Straipsnyje dviejų paskutinių Lietuvoje patvirtintų nusikaltimų prevencijos programų pavyzdžiu analizuojami nusikaltimų prevencijos pagrindai, kertinės nuostatos, veiksmingumo prielaidos ir ...ideologinis kontekstas. Nusikaltimų prevencijos siekiai ir kuriamos priemonės jiems įgyvendinti priklauso nuo požiūrio į nusikalstamo elgesio esmę, kurį formuoja ir vyraujantis socialinis tikėjimas, ir turimos kriminologinės žinios bei noras ir gebėjimas jomis pasinaudoti. Nusikaltimų prevencijos karžygiai dažniausiai sulaukia visokeriopo palaikymo, nepaisant kylančios ar prognozuojamai kilsiančios grėsmės, su kuria jie pasiryžę kovoti, dydžio bei realumo, taip pat pasirinktų ir siūlomų priemonių (ginklų) veiksmingumo. Todėl viena iš kriminologijos mokslo užduočių yra siūlomus nusikaltimų prevencijos modelius, nuostatas, priemones kritiškai įvertinti per sukauptų žinių ir reflektuotos praktikos prizmę, tai ir mėginama padaryti šiame straipsnyje, skatinant tolesnę mokslinę diskusiją.
Juvenile delinquency is a universal phenomenon inherent in the process of biological and social maturation characterized by high latency. Although juvenile delinquent behaviour, due to its ...spontaneity and recklessness, is easily noticeable and not difficult to investigate, it is often not officially recorded because it is primarily addressed through means of informal social control. Various studies show that children from disadvantaged backgrounds are much more likely to fall into a network of formal social control. Thus, the registered juvenile delinquency not only makes up a very small part of the total juvenile delinquency but its structure and socio-demographic indicators of the accused are also distorted by the selectivity and stigmatization of social control. However, when analysing juvenile delinquency in Lithuania, it is still common to present only the number of registered cases, to analyse them, draw certain conclusions based on them alone, and even develop preventative juvenile delinquency programs. This situation is partly due to the Soviet tradition, which still significantly impacts the general approach to criminal behaviour, in which the latency of criminal behaviour was considered not as a natural and inevitable but a negative and to be destroyed phenomenon. On the other hand, there are few studies of latent juvenile delinquency in Lithuania. They are carried out irregularly according to different methodologies and do not always cover the full complexity of juvenile delinquency. In the article manifestations of latent juvenile delinquency, its’ structure and tendencies in Lithuania are analyzed, Lithuanian indicators are also compared with the indicators of other European countries. Despite some differences in the structure of juvenile delinquency between countries, it can be argued that delinquent behavior is common among juveniles living in all countries, and is usually mild and episodic. According to the analyzed indicators, Lithuania stands out with one essential difference – frequent bullying among secondary school students in all age groups.

The article discusses the dilemma of the concept of criminality and it's different reflections in Western and Soviet ideology. It is noted that the difference in these reflections still affects the ...understanding of the concept in countries with different historical background. Moreover, it heavily affects the understanding of criminality as phenomena as well as ideology of the crime prevention and control. Soviet tradition is characterized by an attempt to define criminality as precise as possible and to outline all its features. Soviet tradition has formed the concept that criminality is objective phenomena that causes a permanent threat to society that is why it shall be permanently “fought”. Western tradition pays much less attention to the definition of the concept, it limits itself by presentation of various theories of criminology as well as description of manifestations of criminal activity. Criminality can be compared to fashion, i.e. the phenomena that has no precise meaning, it comes from nowhere and it disappears into nowhere. However, it exists. Moreover, in a time of different crises it is fashionable to write and speak about the criminality without taking into consideration of concept's ambiguity.
Straipsnyje aptariama nusikalstamumo sampratos dilema ir jos skirtinga refleksija vakarų ir Sovietų ideologijose. Pažymėtina, kad refleksijos skirtumai, iki šiol veikia tai kaip nusikalstamumas yra suprantamas šalyse turinčiose skirtingą istoriją. Be to, tai stipriai veikia nusikalstamumo kaip reiškinio ir kaip prevencijos bei kontrolės priemonių ideologijos supratimą. Sovietinė tradicija pasižymi tuo, kad buvo siekiama nusikalstamumą nusakant kiek įmanoma detaliau visus jo požymius. Šioje tradicijoje nusikalstamumas buvo konstruojamas kaip objektyvus reiškinys, kuris kelia grėsmę visuomenei ir todėl su juo turi būti nuolat „kovojama“. Tuo tarpu, Vakarų tradicija daug mažiau dėmesio skiria nusikalstamumo sąvokos apibrėžimui. Vietoj to yra pateikiamos įvairios kriminologijos teorijos bei nusikalstamos veiklos pasireiškimo aprašymai. Nusikalstamumas gali būti palygintas su mada, t.y. reiškiniu, kuris neturi aiškios prasmės, jis ateina iš niekur ir išnyksta į niekur. Tačiau reikia pažymėti, kad krizių metu apie nusikalstamumą rašoma ir kalbama, kaip apie neprieštaringą reiškinį.
