Zbog sve intenzivnijeg korištenja digitalnih alata u radu radnik često biva stalno dostupan poslodavcu, što može rezultirati kršenjem odredbi o ograničenom radnom vremenu i obveznom razdoblju odmora, ...narušiti ravnotežu privatnog i poslovnog života i ugroziti zdravlje radnika. Uvođenjem prava na isključivanje radnika nastoji se spriječiti, ublažiti ili otkloniti takve negativne posljedice. U radu se analizira uređenje prava na isključivanje u pravu EU-a, nacionalnim zakonodavstvima nekoliko država članica EU-a te hrvatskom zakonodavstvu, praksa Suda EU-a u vezi s primjenom Direktive o radnom vremenu te uloga socijalnih partnera u uređivanju i ostvarivanju ovog prava.
Croatia’s Recovery and Resilience Plan (RRP), adopted by the Council on 20 July 2021, encompasses reforms in three main areas: green transition, digital transition, and economic and social ...resilience. The Plan in general is expected to foster economic growth and create jobs. The article analyses the social and labour dimension of the RRP, also in light of implementation of the European Pillar of Social Rights and the country-specific recommendations issued by the European Commission.
Industrija videoigara jedna je od najbrže rastućih industrija s velikim ekonomskim potencijalom koja zapošljava sve veći broj radnika diljem svijeta. No, njezina „tamna strana“, na koju upozoravaju ...različita istraživanja, su nepovoljni uvjeti rada osoba zaposlenih u ovom području: predugo radno vrijeme, niske plaće, diskriminacija i uznemiravanje radnika, neadekvatna zaštita na radu, neravnoteža posla i obiteljskog života i drugo. Sindikalno organiziranje, kolektivno pregovaranje te različite formalne i neformalne kolektivne akcije i predstavništva radnika predstavljaju instrumente kojima se uvjeti rada mogu poboljšati, ali se još uvijek nedovoljno koriste. Riječ je o temi koja zaslužuje pozornost, a u Hrvatskoj još nije dovoljno istražena. U radu se najprije analiziraju uvjeti rada zaposlenih u industriji videoigara, posebno kroz prikaz rezultata različitih istraživanja provedenih među radnicima. Zatim se daje prikaz individualnih akcija te neformalnih i formalnih kolektivnih akcija koje poduzimaju radnici zaposleni u industriji videoigara u različitim dijelovima svijeta. Analizirane su odredbe Kolektivnog ugovora za radnike Gamechuck d.o.o. iz Zagreba. Na temelju dobivenih spoznaja izveden je zaključak o važnosti koju sindikalno organiziranje ove skupine radnika te kolektivno pregovaranje, ali i različite neformalne akcije imaju za poboljšanje njihova položaja i uvjeta rada. Kada je riječ o analiziranom Kolektivnom ugovoru, može se zaključiti da se njime jamči zavidna razina prava radnika, a dodatnu pozornost trebalo bi posvetiti jasnijem uređenju radnog vremena.
The video game industry is one of the fastest growing industries with a huge potential to employ more and more people all over the world. However, there is a dark side that different studies call attention to, all related to the poor working conditions: too long hours, low pay, discrimination and mobbing, inadequate occupational safety, imbalance between work and family life, etc. Organizing in unions, collective negotiations, various formal and informal collective actions and representations are instruments that may bring about better working conditions, but they are not sufficiently practiced. This is an issue that requires more attention in Croatia.
The paper initially analyzes the working conditions of individuals employed in the video game industry, particularly focusing on the results of different studies carried out among the workers. Next, the paper presents individual actions, as well as informal and formal collective actions undertaken by the workers in this industry in different parts of the world. Provisions in the Collective Agreement of the Gamechuck d.o.o. based in Zagreb are analyzed. Findings indicate the importance of organizing in unions and collective negotiations, but also a variety of informal actions for the improvement of the workers’ position and working conditions. The analyzed Collective Agreement shows that a high level of workers’ rights is guaranteed, with more attention needed to arrive at a clearer definition of the working hours.

This paper analyses the strategic and legislative framework of innovation and growth of skills in Croatia. Emphasis is placed on the life-long learning system, especially the legal duty of the ...employer to education and training of his or her employees. The paper will present the results of the research carried out in the scope of the scientific research project Flexicurity and New Forms of Employment about the issues of flexicurity, atypical and new forms of employment, as well as the respective opinions of the employers operating in several branches and trade-unions. Finally, the author analyses different active labour market policy measures directed to the growth of skills and innovations.
U radu se analizira strateški i zakonski okvir za inovacije i unaprjeđenje vještina radnika u Republici Hrvatskoj. Rad se bavi pitanjem cjeloživotnog obrazovanja te posebice obvezom poslodavca da radniku omogući obrazovanje i osposobljavanje. U radu se iznose rezultati izvornog istraživanja autora o konceptu fleksigurnosti, atipičnih i novih oblika rada, provedenog u okviru projekta Fleksigurnost i novi oblici rada. Analiziraju se prikupljena stajališta poslodavaca koji djeluju u okviru nekoliko gospodarskih sektora, kao i stajališta sindikata o ovim institutima. Zaključno, analiziraju se i mjere aktivne politike tržišta rada usmjerene unaprjeđenju vještina i inovacija.
Analysed in the paper are the atypical forms of employment and work organisation, with special accent on the work conditions and the protection of workers from psycho-social risks and work related ...stress, all in the light of the obligations of the EU member states and European social partners in this field of safety and health at work. The authors provide a comparative legal analysis and submit propositions de lege ferenda.

