A partir da década de 90, a introdução de inovações tecnológicas e organizacionais na indústria brasileira se intensificou significativamente. Um dos objetivos deste artigo é analisar os principais ...obstáculos à negociação de cláusulas referentes a essas inovações entre o sindicato dos trabalhadores da indústria de calçados, da indústria siderúrgica e da indústria têxtil e os respectivos empresários. Flexibilização. Legislação trabalhista. During the 90’s, many new technologies and innovations in organizational structure were introduced to the Brazilian industry. One of the purposes of this article is to analyze the main obstacles to the negotiation of new labor laws in relation to theses changes between labor unions (footwear, metal and textile industry workers) and the owners of the factories. The other purpose is to investigate the level of diffusion of the recent flexibilization measures of the labor legislation and the strategy of these unions. Keywords: Productive adjustment. With rapid growth in demand for water, the resource is increasingly being transferred from agriculture to cities and industries. This paper examines trends and expected future changes in sectoral ...water demand, which drive water transfers. It then describes alternative mechanisms for water reallocation, including administrative reallocation, market-based reallocation, collective negotiation, and other means, including combinations of mechanisms, and illegal transfers. Transfer mechanisms and implications for rural livelihoods and the environment are illustrated for case studies in the western United States and Asia. The paper concludes with a series of suggestions for alternative policies and institutions for reallocation that could help reduce adverse consequences for the poor.

In this article, I show some of the results of an anthropological fieldwork thatI carried out in La Matanza, Greater Buenos Aires Area, between April 2002 and March2006. In that frame, I observed the ...everyday activities developed by neighbourhoodgroups linked to unemployed people’s organizations. In that regard, this article aimsat analyzing the everyday practices that are entwined with the collective negotiationof State-run programs. Particularly, this article reconstructs the activities of a groupof people belonging to one of organizations under study, who were in charge of theadministrative tasks required by the normative that framed the State-runemployment programs. The article contends that the complexity of that process oftechnical specialization and knowledge appropriation turns the theoretical frontiersbetween State and social movements extremely blurred.
En este artículo presento resultados de un trabajo de campo antropológicoque desarrollé en el distrito de La Matanza, Gran Buenos Aires, entre abril de 2002 ymarzo de 2006. En ese marco, observé las actividades cotidianas de grupos barrialesvinculados con organizaciones de desocupados. We structurally estimate a perfect information bargaining model of collective negotiations using data on national agreements for Spain. The model is a stochastic model of sequential bargaining in ...which we allow for the possibility of negotiations ending without agreement, a common feature in the data. Delays in equilibrium are the result of uncertainty about the surplus to be divided among the players and not of information asymmetries. The model fits the data well regardless of the limitations imposed by the parametric specification adopted. Our results show that agents are patient and that the advantage from proposing is large. Ce projet de recherche présente une application d’une méthodologie d’analyse que l’étude de la Constitution sur

de la négociation collective établie par la loi législative no 01 de 2005 sur les questions de retraite constitue
une antinomie constitutionnelle qui porte gravement atteinte au mécanisme de concertation par la négociation
collective, que les travailleurs doivent accepter et améliorer les conditions de travail minimales prévues par la
législation.
El proyecto de investigación presenta una aplicación de una metodología analítica que estudia constitucionalmente el tema central, que tiene como objeto el procurar demostrar cómo el referido Acto Legislativo No. 01 del 2005 modificatorio del artículo 48 de la Constitución Política, además de contrariar disposiciones que consagra la misma Carta Política, en materia del derecho de asociación sindical y negociación colectiva por la restricción que se estableció al ejercicio del derecho a la negociación colectiva, artículo 55 de la C.P., derecho este cuyo arraigo en esencia tiene origen en el derecho fundamental de la asociación sindical, consagrado en el artículo 39 de la Constitución Política, desconociendo lo señalado en los Convenios Internacionales del Trabajo, particularmente el Convenio 87 y 98 (OIT), disposiciones calificadas por la doctrina constitucional como parte integral del denominado Bloque de Constitucionalidad, en virtud del inciso 2° del artículo 93 de la Constitución Política, característica reforzada por lo determinado en el inciso 4° del artículo 53 de la Constitución Política. De la misma manera, la enmienda constitucional por la cual se reformó el artículo 48 de la Constitución Política deja ver ostensiblemente cómo se desconoce el derecho a la propiedad privada y a la libertad de empresa al prohibir la negociación colectiva entre particulares, chocando de contera con lo establecido en el artículo 58 de la Constitución Política y lo dispuesto en el artículo 333 constitucional, que garantiza el derecho a la propiedad y el reconocimiento a los derechos adquiridos conforme a la ley, al igual que el derecho a la libertad de empresa bajo una función social determinada.El análisis del trabajo determinó que la exclusión a la restricción de la negociación colectiva que estableció el Acto Legislativo No. 01 de 2005 en materia pensional configura una antinomia constitucional, que lesiona en forma grave el mecanismo de concertación por medio de la negociación colectiva, que tienen los trabajadores para acordar y mejorar las condiciones mínimas del trabajo previstas en la normativa legal.

way stabilishing rights or freely restraining them. This article
deals with these and other controversial questions of Collective
Labor Law, section of the Labor Law responsible for the selfcomposition
institute, which grants powers to the unions in a
way that they can celebrate the instruments of Collective Labor
enforced by law, of which its accomplishment is required by
everyone of the categories involved, members of unions or
not. Which are the limits of the unions, when it comes to
negotiations" Which rights can be object of transaction" Is it
possible to abdicate the Labor Laws, when it comes to collective
negotiation" How to conciliate the principles of non-availability
of the Labor Law and the autonomy of collective will" Can
the principle of the negociated sectorial adequacy be applied
indistinctably to the collective rules" These and other matters
are dealt in this article.
Nos últimos tempos, virou modismo falar em
"flexibilização trabalhista", tanto no que diz respeito à própria
mudança na legislação quanto à supressão de direitos via
negociação coletiva. É necessário, outrossim, saber se as
cláusulas normativas inseridas em Convenções ou Acordos
Coletivos de Trabalho estão ou não sujeitas a certos limites, no
nosso ordenamento jurídico, considerando a autonomia privada
coletiva das entidades sindicais, ou se esta autonomia confere
soberania absoluta à vontade dos agentes envolvidos, podendo
estabelecer direitos ou restringi-los livremente. Neste artigo
trata-se destas e de outras questões controvertidas do Direito
Coletivo do Trabalho, ramo do Direito do Trabalho responsável
pelo instituto da autocomposição, que confere poderes aos
sindicatos para celebrar instrumentos coletivos de trabalho, que
possuem força de lei, cujo cumprimento é obrigatório por todos
os integrantes das categorias envolvidas, sindicalizados ou não.
