Judge Joseph D. Phelps, of the Circuit Court of Montgomery County, Ala., ruled Feb. 28 that the $72 per ton difference between the tax on in state and out-of-state waste imposed by the state ...Legislature last year is invalid under the commerce clause of the U.S. Constitution. Judge Phelps's ruling was in response to a lawsuit filed last year by Chemical Waste Management Inc. naming as defendants Gov. Guy Hunt, the Alabama Department of Revenue, and its director, James M. Sizemore. The controversial tax, passed by the Legislature last year to help the state meet scheduled expenditures during the current fiscal year, had raised the charge on waste from outside Alabama's borders to $112 a ton from $22 - while raising the rate for in-state waste to only $40 a ton from $22. Although Judge Phelps's ruling affirms the $40 per ton fee on Alabama waste, it rejects the $72 per ton differential between between in- and out-of-state collection.
