Post-national developments have questioned the dominance of state will and lead to an increasing separation of the institutional locus of legal voluntarism and coercion. However, this article ...discusses "state tradition" as a legal mind-set; as an ingrained approach to law, which may linger in our legal 'Vorverstandnis' long after post-national developments have challenged its seemingly self-evident premises. The article examines the Kelsenian and the Hartian variants of legal positivism as theoretical expressions of this tradition. The article also argues that state tradition has been, and still is, much more powerful in public than private law. Finally, it is suggested that although the state tradition is unable to chart the post-national lawscape, it may still be of use in the construction of an ideal-typical general concept of law which we need when embarking on an examination of a legal world inhabited by instances of not only state law but non-state law as well.

In this era of globalisation, different legal systems and structures no longer operate within their own jurisdictions. The effects of decisions, policies and political developments are having an ...increasingly wide-reaching impact. Nowhere is this more keenly felt than in the sphere of European Union law. This collection of essays contributes to the co-operative search for interpretative and normative grids needed in charting the contemporary legal landscape. Written by leading lawyers and legal philosophers, they examine the effects of law's de-nationalisation by placing European law in the context of transnational law and demonstrate how it forces us to rethink our basic legal concepts and propose an approach to transnational law beyond the dichotomy of national and international law.
The article discusses Lindahl's book as an important contribution to not only the debate on legal globalisation and transnationalisation but also general legal and constitutional theory, where it ...introduces a phenomenological first-person plural perspective. Yet, the article argues that concrete legal orders of first-level socio-legal practices do not add up to form a comprehensive and unitary legal order. The article also questions Lindahl's claim of the primordiality of the concrete legal order in relation to second-level, specialised legal practices and law as an ensemble of abstract norms. In conclusion, an attempt is made to apply Lindahl's conceptual distinction between boundaries, limits and faultlines to the relations between EU and Member State law.
Les difficultés de la théorie du droit à appréhender le droit transnational démontrent à quel point de nombreux concepts, prétendus universels, de notre langage juridique sont intimement liés au ...droit de l’État-nation. Cet article tente à la fois de clarifier les concepts clés de « droit transnational », de « pluralisme juridique » et d’« interlégalité », et d’élaborer un cadre interprétatif et normatif plus étendu. Il s’accorde avec les pluralistes radicaux sur la signification du perspectivisme en droit tout en donnant à ce perspectivisme un éclairage culturel juridique. En fin de compte, cet article démontre que le droit transnational renforce notre sensibilité à la dimension spatiale et temporelle du droit ; aux qualités multifacettes que le courant principal de la théorie du droit du XX e siècle, avec ses prétentions universalistes, avait tendance à ignorer ou à comprendre en termes positivistes étroits. Ce n’est pas seulement l’emplacement du droit qui est en question mais également les conceptions de temps et d’espace, implicites en droit, ainsi que de durées et de rythmes, de frontières et de liaisons transfrontières, typiques du droit à ses différents niveaux et dans ses deux dimensions d’ordre juridique et de pratiques du droit.
The difficulties of legal theory in coming to terms with transnational law demonstrate how intimately linked to nation-state law many of the supposedly universal concepts of our legal language are. ...The paper discusses such key concepts as 'transnational law', 'legal pluralism' and 'interlegality', but tries also to elaborate a more comprehensive interpretative and normative framework. The paper agrees with radical pluralists on the significance of perspectivism in law, but give this perspectivism a legal cultural turn. Finally the paper argues that transnational law enhances our sensitivity to the spatiality and temporality of law; many-faceted qualities which mainstream legal theory of the 20th century, with its universalist pretensions, tended to ignore or understood in narrow positivist terms.