Obavljanje nekog rada za drugoga može se
zasnivati na različitim pravnim temeljima pa se i pravni položaj osoba koje
obavljaju rad razlikuje ovisno o tome rade li na temelju nekog ugovora
građanskog ...prava (primjerice, ugovora o djelu) ili ugovora o radu (kada je
osoba u radnome odnosu). Radno pravo jamči zaštitu radnicima koji su zbog
podređenosti i ekonomske ovisnosti o poslodavcu slabija strana u radnome
odnosu. Zato je važno odrediti pojam radnika i radnog odnosa. U radu se
analiziraju rješenja Preporuke MOR-a br. 198, zakonsko uređenje radnog odnosa u
Sloveniji i Hrvatskoj, pokazatelji radnoga odnosa, utvrđivanje radnoga odnosa u
praksi inspekcije rada i sudskoj praksi, kao i položaj ekonomski ovisnih osoba.
There are different legal grounds on which the work for another person
can be performed, whereas the legal status of persons performing work depends
on the type of contract involved, namely civil law contract (e.g. contract of
service) or contract of employment (when persons are in employment
relationships). Labour law guarantees the protection of workers who are, due to
their subordination to and economic dependence on the employer, the weaker
contracting party in employment relationships. Because of this, identifying the
notions of worker and employment relationship is particularly important. The
authors analyse the provisions of the ILO Recommendation No. 198; the statutory
regulation of the employment relationship in Slovenia and Croatia; indicators
of the existence of employment relationship,
determination of the existence of an employment relationship in practice by the
labour inspection as well as in case-law, and the legal status of economically
dependent persons.

Rad se bavi pitanjem cjeloživotnog obrazovanja te posebice obvezom poslodavca da ...radniku omogući obrazovanje i osposobljavanje. U radu se iznose rezultati izvornog istraživanja autora o konceptu fleksigurnosti, atipičnih i novih oblika rada, provedenog u okviru projekta Fleksigurnost i novi oblici rada. Analiziraju se prikupljena stajališta poslodavaca koji djeluju u okviru nekoliko gospodarskih sektora, kao i stajališta sindikata o ovim institutima. Zaključno, analiziraju se i mjere aktivne politike tržišta rada usmjerene unaprjeđenju vještina i inovacija.
Employers are increasingly resorting to the. contractual delegation of certain activities to outside contractors. Legal status of employees who previously performed this work with the employer ...depends mainly on whether there has been the transfer of the undertaking within the meaning of Directive 2001/23/EC. According to case law of the Court of Justice of the EU, in addition to the performance of the same activities, a condition is also the transfer of essential means of work or transition of employees. Since the transition of employees in this case depends on the agreement between the contracting authority and the provider of services, terms of public procurement are very important in this regard. The article addresses the question of the application or non-application of the institution of the transfer of the undertaking in cases of outsourcing in public sector while paying attention to Slovenian and Croatian legislation and to the Directive.
Seasonal workers are increasingly important in some Member States as a means to fill the labour market needs. Preferred due to their lower salaries, greater docility and the evasion of administrative ...and social security obligations, migrant workers are often treated less favourably than domestic workers in terms of employment rights, benefits and access to adequate housing. The agricultural sector of employment is particularly at risk of labour exploitation during harvest seasons and thus associated with atypical or informal forms of employment and precarious working conditions. The COVID-19 pandemic gave visibility to the new risks the seasonal workers are exposed to. In addition, it showed that in some cases such problems can lead to the further spreading of infectious diseases and increase the risk of COVID-19 clusters. The consequences of of the pandemic can be observed in Croatia too. This paper primarily covers the position of third-country nationals who enter and reside in Croatia for the purpose of agricultural seasonal work within the framework of the Seasonal Workers Directive (Directive 2014/36/EU). Significant challenges facing the Croatian labour market have been addressed by means of a comparative approach in order to present the current situation on the EU labour market and suggest potential legal solutions applicable in regard to the national circumstances.
Creation of more and better jobs is a central issue of the ILO's Decent Work Agenda, OECD's jobs strategy and the European Unions quality of work policies. While recent reports show an increase of ...new jobs in the European Union, the number of quality jobs is diminishing. On the other hand, there is a problematic mismatch between the education system and labour market needs. According to statistical data, Croatia is among the EU Member States with the highest rate of precarious work and the highest share of fixed-term employment in total employment. Almost a quarter of the Croatian population is at risk of poverty or social exclusion. Precarious work is closely related to non-standard or atypical forms of employment (e.g. part-time work, fixed-term employment, temporary agency work and (bogus or dependent) self-employment). These forms of employment have negative consequences for the functioning of the labour market, individual workers and the society as a whole. The authors underline shortcomings of the Croatian legislation regarding atypical forms of employment and give possible solutions that could improve the employment status and social security entitlements of those categories of workers.
