In Rethinking EU Consumer Law, the authors analyse the development of EU consumer law on the basis of a number of clear themes, which are then traced through specific areas. Recurring themes include ...the artificiality of the EU’s consumer image, the problems created by the drive towards maximum harmonisation, and the unexpected effects EU Consumer Law has had on national law. The book argues that EU Consumer Law has the potential of enhancing the protecting of consumers throughout the EU and could offer a model for consumer law elsewhere in the world, but in order to unlock this potential, there needs to be a rethink with regard to the EU’s approach to consumer law and policy.

When enforcement is determined on an object that is co-owned by the executor and a third party who is not the executor, domestic and comparative procedural theories identify (only) the concept ...according to which the co-ownership of the third party represents their exclusive right, starting from the fact that it is natural for a forced settlement enforcement requester to be carried out based on the value of the executor’s property. In addition to the above, two other models are identified in the paper using the normative- dogmatic and comparative law method – the right of co-ownership of the third party on the object of execution, which represents a conditional exclusive right, and their right which is not an exclusive right. The legal-value reach of the identified legal models is examined by analyzing the current domestic and foreign procedural theories, as well as the current domestic judicial practice, and by examining their compatibility with the convention standard of protection of the third party’s right to peaceful enjoyment of property. Since the laws of the entities of Bosnia and Herzegovina accept opposite models regarding this issue, the research aims to point out to the legislators in the entities of Bosnia and Herzegovina the importance of conceptual harmonization as soon as possible. It is concluded that from the identified legal models, the protection of the right to peaceful enjoyment of the property of a third party is provided (only) by the one that envisages the co-ownership of this person as his exclusive right, either on the movable or immovable thing on which enforcement is determined.
Cíl této studie je dvojí. Je především stručným pohledem na historii katedry mezinárodního (a evropského) práva od jejího založení do současnosti, zejména pokud jde o personální složení a odborné ...zaměření. Druhým cílem je zmapování a vyhodnocení přínosu katedry k rozvoji oborů mezinárodní právo veřejné a právo EU, včetně větve duševního vlastnictví. O oboru mezinárodní právo soukromé pojednává zvláštní studie.Pro přehlednost je text členěn do tří částí, odpovídajících třem obdobím: první do roku 1990, druhé poté do roku 2010 a třetí zahrnující poslední léta a současnost. Zatímco první období bylo ve znamení rozjezdu a budování nové katedry na nové fakultě, druhé období znamenalo v nových podmínkách bouřlivý rozvoj odborné i pedagogické činnosti. Katedra rozšířila svoji působnost o nový velmi dynamický obor právo Evropské unie. V posledním období do současnosti pokračuje bohatá vědecká a pedagogická činnost a stabilizuje se personální složení týmu katedry.Studie dochází k závěru, že katedra významnou měrou přispívá k rozvoji svých oborů, zajišťuje bohatou a hodnotnou pedagogickou činnost a dostala se tak na špičku podobných pracovišť v ČR.
Eine Flexibilisierung des zu starren Schrankenkatalogs des deutschen und europäischen Urheberrechts ist dringend erforderlich. Dies zeigt sich insbesondere bei der Konfrontation der Schranken mit ...neuartigen Formen der Werknutzung. Im Rahmen der technologieneutral und wertungsoffen ausgestalteten Fair Use-Schranke des US-amerikanischen Urheberrechts gelingt es hingegen deutlich problemloser, auch einer veränderten Werknutzungsrealität gerecht zu werden. Rechtsvergleichend untersucht der Autor, wie sich aus Erkenntnissen zur Fair Use-Schranke und dem im europäischen und internationalen Recht etablierten urheberrechtlichen Dreistufentest eine Auffanggeneralklausel gestalten lässt, die den zu starren Schranken der InfoSoc-Richtlinie bzw. des UrhG die erforderliche Flexibilität verleihen könnte, ohne als Fremdkörper im europäischen Recht zu erscheinen.

Oktober 2005 markierte den Beginn eines weitreichenden Umwälzungsprozesses bei der kollektiven ...Wahrnehmung der Musikurheberrechte in Europa, deren Umsetzung nicht zuletzt auch vielgestaltige und bislang ungeklärte Rechtsprobleme nach sich zog. Darin eingeschlossen ist nicht nur die Frage nach der rechtlichen Struktur und urheberrechtlichen Zulässigkeit der infolge der Kommissions-Empfehlung gegründeten Zentrallizenzinitiativen wie etwa der CELAS, sondern auch die Frage nach deren Qualifizierung als Verwertungsgesellschaft i.S.d. UrhWG und deren Auswirkung auf bislang bestehende prozessuale Beweiserleichterungen für Verwertungsgesellschaften wie der GEMA-Vermutung. Die Bewältigung all dieser Rechtsprobleme gebietet nicht nur die alltägliche Lizenzierungspraxis im Online-Bereich; ein grundlegendes rechtliches Verständnis hierfür ist auch zwingend erforderlich, will man bei der paneuropäischen Musikrechtewahrnehmung im Internet künftig neue, einfachere Richtungen einschlagen.Das Werk ist unverzichtbar für Wissenschaft und Musikwirtschaft gleichermaßen, die sich mit den veränderten Rahmenbedingungen der Online-Musikrechteverwaltung beschäftigen.

Dazu stellt die Untersuchung Bezüge zu dem Querschnittsinstrument mainstreaming her und macht die EuGH-Rechtsprechung zu affirmative action-Maßnahmen fruchtbar. Sie widmet sich speziell dem Kriterium der Tariftreueverpflichtung und nimmt eine sorgfältige Verhältnismäßigkeitsprüfung sozialer Vergabekriterien als Instrument staatlicher Regulierung vor. Schließlich werden anhand der gefundenen Ergebnisse die neuen Vergaberichtlinien 2004/17/EG und 2004/18/EG untersucht.
Company law is undergoing fundamental change in Europe. All European countries have undertaken extensive reform of their company legislation. Domestic reform has traditionally been driven by ...corporate failures or scandals. Initiatives to make corporate governance more effective are a feature of recent European law reform, as are measures to simplify and ease burdens on smaller and medium-sized businesses (SMEs). An increasing EU harmonisation is taking place through the Company Law Directives, and the free movement of companies is also facilitated by the case law of the European Court of Justice on the directives and the right to free movement and establishment in the EC Treaty. New European corporate forms such as the European Economic Interest Grouping (EEIG) and the European Company (SE) have added new dimensions. At a time of rapid development of EU and national company laws, this book will aid the understanding of an emerging discipline.
