This article discusses the use of cartoon visual depictions of women during the First World War and the humour within them for the viewing public. Extensive historiography of women and war recognizes ...female contributions to the war effort, and the underlying integrity of motherhood throughout. Nonetheless, how audiences perceive visual representations of women during war do not feature within this literature to the same degree. Evaluation of cartoon humour alongside context of images of women historicizes the content and its impact on respective contemporary audiences. News publications throughout the war provide appropriate visual sources, and most for this study come from the British Cartoon Archive (BCA) at the University of Kent. The article considers three predominant tropes of female cartoon illustration during the war: the young and flighty, the elderly matron and the allegory of combatant nations. Cartoons of these womenvisibly take on new positions in war: helping the war effort or misunderstanding new situations whilst maintaining traditional positions from before the war. Humorous alterations to anticipated stereotypes provide didactic purpose showing the public how to behave, or more specifically how not to with the younger and older depictions. The final group of allegorical personas revisit older national and abstract icons to aid public morale providing relief and hilarity through enemydenegration or support and strength when visualizing home nations. This article argues how humorous cartooning of women in wartime preserved the pre-war status quo of female positions in society to provide comfort and relief to the public despite acknowledged female involvement in the war effort overall.
Media images of heroic, hard-working Australian achievers have often accompanied stories about an upbeat national work ethic to boost public morale in times of massive upheavals and crisis. The ...concept of an Australian work ethic has not been a natural creation, but it has been actively developed in the media. This article reveals a turning point in the media portrayal of the crucial area of work that helped cultivate diverse expressions of Australia's image. The article focuses on the era of momentous disruption in World War II that led to an unprecedented idealisation of workers and changed the traditional roles of the prime minister, journalists and the public. Wartime prime minister John Curtin became an egalitarian partner and a collaborator with media teams. Journalists created increasingly inclusive media experiences to encourage the public to identify with the fashionable new ethos of working-class thrift. Wartime citizens enthusiastically contributed to the varied media expressions of collective work ethics, overturning the traditional notion of a passive public sphere. Using the concept of the emotional public sphere, this article provides a rare perspective on the media's role in shaping and extending popular attitudes towards Australian workers, collective service and inclusive communities.
This article suggests that the study of the War of Resistance against Japanese aggression should pay due attention to the effect of the war on the wartime everyday, that is, on Chinese culture, ...politics, society, and the economy away from the battlefield. Not only was the impact deep and enduring, but evolving, regionally and socially divergent responses to the war also shaped the war's military. In modern war, as Karl von Clausewitz pointed out, public morale is a key factor in deciding the outcome of the fighting. The article first sketches the war's impact on the Chinese economy, suggesting that the main consequences were "demodernization" and the revival of traditional trading patterns. It then discusses the reading lives of a young woman who grew up during the war and a senior Nationalist official to delineate contrasting emotional private responses, with one person finding in literature an inspirational alternative and the other becoming increasingly disillusioned. The article concludes with an examination of three popular history textbooks. They all stressed the importance of an awareness of Chinese civilization but narrated its nature and its prospects in contrasting ways. Such textbooks were used in required Chinese history courses at universities. The article makes no attempt to be comprehensive but instead uses a few examples as illustrations of the potential of researching wartime everydayness.
In this article, I present discussions of conditions for reviving public morale and, in the process, public morality, which would ultimately be a political goal, using examples from the Victorian era ...in Britain and what Americans refer to as the Progressive Era at the beginning of the twentieth century in the United States. I begin with an older book by Gertrude Himmelfarb that emphasises the revitalisation of public morality in Victorian Britain. A book by Robert D. Putnam and Shaylyn Romney Garrett makes similar claims for the effects of the Progressive Era in the US, and for how a similar approach could be useful in the present era. Both books emphasise cultural critique and discount the effects of causality going in the opposite direction, starting with economic revival, and I discuss this dilemma in this article.

The coronavirus crisis has really tested the ability of politicians to speak in public without putting their foot in it. From the early days, when British Prime Minister Boris Johnson thought he was ...doing his bit for public morale by reassuring us that he was still shaking everyone's hands, the pandemic has been quite a schooling for a leader who has long delighted audiences by himself not knowing what outrageous thing he was going to say next. It has been interesting to observe him editing his performance in real time, forcing himself to swallow the colorful phrases and to replace them with the dead bureaucratese of the officials who brief him even as he speaks. In an early news conference, the linguistically boisterous Johnson talked about "squashing the sombrero," but as he was referring to a graph of predicted deaths, in later appearances his language became less colorful.
