En Région bruxelloise, les sanctions administratives communales (SAC) ont assuré ce rôle de répression, dans une articulation originale avec la répression pénale. À partir de l’analyse de données empiriques quantitatives et qualitatives, l’article se penche sur les contours et les applications de cette « exception bruxelloise », à l’aune d’enjeux liés à la jouissance de l’espace public dans une ville caractérisée par d’importantes inégalités sociospatiales.

In het Brussels Gewest werden daarvoor de gemeentelijke administratieve sancties (GAS) aangewend, die op een nieuwe manier werden gekoppeld aan strafrechtelijke sanctionering. Op basis van de analyse van kwantitatieve en kwalitatieve empirische gegevens bestuderen we in dit artikel de grote lijnen en de toepassingen van deze “Brusselse uitzondering” in het licht van de uitdagingen die gepaard gaan met het genot van de openbare ruimte in een stad met grote sociaal-ruimtelijke ongelijkheden.

Previously harmless types of behaviour had been made into offences. From the beginning, the punishment of these offences was a priority for the Belgian authorities. In the Brussels Region, the municipal administrative sanctions (MAS) ensured this repressive approach in an unprecedented interrelation with criminal enforcement. Based on the analysis of quantitative and qualitative empirical data, this article examines the outlines and applications of this “exception for Brussels” in terms of issues related to the use of public space in a city characterised by significant socio-spatial inequalities.

The laws of 1999 and 2004 concerning the implementation of municipal administrative sanctions (in short GAS legislation) gave local authorities new legal instruments to act more vigourously against ...phenomena of nuisance. Local authorities can now impose an administrative fine of up to 250 euros for behaviour which is contrary to public order (cleanliness, safety and quiet enjoyment) or which causes “public nuisance”. This publication purports to assess how the 19 municipalities of Brussels Capital Region formulate and apply this local “nuisance law”. Many differences emerge in terms of the content, the procedure and the modalities of municipal administrative sanctions (mediation, taking the minutes, amounts) and in terms of the choice between fines or police punishments. Even though some de facto harmonisation has taken place among Brussels police and security matters and the Region intervenes to make adjustments where necessary, the Brussels Region needs more institutionally-based guidance.
