Au Nouveau-Brunswick, la langue de la législation a été l’anglais jusqu’en 1969. La politique du gouvernement à cet égard a été changée par l’adoption de la Loi sur les langues officielles du ...Nouveau-Brunswick. En cinq ans à peine, les lois publiques ont été traduites et publiées en format bilingue dans le recueil des lois révisées de 1973. Une transition relativement harmonieuse s’est ainsi effectuée à partir d’un régime unilingue vers le bilinguisme officiel. La législation déléguée a emboîté le pas à partir de 1977. La production en format bilingue des lois du Nouveau-Brunswick a aussi entraîné des conséquences relativement à leur application par les tribunaux, l’égale autorité des versions exigeant l’étude des textes français et anglais pour leur interprétation.
Au Nouveau-Brunswick, la langue de la justice a été l’anglais jusqu’en 1967. Une modification à la Loi sur la preuve permettait alors l’usage d’autres langues dans des circonstances très limitées. ...Tout en reconnaissant le statut officiel du français devant les tribunaux et en élargissant quelque peu les droits accordés en 1967, la Loi sur les langues officielles du Nouveau-Brunswick de 1969 maintenait la discrétion des juges d’imposer une langue de procédure selon les situations. C’est avec l’avènement de la Charte canadienne des droits et libertés en 1982 et la modification correspondante à la loi qu’une pleine liberté de choix a été établie. Depuis lors, les seules restrictions possibles s’appliquent aux autorités publiques devant procéder dans la langue des accusés ou des parties civiles et aux assureurs agissant en vertu de leur droit de subrogation ou de leur obligation de défense. La langue de la justice s’est aussi francisée par la traduction des jugements à partir des années 80 malgré l’absence de dispositions législatives spécifiques. C’est seulement en 2002, avec la révision de la Loi sur les langues officielles, qu’une obligation dans ce sens a été adoptée. Depuis, les citoyens sont ainsi en mesure de prendre connaissance des jugements qui présentent une valeur jurisprudentielle dans la langue officielle de leur choix.
The 2017 AARP LTSS Scorecard reported that Connecticut ranked 51st nationally in the percent of home health patients that have a hospital admission and falls behind other states in utilization of ...palliative care. Home health providers suggest underutilization of hospice as a primary driver of high hospital admission rates. The study, funded by the Connecticut Department of Social Services, aimed to improve understanding of hospice utilization among Medicare/Medicaid dually eligible and Medicaid-only populations. Results of analysis of Medicaid-only (n=2,979) and Medicare/Medicaid dually eligible (n=12,090) decedents’ Medicare and Medicaid claims data from 2014 through 2016 showed that dually eligible decedents had a significantly higher rate of hospice use compared to Medicaid-only decedents (44% vs. 18%) and a significantly longer average length of stay in hospice (49.65 vs. 26.58 days). Dually eligible hospice users are more likely to have a diagnosis of Alzheimer’s disease and related disorders (47%) compared to Medicaid-only hospice users (19%). Other diagnoses show similar patterns. Geographic variation across regions was not substantial, indicating that the observation of low hospice use is a state-wide issue. Approximately 50% of hospice use was potentially concerning, including hospice dis-enrollment and very short/long hospice enrollment. Additionally, the analysis examined utilization within the two groups of decedents. Findings suggest where there are divergences in hospice utilization within Dual and Medicaid only populations. Recommendations include encouraging physician use of hospice/palliative screening tools and developing education interventions with physicians and patients to increase the understanding of the benefits of hospice and palliative care.
Sociologists attribute the Acadian collective awakening to the period 1860-1880. Yet, despite the marginalization of Acadians and their lack of organization, the law appears to have recognized them ...as a community many years before the 1860s. In particular, provincial legislation allowed their exclusion from a uniform u poor rate "regime to let them care for their poor, a publicly financed lazaretto was dedicated to their medical treatment, and the legislature provided to some Acadians in southeastern New Brunswick their own fiscal regime to assist the poor. This article explores the recognition of Acadians' communal aspirations by the law. Les sociologues attribuent la « prise de conscience collective acadienne » à la période 1860-1880. Malgré la marginalité et le peu d'organisation des Acadiens, le droit semble pourtant les avoir reconnus comme société plusieurs années auparavant : notamment par la loi permettant leur exclusion du régime uniforme de soutient aux personnes démunies, par la création d'un lazaret financé par les fonds publics, et par la législation qui accordait aux Acadiens du sud-est leur propre régime fiscal pour subvenir aux besoins des moins bien nantis. C'est la reconnaissance d'une conscience collective par le droit que nous allons explorer dans cet article.
