The present study intends to analyze which is the ambit of incidence of procedural convention constant in art. 357, §2º, of Code of Civil Procedure, which provides the possibility of consensual ...procedural curative acts, allowing the delimitation of the litigious object by the litigants. Starting by the study of dispositive principle in the material sense and the labor division between the judge and the parts, intends to check the reduction in incidence of iura novit curia adage on the determination of the juridical basis of causa petendi because of, precisely, the procedural convention constant in art. 357, §2º, of Code of Civil Procedure.
The paper analyzes the distinction between the two presumptions mentioned in the title. At first glance, it seems that the application of both the Iura Novit Curia and the Iura Novit Arbiter ...principles in international arbitration is redundant. After all, what are the Arbitrator and the Arbitral Tribunal if not a private judge and, respectively, a private Court? However, the distinction between the two concepts becomes extremely important in certain stages of the arbitration, especially when it comes to purely procedural matters. As such, there is a difference between the arbitral process that takes place in front of the Arbitral Tribunal and incidental or additional procedures that take place in front of State Courts (even after the arbitral award has been rendered, e.g. an annulment procedure or at the stage of recognition or enforcement of a foreign arbitral award). In conclusion, the use of both expressions in parallel is justified. Iura Novit Curia corresponding strictly to the role of Domestic Courts in an arbitration, at all stages (both incidental and additional matters during the arbitral process and in follow up procedures) and addressing the knowledge of the Courts’ lex fori (e.g. publicorder/public policy issues), unless explicitly excluded by applicable provisions. While Iura Novit Arbiter pertaining to the role of the Arbitral Tribunal per se – although, in this case, the expression is more a misnomer, the presumption being limited by the choices of the parties as an assertion of party autonomy, a main characteristic of arbitration as an alternative dispute resolution method.

Después de haber llevado a cabo la observación empírica del uso real de las máximas latinas en las resoluciones del Tribunal Supremo, se ha comprobado que siete presentan una notable frecuencia de ...aparición. El aforismo iura novit curia elegido en esta ocasión ―principio que no es romano, sino medieval― presupone la facultad que tienen los tribunales para encontrar el derecho aplicable a la solución del caso, si bien este cambio debe extraerse de los hechos alegados y probados, tiene que guardar la necesaria armonía con la pretensión deducida, con el petitum y la causa petendi. Se estudia este principio procesal desde el punto de vista etimológico y gramatical y se recogen las interpretaciones usuales y admisibles en derecho en el periodo 2013-2014, a partir de un corpus constituido por 306 documentos, correspondientes a las salas Civil, Penal, Contencioso-Administrativo y Social del Tribunal Supremo.
The article discusses the practicability of application of the iura novit curia principle in international arbitration and the potential problems arising thereof. The procedural principle governing ...most civil-law jurisdictions concerns the arbitrator’s power to assess the merits of the case independently of the arguments of the parties and to ascertain and apply the law on its own motion. In arbitration, the application of the principle raises a number of concerns, such as due process, party autonomy or the protection of the interests and expectations of the parties, and touches upon the basic understanding of the arbitrator’s mandate. Thus, the article analyses the principle in light of the theoretical doctrines and fundamental principles of international arbitration.
En este artículo se analiza la necesidad de que el juzgador en general, especialmente el penal, rompa con paradigmas que le impiden abrir su campo de conocimiento y comprensión, más allá del mundo ...estrictamente jurídico, de manera que pueda pronunciarse con mayor conciencia y objetividad sobre los hechos que se juzgan. El principio iura novit curia establece la ficción de un juez racional que se basta con el conocimiento del derecho para resolver los problemas jurídicos. No obstante, es evidente que el juez requiere ampliar sus horizontes epistemológicos para evaluar la admisibilidad y alcances de la prueba especializada en otras ciencias.
This article analyzes the need of every judge, especially those who work on the criminal area, breaking legal paradigms that prevent them from opening up their field of knowledge and understanding, beyond the strict legal world, so that they can pronounce with greater awareness and objectivity on the facts that are judged. The principle of iura novit curia establishes the fiction of a judge that is rational enough with the knowledge of the law to solve legal problems. However, it is clear that the judge needs to expand his epistemological horizons to evaluate eligibility and scope of the specialized test in other sciences.
