the administrative-legal norm, as well as to express the author’s point of view on some fundamental aspects of the raised issues.
Supporting the traditional approach to the solution of the indicated scientific task, at the same time, the author clarifies that the category «structure of the legal norm» was introduced precisely to describe the relationships and interaction between the elements of the norm, and the latter should be considered, so to speak, projectively from the indicated block of questions. In other words, if we proceed from the generally accepted thesis that the rule of law is a system, then its structure (as a subject of research) should first of all be studied and analyzed through the prism of the set of essential connections of its elements.
It is noted that there are strong connections between the elements of the norm of administrative law, which are manifested in the fact that all of them in their unity reflect the public-legal nature of the norm, ensure the effect and corresponding effectiveness of a specific administrative-legal norm. Those elements that do not possess the mentioned properties, accordingly, are not included in the system of the relevant rule of law, forming, as a result, a legal prescription in which another rule of law is embodied, or even forming any other social, but not legal rule. It is proved that the structure of the administrative-legal norm is internal and external connections of the vertical and horizontal level, which ensure the unity of the elements of the norm and integral properties, selected on the basis of the principles of preservation and invariance, which reflects the public-legal nature of the norm and ensures its legal effect and performance.
Зазначено, що у пошуку відповідей на питання про особливості норм адміністративного права, як об’єкту цілепокладання, проблематика їх структури є одним із ключових. Саме тому вказане питання завжди ...було у полі зору як вітчизняних, так і зарубіжних дослідників. У зв’язку з цим актуальним бачиться визначення теоретико-правових засад визначення структури адміністративно-правової норми, що у свою чергу, дозволить визначитись із особливостями формування цілей норм адміністративного права. Вказане й обумовило формулювання мети дослідження – на підставі аналізу різноманітних підходів визначити теоретико-правові засади формування структури адміністративно-правової норми, а також висловити авторську точку зору з деяких принципових аспектів порушеної проблематики. Підтримуючи, традиційний підхід до вирішення вказаного наукового завдання, разом із тим автор уточнює, що категорія «структура норми права» введена саме для опису взаємозв’язків та взаємодії між елементами норми, а останні слід розглядати так би мовити проекційно від вказаного блоку питань. Іншими словами, якщо виходити із загальновизнаної тези про те, що норма права є системою, то її структура (як предмет дослідження) у першу чергу має вивчатися та аналізуватися крізь призму сукупності істотних зв’язків її елементів. Зазначено, що між елементами норми адміністративного права існують міцні зв’язки, які проявляються у тому, що усі вони у своїй єдності відображають публічно-правову природу норми, забезпечують ефект та відповідну результативність конкретної адміністративно-правової норми. Ті елементи, які не володіють названими властивостями, відповідно, не входять до системи відповідної норми права, утворюючи, як наслідок, правовий припис у якому уособлюється інша норма права, або навіть утворюючи будь-яку іншу соціальну, але не правову норму. Доведено, що структура адміністративно-правової норми – це внутрішні та зовнішні зв’язки вертикального та горизонтального рівня, що забезпечують єдність елементів норми та цілісних властивостей, виділених на основі принципів збереження та інваріантності, яка відображає публічно-правову природу норми та забезпечує її правовий ефект та результативність.
Human tuberculosis (TB) caused by Mycobacterium bovis appears to be rare in most of the region of the Americas, although some localities have reported an unusually high prevalence of M. bovis among ...human TB cases (e.g., San Diego, CA, USA; parts of Mexico). As surveillance
data are lacking in many countries, there is substantial uncertainty regarding actual incidence. M. bovis is most often not identified, as the diagnosis of TB is made by smear microscopy alone or using egg-containing culture media lacking pyruvate. Where human M. bovis cases
have been studied in the region, they appear to be associated with ingestion of unpasteurized dairy products, or with airborne acquired infection in animal keepers and meat industry workers from countries where bovine TB remains a problem. Human-to-human transmission of M. bovis does
occur, but appears to account for a very small proportion of cases. Efforts to eradicate M. bovis in humans in the Americas should therefore be directed at eradicating the disease in cattle, increasing pasteurization of dairy products and providing education about the dangers of consuming
unpasteurized dairy products.
Dengue (DENV), zika (ZIKV) and chikungunya (CHIKV), three arbovirosis transmitted by Aedes mosquitoes, have spread in recent decades in humid tropical and subtropical zones. Dengue is epidemic in ...subtropical areas of Argentina. DENV infection confers lasting immunity against the infecting serotype but increases the risk of serious disease upon reinfection by any of the other three. The recombinant tetravalent vaccine Dengvaxia® prevents severe dengue and hospitalization in seropositive subjects. In 2017, Dengvaxia was approved in Argentina, for ages 9 to 45, but is not included in the national vaccination calendar. Two other vaccines are in Phase III evaluation: one developed by NIAID / Instituto Butantan and the other by Takeda. ZIKV, a virus associated with microcephaly in newborns in Brazil, circulates since 2016 in Argentina. There is still not effective treatment nor vaccine with proven activity against ZIKV. There has been no active circulation of CHIKV in Argentina in 2017. Outbreaks of CHIKV fever have a complication: the development of chronic post-disease rheumatism. There are not approved vaccines for humans nor effective antiviral therapies. The seriousness of these virosis has contributed to a rapid progress in the knowledge of the infection processes and the immune response. For now, Aedes aegypti and A. albopictus vectors continue to expand, suggesting that the vaccine will be the most effective means of controlling these viruses. Here we summarize information about these arbovirosis in Argentina and Brazil and describe advances in the development and evaluation of vaccines.