La majeure partie de la carrière de Me Michel Bastarache, avant son accession à la magistrature en 1995, a été consacrée à la défense des droits des minorités linguistiques. Il fut aussi un acteur ...principal pour l’intégration de la langue française à la pratique du droit dans les provinces de common law, dont le Nouveau-Brunswick. Son implication s’est faite auprès des deux paliers gouvernementaux, des barreaux provinciaux, des établissements d’enseignement et au sein d’organismes des minorités linguistiques. Il a constamment fait la promotion de l’idéologie universelle et égalitaire des protections linguistiques, de leur caractère collectif et d’un rôle judiciaire accru dans leur réalisation. Son intérêt pour les droits linguistiques s’est poursuivi suite à sa nomination à la Cour d’appel du Nouveau-Brunswick (1995) puis à la Cour suprême du Canada (1997). Les positions prises au long de sa carrière colorent les motifs qu’il a produits en matière linguistique. Cependant, son influence dans le domaine demeure tributaire des prononcés rendus par les formations antérieures et, en ce sens, ses motifs ne se démarquent pas substantiellement de ses prédécesseurs. Son talon d’Achille se retrouve dans ses motifs de Charlebois (2005) où, incapable de rallier une majorité de la Cour, il aurait transformé l’interprétation de la Loi sur les langues officielles (du Nouveau-Brunswick).
Vaccine-induced immune thrombotic thrombocytopenia (VITT) is a rare complication after severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) adenoviral vector vaccination. In British Columbia ...(BC), Canada, a provincial clinical care pathway was developed to guide clinicians in evaluating for VITT among patients who present with thrombocytopenia or thrombosis symptoms within 4 to 28 days after adenoviral vector vaccine exposure. All patients had enzyme-linked immunosorbent assay (ELISA) testing for platelet factor 4 (PF4) antibodies, and all cases with positive PF4-ELISA or d-dimer levels ≥2.0 mg/L fibrinogen equivalent units (FEU) had further testing for platelet-activating PF4 antibodies using a modified serotonin release assay (SRA). Between 1 May and 30 June 2021, 37% of 68 patients investigated for VITT had thrombosis, but only 3 had VITT confirmed by PF4-ELISA and SRA. Platelet counts, d-dimer levels, and ELISA optical density values were significantly different between those with and without VITT. Three patients had thrombocytopenia and thrombosis with d-dimer levels >4.0 mg/L FEU but had negative PF4-ELISA and SRA results. Patients with VITT were treated successfully with IV immunoglobulin, nonheparin anticoagulants, and corticosteroids. Our pathway demonstrated that thrombosis is common among patients investigated for VITT and that PF4-ELISA testing is necessary to confirm VITT in those presenting with thrombosis and thrombocytopenia.
•A clinical care pathway using centralized PF4-ELISA testing detected a 37% prevalence of thrombosis among patients investigated for VITT.•VITT should be confirmed by PF4-ELISA as thrombosis with thrombocytopenia can occur without PF4 antibodies after SARS-CoV-2 vaccination.
Although local tissue activation of the endothelin (ET) system contributes to the development of pulmonary hypertension, the impact of isolated chronic plasma hyperendothelinemia on the pulmonary ...circulation is unknown.
Mini-osmotic pumps were implanted in rats to deliver ET-1 during 7 or 28 days. After in vivo hemodynamics, the lungs were isolated to derive pressure-flow relations. Small pulmonary arteries ( approximately 250 microm) were mounted on an isometric myograph to study their reactivity.
Plasma ET-1 approximately doubled (p < 0.05) after 7 and 28 days. Lung tissue ET-1 level increased fourfold after 7 days (p < 0.001) but was no longer significantly elevated after 28 days. Right ventricular systolic pressure was unaffected. The pulmonary pressure-flow relation shifted upward with a steeper slope (p < 0.05) at 7 days, but not after 28 days. Maximum dilatations to both acetylcholine (p < 0.01) and sodium nitroprusside (p < 0.001) were greatly reduced by approximately 50% after 28 days and were normalized by the addition of the nitric oxide synthase inhibitor L-NNA and the antioxidant N-acetyl-L-cysteine, respectively.
Chronic hyperendothelinemia reduces the pulmonary vasodilator reserve in response to nitric oxide. Correction by an antioxidant and L-NNA suggests that this relates to increased production of reactive oxygen species, which may have clinical relevance for conditions associated with chronic increase of ET. Further studies are required to determine if, in the long term, this could contribute to the development of pulmonary hypertension.