Depuis 1995, des membres se sont régulièrement joints à l’Organisation mondiale du commerce, formant ainsi une mosaïque complexe d’États hétérogènes qui comprend une variété de cultures, de ...religions, de pratiques et de coutumes. Cette diversité croissante pose plusieurs défis importants, particulièrement quant à la possibilité de limiter le commerce en raison des préoccupations citoyennes qui émanent de tous les membres. Comment un État peut-il répondre aux demandes formulées par sa population tout en respectant ses engagements en faveur des autres membres ? L’exception de moralité publique a consisté en une réponse, laquelle a été étudiée à quatre reprises par les organes quasi juridictionnels de l’OMC. Si les quatre mesures défendues ont été reconnues comme relevant de l’ordre de la moralité publique, aucune n’a pu franchir la totalité des tests commerciaux et être entièrement justifiée. Les lacunes et les interrogations relatives à l’interprétation de cette exception, tout comme le nouvel engouement qu’elle suscite, méritent que l’on s’y attarde. Pour ce faire, cet article propose de revisiter l’exception de moralité publique à la hauteur de la jurisprudence de la Cour européenne des droits de l’homme qui, elle aussi, interprète l’expression de la moralité publique, et ce depuis plus de quarante ans. Elle a su, au travers de sa jurisprudence, développer une approche unilatérale de la norme morale et inscrire la nécessité d’une telle ingérence dans l’exercice et la jouissance des droits et libertés dans une perspective consensuelle. Il est posé comme postulat que les organes quasi juridictionnels de l’OMC pourraient faire de même, et ce dans le but de respecter la nature de la norme.
L’Union européenne a adopté en 2009 des règles ayant pour effet d’interdire l’importation ou la mise sur le marché des produits dérivés du phoque, à l’exception de ceux provenant de la chasse ...pratiquée par les Inuits ou en vue de la gestion durable des ressources marines ou encore ceux rapportés par les voyageurs. Le Canada et la Norvège ont introduit à l’OMC une procédure de règlement des différends contre ces règles. Selon le rapport de l’Organe d’appel, adopté par l’Organe de règlement des différends, ces règles ne sont pas compatibles avec les principes de base du GATT. Elles entrent cependant dans l’une des exceptions à ces principes, exceptions permettant à un État de prendre des mesures restrictives au commerce, dans le cas présent celle permettant de prendre des mesures nécessaires à la protection de la moralité publique. Ces règles doivent toutefois être amendées parce que, telles que conçues actuellement, elles constituent un moyen de discrimination arbitraire.
Dans les matières dites techniques, auxquelles se rattachent les règles d'organisation et de fonctionnement du marché boursier, le droit pénal est utilisé comme une discipline accessoire, ...garantissant l'efficacité de ces réglementations. Cette approche emporte une déformation du droit pénal de fond et un recul de la protection normalement garantie par celui-ci, essentiellement par des atteintes au principe de la légalité criminelle et une instrumentalisation du mécanisme de la responsabilité pénale. Il en résulte que l'apport du droit pénal à la moralisation du marché boursier est limité aux exigences du procès équitable, l'assimilation des sanctions pécuniaires administratives à des peines ayant emporté leur soumission aux principes généraux qui gouvernent la matière pénale. Pourtant, quel que soit le champ de son intervention, le droit pénal demeure porteur de valeurs morales fondamentales. Il ne peut d'ailleurs contribuer à moraliser le marché boursier que dans la mesure où il est normatif. Le recours à la sanction pénale doit dès lors être limité à la répression de la ruse, matérialisée par la création ou l'exploitation d'une situation de déséquilibre entre les individus. Le droit pénal ne doit plus être au service de la régulation des marchés, mais voir son efficacité garantie par celle-ci. Loin d'être étrangère aux préoccupations de concurrence inhérentes au fonctionnement des marchés, cette approche contribuerait à la conciliation de la morale et de l'économie sur ceux-ci.
In so-called technical subjects which relate to the rules of organisation and operation of the stock market, criminal law is used as an ancillary discipline, ensuring the effectiveness of these regulations. This approach leads to a distortion at the core of criminal law and adecline in the protection which is normally guaranteed by, essentially, violations of the principle of criminal law and a manipulation of the mechanism of criminal responsibility. As a result, the contribution of criminal law to the morality of the stock market is limited to therequirements of fair trial, the balance between administrative sanctions and penalties that have been achieved through abiding to the general principles that govern the criminal.Yet regardless of the scope of its intervention, the criminal law remains with its fundamentalmoral values. It can only contribute to the morality of the stock market by being normative.The use of the criminal sanctions must therefore be limited to the suppression of the ruse, aswitnessed by the creation or operation of a situation of imbalance between individuals. The criminal law should no longer be at the service of the regulation of markets, but see its efficiency guaranteed by it. Far from being foreign to the concerns of competition inherent tothe key components of the markets, this approach would lead to the reconciliation of morality and the economy of the markets themselves.
Quoique bénéfique au niveau global, l’ouverture des marchés peut constituer une menace pour les valeurs fondamentales qui constituent le socle d’une société. Elle suscite ainsi un débat sur le ...contenu et les limites à la souveraineté nationale et, par opposition, sur la légitimité de l’OMC en lien avec la reconnaissance de ces valeurs. À l’heure où les États membres ne semblent pas à même de s’accorder sur de nouvelles avancées ambitieuses, l’article XX a) du GATT constitue un élément cardinal d’une solution, car il offre la seule garantie contre une vision absolutiste du commerce international. Cet article rassemble les éléments nécessaires pour approcher la notion de moralité publique. Par un examen de la genèse de cette disposition et de la jurisprudence de l’Organe d’appel et d’autres juridictions internationales, il relève le rôle important des États et expose les arguments pour que l’OMC, via son mécanisme de règlement des différends, reconnaisse d’une manière principielle que l’article XX a) conduit à une lecture des accords de l’OMC cohérente avec les valeurs fondamentales de chacun des États membres, sans contredire les objectifs du Traité.
