Controversy includes claims of government malfeasance and threat of a defamation lawsuit
This article aims to serve as a "starter's guide" for franchisors who might be interested in pursuing environmentally friendly franchise-wide initiatives and explores the legal considerations that ...franchisors must address in order to pursue these initiatives. This article also advises franchisors on potential sources of litigation that may arise from these "Green Initiatives" and how to prepare for them.

Davacının aynı davalıya karşı aynı dava dilekçesinde birden fazla talebini aslîlik-ferîlik ilişkisi içerisinde ileri sürdüğü dava “terditli dava” olarak tanımlanmaktadır. Amaç: Talepler arasında aslî ...ve ferî olarak bir sınıflandırılma yapılabilmesi için aralarında hukukî veya ekonomik bir bağlantı olması gerekir. Bu tanım çerçevesinde özellikle davanın esaslı unsurlarından olan davanın sebebi kavramını açıklamaya yarayan teoriler ele alınarak bir değerlendirme yapılarak terditli davanın kapsamı belirlenmelidir. Çünkü HMK madde 111’deki ifade şekli terditli davanın sadece talep sonucu bakımından geçerli olduğunu göstermektedir. Yöntem: Dava sebebi kavramı ve terditli dava kavramları arasındaki ilişki, terdit ilişkisi, ilmî içtihatlara konu olan uyuşmazlıklardaki çözüm şekli bakımından bir inceleme yapılmasını gerekli kılmaktadır. Bu nedenle öncelikle dava sebebi açıklanmalıdır. Dava sebebini açıklayan teoriler, boşanma sebeplerinin terditli olarak ileri sürülüp sürülmemesi noktasında da yol gösterici olacaktır. Türk Medenî Kanunu’nda düzenlenen özel ve genel boşanma sebeplerinin birlikte aslîlik- ferîlik ilişkisi içerisinde ileri sürülmesi o davayı terditli dava olarak nitelendirmek için kâfi bir gerekçe olup olmadığı tartışılmalıdır. Bulgular: Özellikle Yargıtay 2. Hukuk Dairesi’nin özel ve genel boşanma sebeplerinin birarada aslîlik-ferîlik ilişkisi içerisinde ileri sürülmesini terditli dava olarak tespit eden içtihatları değerlendirildiğinde hukukî sebepte kurulan terdit ilişkisi terditli dava olarak nitelendirildiği görülmektedir. Özgünlük: Yargıtay 2. Hukuk Dairesi özel ve genel boşanma sebepleri arasında terdit ilişkisi kurarak terditli dava olarak nitelendirdiği kararlar hukukî sebep bakımından terditli davanın mümkün olabildiğini göstermektedir. Ancak dava sebebini açıklayan teoriler ele alındığında da hukukî sebepte kurulan terdit ilişkisinin terditli dava olarak tanımlanıp tanımlanamayacağı belirlenmelidir.
The lawsuit in which the plaintiff puts forward more than one claim in the same petition against the same defendant in the relationship of primary and secondary is defined as "action with gradual claims". Objective: In order for a classification to be made between the demands as primary and secondary, there must be a legal or economic connection between them. Within the framework of this definition, the scope of the tentative case should be determined by making an evaluation by considering the theories that help explain the concept of the cause of the case, which is one of the essential elements of the case. Because the wording in HMK article 111 shows that the action with gradual claims is valid only in terms of the outcome of the demand. Method: Theories explaining the cause for the lawsuit will also guide in terms of whether the reasons for divorce should be put forward in a timely manner. It should be discussed whether arguing the specific and general grounds for divorce regulated in the Turkish Civil Code together in the relationship of substantiveness is sufficient justification for qualifying that case as an action with gradual claims. Findings: When the case law of the 2nd Civil Chamber of the Supreme Court of Appeals, which determines that the causes for specific and general divorce are put forward, it is seen that the action with gradual claims may also depend onlegal reasons. Originality: The 2nd Civil Chamber of the Supreme Court of Appeals, by establishing a temporary relationship between the private and general divorce grounds, and the decisions that it defines as an action of gradual claims, show that it is possible to make an action of gradual claims in terms of legal reasons. However, when the theories explaining the reason for the lawsuit are taken into consideration, it should be determined whether the gradual relationship established in the legal reason can be defined as a litigation.

El presente artículo busca dar a conocer el descubrimiento en 2020 del pleito sobre la sucesión del mayorazgo de Pedro Menéndez de Avilés, primer Adelantado de Florida, del que hasta ahora solo se ...conocía un resumen impreso de veintiséis hojas. Los más de seiscientos folios de los que se compone el pleito conservado en el Archivo del Marqués de Ferrera arrojan ahora nuevos datos sobre un litigio que se dilató de 1601 a 1606, ayudan a matizar y completar testimonios que solo se conocían muy resumidos y, de manera más importante, aportan nuevos documentos desconocidos hasta el momento, como la escritura de concordia que puso punto y final a la disputa.
