Rechtsnormen sind abstrakt formuliert und enthalten unbestimmte Rechtsbegriffe, um eine Vielzahl von unterschiedlichen Lebenssachverhalten in dem Anwendungsbereich einbeziehen zu können. Im konkreten ...Einzelfall bedürfen sie der Auslegung bzw. Konkretisierung, um Zweifel auszuräumen, ob der relevante Sachverhalt tatsächlich zu erfassen ist oder nicht. Der Rechtsanwender kann sich bei dieser Abgrenzung unterschiedlicher Auslegungsmethoden bedienen (z.B. grammatikalische, systematische, teleologische, historische Auslegung). Der Auslegung bedürfen auch die Regelungen der Abkommen zur Vermeidung der Doppelbesteuerung (DBAs). Als allgemeine Auslegungsregeln kommen nach dem Wiener Übereinkommen über das Recht der Verträge (WÜRV) auch jede spätere Übereinkunft oder spätere Übung der Vertragsparteien bei der Auslegung oder Anwendung der Abkommensnormen in Betracht, wobei hierbei in der Besteuerungspraxis teilweise auf den Kommentar der OECD zum Musterabkommen (OECD-Musterkommentar; OECD-MK) zurückgegriffen wird. Unklar könnte hierbei sein, ob spätere Änderungen dieses OECD-MK sich auch auf die Auslegung von Abkommensnormen in vorher abgeschlossene DBAs auswirken können. Die BFH-Rechtsprechung hat dies bislang ganz überwiegend verneint, das BMF will dies nunmehr abweichend davon mit einem neuen Schreiben vom 19.4.2023 für die Finanzamtspraxis jedoch vorschreiben, dass das so zu sehen ist. Der Beitrag analysiert dieses neue BMF-Schreiben und dessen Auswirkungen.
