This paper comments on Francesco Boldizzoni’s The Poverty of Clio in the context of the recent French-speaking literature in economic history and economic sociology. Boldizzoni’s argument about the ...concept of « culture », understood as a seemingly ultimate cause of economic phenomena, is discussed. Past rationalities, according to the literature, are difficult to analyse : the author insists on the permanent tension between different versions of economic rationality at each time period, as opposed to the conception of an evolution from the culturally embedded to the homo economicus. The author finally focuses on recent scholarship on the social construction of markets as one of the most promising bridges between economic history and economic sociology. For contemporary markets, the author argues, studies have substantially revised the idea that contemporary markets are impersonal and their equilibrium price-based.
Abstract
In the past thirty years, historians have deeply renewed our understanding of the state in the early republic period of the United States as much more powerful, deep reaching, and proactive ...than the traditional image represented. In France, too, new work has revised our vision of the state in the early nineteenth century, which looked different from the triumphant, Napoleonic leviathan that often appears in discourse. Yet both historiographies, having evolved separately, still base their conclusion on implicit comparisons, with an imagined “European” state or with a later “modern” state. This article uses the new historiographies on both countries to go beyond those unstated exceptionalisms to propose a reconstruction of the state in that period. Pulling those studies together, and mobilizing insights from one to shed light on the other, it recovers a common repertoire of statecraft that emerged in the revolutionary era. It hinged on fostering consent of key segments of the population and therefore organized the work of the state in mostly nonbureaucratic forms. States in that period reflected a particular enmeshing of public and private forms that needs to be analyzed for itself, especially if we want to understand the specificity of today’s practices.

En plus d’une étude sous tous les angles et à toutes les échelles de la pratique de la convention collective de 1890 à 1914, en France et en Allemagne, le livre offre des synthèses du plus récent ...état de la recherche sur l’organisation du travail dispersé dans les fabriques collectives urbaines (aussi appelées aujourd’hui « districts industriels »), dans le bâtiment, dans ce qui reste de la proto-industrie rurale ; sur ce que fait le développement des syndicats ouvriers et patronaux à des pratiques de négociation collective qui leur préexistaient ; sur l’élaboration des statistiques des grèves ; sur le fonctionnement concret des tribunaux chargés du travail ; sur les débats juridiques, économiques et sociaux dans les universités et les ministères – liste non exhaustive.
L’objectif de cet article est d’utiliser le cas du textile pour discuter de l’image sociale des métiers dans la seconde moitié du XIX e siècle, à partir d’un corpus de guides pour le « choix d’un ...état », un nouveau genre éditorial né au milieu du siècle. Le texte en analyse les principales publications jusque dans les années 1890, y explore les interactions entre genre et hiérarchisation sociale et discute plus généralement la notion de « métier », à la fois structurante et fuyante.
Des années 1850 aux années 1870 a lieu en Angleterre une campagne pour la création de tribunaux de commerce, sur le modèle de l’Europe continentale. Cette création n’a pourtant pas lieu. L’article ...explore les raisons de cette campagne et de ce résultat. Il montre que la non-création tient à une culture juidique qui ne correspond pas aux définitions habituelles de la common law et qui, notamment, ne s’étend pas aux États-Unis. Il est pourtant utile de parler de culture juridique pour désigner les interactions entre quatre éléments qui peuvent expliquer ce non-transfert : ce qui importe aux juristes en termes de procédures ; l’attitude de respect distant des commerçants envers le droit ; leur accès limité aux tribunaux ; enfin, les formes de leur autocatégorisation (les différences entre commerçants l’emportant sur les ressemblances).

En conflit sur l’exécution d’un contrat, deux grandes entreprises prennent souvent la voie de l’arbitrage commercial international, plutôt que celle d’un tribunal officiel. Cette justice privée, ...volontaire et confidentielle, a été développée à partir de 1923 à la Chambre de commerce internationale, à Paris, en suivant deux directions : l’accumulation interne d’un savoir-faire pratique, issu de la résolution des litiges ; puis une série de négociations avec les États, notamment à la SDN et à l’ONU. Cette juridiction privée bénéficie aussi du soutien direct des États : depuis 1958, les actifs d’une entreprise qui perd un arbitrage peuvent très vite être saisis par la force publique. Ce régime d’arbitrage a évolué vers une forme d’extra-territorialité juridique. Néanmoins les seuls intérêts privés n’ont pas suffi à le faire naître. En effet, les acteurs centraux de son institutionnalisation ne sont pas de grandes entreprises, et celle-ci n’a eu lieu qu’avec l’assentiment, et même le soutien, des autorités publiques.
