This book analyses main lines of legal development in the area of proprietary security rights in movable assets (comprising pledges/charges, transfer of ownership for security purposes, assignment of ...claims for security purposes, and retention of title), starting from Roman law through the era of European codifications up to the present law in particular in Austria, then continues by analysing main questions of this area of law – above all isues concerning registration systems for security rights – in Germany, the Netherlands, France, Belgium and England, and finally analyses, on that basis, whether the “Draft Common Frame of Reference“ (DCFR), presented by an international group of experts in 2009, provides adequate solutions which are suitable to continue these legal developments consequently. The results achieved in this research show that the DCFR offers attractive solutions that are apt for the future development of the law in almost all areas investigated.
Das Werk arbeitet wesentliche Entwicklungslinien im Mobiliarsicherungsrecht (Pfandrecht, Sicherungseigentum, Sicherungszession, Eigentumsvorbehalt) vom Römischen Recht über die Kodifikationszeit bis ins geltende Recht insbesondere in Österreich heraus, analysiert zentrale Fragestellungen – insbesondere solche betreffend Mobiliarsicherheitenregister – zum deutschen, niederländischen, französischen, belgischen und englischen Recht und überprüft auf dieser Grundlage, ob der 2009 von einer internationalen Expertengruppe vorgelegte „Draft Common Frame of Reference“ (DCFR) sachgerechte Lösungen anbietet, die geeignet sind, diese Rechtsentwicklung konsequent fortzuführen. Die einzelnen Ergebnisse lassen sich dahin zusammenfassen, dass der DCFR fast durchgehend sachlich attraktive und zukunftsweisende Lösungen anbietet.

Examining the vivid, often apocalyptic church murals of Peru from the early colonial period through the nineteenth century, Heaven, Hell, and Everything in Between explores the sociopolitical ...situation represented by the artists who generated these murals for rural parishes. Arguing that the murals were embedded in complex networks of trade, commerce, and the exchange of ideas between the Andes and Europe, Ananda Cohen Suarez also considers the ways in which artists and viewers worked through difficult questions of envisioning sacredness.This study brings to light the fact that, unlike the murals of New Spain, the murals of the Andes possess few direct visual connections to a pre-Columbian painting tradition; the Incas' preference for abstracted motifs created a problem for visually translating Catholic doctrine to indigenous congregations, as the Spaniards were unable to read Inca visual culture. Nevertheless, as Cohen Suarez demonstrates, colonial murals of the Andes can be seen as a reformulation of a long-standing artistic practice of adorning architectural spaces with images that command power and contemplation. Drawing on extensive secondary and archival sources, including account books from the churches, as well as on colonial Spanish texts, Cohen Suarez urges us to see the murals not merely as decoration or as tools of missionaries but as visual archives of the complex negotiations among empire, communities, and individuals.
El propósito de este ensayo es pensar la estructura de poder que se articula en la economía (Illouz) o circulación social (Ahmed) del amor; así como también observar la llamada “responsabilidad ...afectiva” como forma de “reacción” a esa estructura.
La teoría política y social feminista ha identificado en esa economía libidinal una de las más fundamentales fuentes de opresión social basadas en el género. Fue probablemente Carole Pateman quien primero ofreció una genealogía moderna de esa opresión, remontándola a las teorías del contrato social y la noción liberal de consenso. Paradójicamente, para la época en que Pateman ofrece su teoría del contrato sexual, la institución matrimonial se encontraba en jaque, como se ocupó de mostrarlo la socióloga Eva Illouz. Hasta el día de hoy, el matrimonio convive con nuevas formas de filiación sexoafectiva no menos opresivas. Históricamente, el feminismo ha sido pesimista respecto a la posibilidad de pensar formas no opresivas de las relaciones sexoafectivas cisheterosexuales. No obstante, planteamos que la idea de “responsabilidad afectiva”, muy popularizada recientemente en Argentina, se presenta como una vía de reacción de la opresión. A efectos de dar mayor especificidad a esta noción, nos apoyaremos en las obras de Sara Ahmed y Judith Butler.
The stark reality is that throughout the world, women disproportionately live in poverty. This indicates that gender can both cause and perpetuate poverty, but this is a complex and cross-cutting ...relationship.The full enjoyment of human rights is routinely denied to women who live in poverty. How can human rights respond and alleviate gender-based poverty? This monograph closely examines the potential of equality and non-discrimination at international law to redress gender-based poverty. It offers a sophisticated assessment of how the international human rights treaties, specifically the Convention on the Elimination of Discrimination Against Women (CEDAW), which contains no obligations on poverty, can be interpreted and used to address gender-based poverty. An interpretation of CEDAW that incorporates the harms of gender-based poverty can spark a global dialogue. The book makes an important contribution to that dialogue, arguing that the CEDAW should serve as an authoritative international standard setting exercise that can activate international accountability mechanisms and inform the domestic interpretation of human rights.

For decades, most American Indians have lived in cities, not on reservations or in rural areas. Still, scholars, policymakers, and popular culture often regard Indians first as reservation peoples, ...living apart from non-Native Americans. In this book, Nicolas Rosenthal reorients our understanding of the experience of American Indians by tracing their migration to cities, exploring the formation of urban Indian communities, and delving into the shifting relationships between reservations and urban areas from the early twentieth century to the present.With a focus on Los Angeles, which by 1970 had more Native American inhabitants than any place outside the Navajo reservation,Reimagining Indian Countryshows how cities have played a defining role in modern American Indian life and examines the evolution of Native American identity in recent decades. Rosenthal emphasizes the lived experiences of Native migrants in realms including education, labor, health, housing, and social and political activism to understand how they adapted to an urban environment, and to consider how they formed--and continue to form--new identities. Though still connected to the places where indigenous peoples have preserved their culture, Rosenthal argues that Indian identity must be understood as dynamic and fully enmeshed in modern global networks.
