This paper aims at discussing some facets of the emerging European level of collective negotiations. The paper argues that in general the acquis communautaire and other international acts can already ...accommodate this new category of agreements. At the same time it finds out that lack of a specific legal framework may have negative implications for the binding force of the agreements in question and for their enforcement. The existence of those agreements beyond or parallel to law causes hence confusion in regard to roles that the social partners at the national and the European level should play. Thus, in order to put some structure into the debate, it is argued that a differentiation between, on the one hand, national collective bargaining and transnational collective agreements or negotiations, and, on the other hand, consultation and negotiation powers should be applied. Consequently, the author provides an answer to the title question by stating that even though the growing engagement of European Works Councils into transnational collective negotiations represents a functional development of their practice, it is an example of transgressing their information and consultation competences. Dieser Artikel setzt sich mit verschiedenen Facetten der entstehenden europäischen Ebene von Kollektivverhandlungen auseinander. Es wird argumentiert, dass der acquis communautaire im Allgemeinen dieser neuen Kategorie von Vereinbarungen bereits Rechnung trägt. Gleichzeitig wird festgestellt, dass der Mangel an einem spezifischen rechtlichen Rahmen negative Auswirkungen auf die Bindungskraft dieser Vereinbarungen und auf ihre rechtliche Durchsetzung haben kann. Die Existenz der Vereinbarungen in einer rechtlichen Grauzone bzw. parallel zum Rechtsrahmen sorgt für Verwirrung in Bezug auf die Rollen der sozialen Partner, sowohl auf der nationalen als auch auf der europäischen Ebene. Um die Debatte besser zu strukturieren, wird deshalb argumentiert, dass zwischen nationalen Tarifverhandlungen und grenzüberschreitenden Kollektivvereinbarungen bzw. -verhandlungen auf der einen Seite und zwischen Anhörungsrechten und Verhandlungskompetenzen auf der anderen Seite unterschieden werden sollte. Der Autor stellt abschließend fest, dass, obwohl die Einbeziehung der Europäischen Betriebsräte in grenzüberschreitende kollektive Verhandlungen eine funktionelle Weiterentwicklung ihrer Arbeitsweise darstellt, dies gleichzeitig ein Beispiel für die Überschreitung ihrer Informations- und Anhörungskompetenzen darstellt.
Competition laws have only applied to many participants in the health care industry in Australia and New Zealand since the mid 1990s. Since then, the Australian Competition and Consumer Commission ...has considered a number of applications by medical practitioner associations and private hospitals to authorise potentially anti-competitive conduct, while the New Zealand Commerce Commission has successfully prosecuted a group of ophthalmologists. Amongst medical practitioners, however, there is still confusion and misunderstanding concerning the type of conduct caught by the Australian Trade Practices Act 1974 (Cth) and the New Zealand Commerce Act 1986 (NZ). This is of serious concern given the substantial penalties associated with price-fixing and restrictive trade practices. This article examines the provisions of these Acts most relevant to medical practitioners as well as a number of determinations and judicial decisions. To provide practical assistance to medical practitioners, the key lessons are extracted.
The statistics of union density in Britain are thoroughly documented and there is little disagreement about the overall pattern across British industry between the turn of the century and the present ...day. However, discussion of their significance has largely been dominated by the two apparently incompatible approaches of the 'Marxian' and 'Industrial Relations' schools. In this article, it is argued that an interpretation derived from the theory of social selection can reconcile what is valid in these two approaches and thereby suggest a more satisfactory explanation than either of the reported pattern of variation, both over time and across different sectors of the economy. In conclusion, some wider implications are discussed which bear on recent debates over the class position of white-collar employees.
Are European works councils the first step on the road to European level collective bargaining? Factors against this view include the Directive's limitation to information rights, the existence of a ...clear demarcation between information and bargaining in many EU countries, the national focus of most European unions, and the increasingly divisionalised structure of companies. Nevertheless, as product markets become more internationalised, multinationals develop more international employee management systems, and unions seek cross- border comparisons of employee rights and benefits, there are real pressures towards a form of 'arms-length' bargaining at European level. In this the parties do not formally negotiate at the European level, but they do influence and anticipate each other's at national level. Sind europäische Betriebsräte ein erster Schritt auf dem Weg zu Kollektivverhandlungen auf europäischer Ebene? Gegen diese Sichtweise sprechen folgende Faktoren: die in der EU-Richtlinie vorgenommene Begrenzung auf Informationsrechte; die klare Abgrenzung zwischen Information und Kollektivverhandlungen in vielen europäischen Ländern; das nationale Interesse der meisten europäischen Gewerkschaften; sowie die häufig nach Sparten gegliederten Unternehmens-strukturen. Gleichwohl werden mit der weiteren Internationalisierung der Produktmärkte in vielen multinationalen Unternehmen transnationale Systeme der Arbeitsbeziehungen entstehen und die Gewerkschaften zunehmend grenzüberschreitende Vergleiche von Arbeitsnormen und Arbeitnehmerrechten vornehmen. Es gibt folglich einen realen Druck in Richtung „indirekter Kollektivverhandlungen“ auf europäischer Ebene. Nach diesem Verständnis verhandeln die Parteien zwar nicht formal auf europäischer Ebene, sondern beeinflussen sich gegenseitig und antizipieren ihre jeweiligen Reaktionen auf nationaler Ebene.