Este artigo pretende expor os diferentes argumentos e posições quanto à possibilidade da declaração de inconstitucionalidade ex officio. Procuraremos demonstrar que a questão esconde complexidades ...que não podem ser ignoradas quando do tratamento do tema. Propomos, nesse sentido, que é possível cogitar a criação de um modelo que considere as diversas implicações de se proibir ou obrigar o controle de constitucionalidade de ofício. O trabalho utiliza a metodologia analítica, pois, através de estudos da doutrina e da jurisprudência, nacional e estrangeira, desenvolve os argumentos que hoje se colocam, estabelecendo (i) um panorama para a criação de um modelo capaz de absorver as diversas implicações da questão e (ii) uma base para uma crítica construtiva dos modelos que hoje se impõem. Ao final, concluímos que, de fato, o tema merece ser repensado no âmbito da doutrina e da jurisprudência brasileiras, pois se trata de problemática de alta relevância e complexidade, cujas implicações se observam na separação e equilíbrio entre os poderes.
A pesar de su reconocimiento en diferentes jurisdicciones, la aplicación del principio iura novit curia al arbitraje comercial internacional ha sido objeto de debate. Desde el punto de vista más ...liberal, el principio es absolutamente aplicable al arbitraje comercial internacional, tal y como sería aplicado por un juez al dictar sentencia conforme a su derecho nacional, mientras que desde la postura más estricta, cualquier manifestación de este principio que permita a los árbitros tomar la iniciativa de traer nuevas cuestiones de derecho al proceso debe ser rechazada por completo. Partiendo de la premisa de que, por lo general, los miembros de un tribunal arbitral internacional no conocen el derecho aplicable a las controversias que se someten a su conocimiento, ni tienen experiencia o manejo práctico respecto a dicho derecho, la aplicación del principio iura novit curia de forma pura y simple no resultaría adecuada en el contexto del arbitraje comercial internacional en razón de su naturaleza contractual y los intereses involucrados. Por otra parte, rechazar de plano la aplicabilidad del principio en el arbitraje comercial internacional implicaría atar de manos a los árbitros y crearía el riesgo de que se emitan laudos que ignoren o contradigan normas y principios del derecho aplicable, lo que podría afectar su validez y dar pie a que su validez y ejecución posterior se vean cuestionadas. En razón de lo anterior, para que el principio iura novit curia pueda ser aplicado en el contexto del arbitraje comercial internacional, dicho principio debe ser abordado desde una postura intermedia y sufrir una importante adaptación de forma que ciertas manifestaciones del mismo puedan ser aceptadas en casos excepcionales como una herramienta para que los árbitros puedan cumplir cabalmente con los deberes inherentes a su función decisoria, incluyendo el deber de no exceder la jurisdicción que les ha sido conferida, de dictar laudos válidos, ejecutables y apegados al derecho aplicable, de actuar en forma imparcial y de garantizar a las partes en todo momento derechos fundamentales derivados del debido proceso, como lo son el derecho a ejercer su defensa en forma adecuada y oportuna, así como el derecho a ser tratadas con igualdad.
This article shows the results of a study about the evolution of the doctrine of comparative law with regard to the proof of law, taking into account – without exhaustiveness and very probably with ...omissions – some authors who are considered reasonably representative of legal systems with an origin similar to the Uruguayan one, and, on the other hand, all those who have written in Uruguay for more than a century to that regard. It also gathers all the provisions of the Uruguayan domestic law and all the provisionsof private international law of conventional origin that are in force in this country. Finally, it shows what the author considers that might be a theoretical framework of the problem, that adjusted in particular to the Uruguayan law – though it might be applicable to other systems – may allow to understand and apply the corresponding provisions in a logical, coherent, systematic and without contradiction manner, and maybe suggest some guidelines that could contribute to new writings or complementary writings.
Resumen. En este artículo se exponen los resultados de una investigación acerca de la evolución de la doctrina de derecho comparado respecto a la prueba del derecho, considerando, naturalmente que sin exhaustividad y seguramente con omisiones, a algunos autores que se entienden razonablemente representativos de ordenamientos jurídicos de similar origen al uruguayo y, por otro lado, a todos quienes en Uruguay han escrito durante más de un siglo a tal respecto. Se relevan asimismo todas las disposiciones del derecho interno de Uruguay y todas las disposiciones del derecho internacional privado de origen convencional que rigen para este país. Por último se expone lo que el autor entiende que puede ser un encuadre teórico del problema que, ajustándose particularmente el derecho uruguayo, aunque quizás sea trasladable a otros ordenamientos, permita interpretar y aplicar lógicamente, en forma coherente, sistemática y sin contradicciones, las disposiciones correspondientes, y eventualmente indicar lineamientos que podrían con fecundidad aportar a nuevas redacciones o redacciones complementarias.