Įkalinimo įstaigos formuoja erdvę, kurioje daugumai jos gyventojų (kaliniams) reikia prisitaikyti prie nustatytos tvarkos ir jai paklusti, o kitiems tai yra darbo vieta – jų užduotis yra palaikyti ...šią tvarką ir atitinkamai reaguoti į jos pažeidimus. Įkalinimo įstaiga yra išskirtinė vieta ir gyvenimui, ir darbui, o tarp šių dviejų skirtingus vaidmenis atliekančių grupių susiklostantys santykiai daro didelę įtaką ne tik įstaigoje vyraujančiai atmosferai, bet ir kalinių integracijos perspektyvoms. Todėl tarptautiniuose kalinimo standartuose ir daugelio Vakarų kultūros šalių kalinimo praktikoje itin pabrėžiama šių santykių svarba – atitinkamas nuostatas ne tik įtvirtinant teisės aktuose, bet ir skiriant tam ypatingą dėmesį personalo mokymuose. Tačiau ir teisės normos, ir atitinkama praktika atsiranda tik tada, kai šių santykių svarba tampa visiškai akivaizdi. Šiame straipsnyje siekiama šį akivaizdumą atskleisti.
Baudžiamasis klimatas Lietuvoje tampa labiau atšiauresnis, tai matyti įvertinus baudžiamųjų įstatymų leidybos ir baudžiamojo persekiojimo rodiklius. Šis procesas kelia daug klausimų ne vien Lietuvos, ...bet ir kitų Europos šalių kriminologams – po 2003 m. Lietuva bent 5 metus pirmavo pagal kalinių skaičiaus mažėjimą Europoje (nors jam net gerokai sumažėjus jis vis tiek dar buvo kelis kartus didesnis už Europos šalių vidurkį), o naujasis Baudžiamasis kodeksas su geriau subalansuota valstybės reakcijos priemonių į nusikalstamą elgesį sistema leido tikėtis ne tik ilgalaikių teigiamų padarinių, bet ir pokyčių baudimo kultūroje. Pastaraisiais metais vis labiau aiškėja, kad ji nepasikeitė. Šiame straipsnyje analizuojami pagrindiniai baudžiamojo represyvumo didėjimą Lietuvoje atspindintys rodikliai, per jų visumą siekiant atskleisti bendras represyvėjančio baudimo tendencijas. Nors straipsnio pavadinimu keliamas klausimas yra daugiau retorinis ir labiau atspindi apmaudžią nuostabą nei į jį turimą atsakymą ar atsakymus, tačiau remiantis autoriaus ir kitų Europos kriminologų atliktais tyrimais bei įžvalgomis daroma pagrindinė išvada, kad baudimo kultūra pirmiausia priklauso nuo socialinio, kultūrinio, politinio ir ekonominio konteksto, turinčio ilgą istorinį šleifą, taip pat nuo ekonominio laikmečio ypatumų. Bandymai spręsti nusikalstamo elgesio problemas didinama baudžiamąja represija liudija tebevyraujančią seną tradiciją. Norint ją keisti, būtina ją parodyti ir suvokti, pamatyti esminius skirtumus nuo kitų Europos Sąjungos šalių ir galimas alternatyvas.
In the article manifestations of registered juvenile delinquency, its‘ structure and tendencies in Lithuania are analyzed, Lithuanian indicators are also compared with the indicators of other ...European countries. The comparative study shows large differences in registered juvenile delinquency, which are primarily determined by different scopes of criminalization of delinquency, different intensity of formal control, as well as different rules for registering juvenile delinquency. The absolute indicators of registered juvenile criminal offences in Lithuania have been decreasing for the past two decades, and the relative indicators of registered juvenile criminal behavior have also been consistently decreasing for the last five years. 2020–2021 the number of administrative offenses committed by minors in Lithuania also decreased, which is primarily associated with restrictions in public life introduced due to the COVID-19 pandemic. Serious violent crimes by minors, characterized by low latency, are often widely described in the media, and constitute a small part of the structure of crimes committed by minors in Lithuania, and the number of murders is consistently decreasing – in 2021 it was the smallest during the entire period of independent Lithuania – only one murder was registered. After completing this study, it can be said that the indicators of registered juvenile delinquency compared to other countries should be seen first of all as an output of the juvenile behavior control mechanisms operating in each country, which tells little about the real extent of juvenile delinquency. The minor juvenile delinquency is more latent and its rates should be first evaluated. Cases of serious delinquency are characterized by a much lower latency, but in this case too, in order to compare registered delinquency, it is necessary to simultaneously assess complex differences in criminal prosecution between countries.
Taking together all the evidence on the aetiology, development and differential processes of delinquent behaviour from childhood to adulthood, we dispose of important new evidence from the ...neurosciences, which, compared to traditional criminological, developmental, psychological and sociological evidence, increases our capacity to explain the age-crime curve. In particular, the right-hand side of the curve, indicating desistance from crime in young adulthood between the ages of 18 and 25, can be based on new insights from neuroscientific research on brain maturation and the development of self-control mechanisms. As a result, new questions about judicial reactions and interventions must be raised. If an individual’s brain is fully matured only in the mid-twenties, general criminal law is possibly inappropriate, and a specific youth or young-adult criminal law reflecting the transitional processes and the diminished culpability of young-adult offenders should rather be applied. In many European jurisdictions, the scope of youth justice has been extended upwards to 18–20 year-old adults, in the Netherlands even up to 22 years of age, a political decision affecting criminality and based on new neuroscientific evidence.

Die ...Schwerpunkte liegen bei den Themen, die für die kriminologische Forschung am relevantesten sind – Korruption, Jugendkriminalität, Kriminalpolitik und Strafvollzug. Litauen ist der einzige Baltische Staat, in dem Bachelor- und Masterstudiengänge in Kriminologie etabliert sind, in dem ein nationaler berufsorientierter Verein der Kriminologen gegründet wurde. Die Entwicklung der letzten Jahrzehnte der Kriminologie in Litauen zeigt eine gute Perspektive für die Zukunft und eröffnet breite Möglichkeiten für die internationale Zusammenarbeit.
