Die anhaltende Dysfunktionalität des Europäischen Asylsystems „ruft“ nach Reformen. Hier werden die Gesamtkonzepte von Ruud Koopmans und Lothar Häberle analysiert. Bisher nutzen Migranten mit ...aussichtslosem Asylantrag die oft lange Bearbeitungszeit, um im Wunsch-Mitgliedstaat als Arbeitsmigrant Fuß zu fassen („Spurwechsel“). Diese Fehlanreize sind abzustellen durch physische Asylverfahrens-Verlagerung und Verfahrens-Beschleunigung. Irreguläre Migration soll vor allem durch humanitäre Kontingente und Visa für (Fach-)Kräfte ersetzt werden. Trotz verschiedener Herangehensweise und Unterschieden im Konkreten zeigen beide Konzepte entscheidende Gemeinsamkeiten auf. Um diese strategischen Entscheidungen wird keine Reform des Europäischen Asylsystems herumkommen.
El estudio de los cambios experimentados por el ejército borbónico tras la paz de Utrecht constituye el objetivo de este artículo, que se apoya en el análisis de la documentación referida a Galicia ...conservada en el Archivo General de Simancas (informes y correspondencia de la secretaría de Guerra, contabilidades militares, hojas de servicio) y en diversos archivos municipales. El texto profundiza en el proceso de reformación de las fuerzas que participaron en la guerra de Sucesión y en las reformas desarrolladas en tiempos de Alberoni, temáticas que han recibido escasa atención de los investigadores hasta la fecha. En concreto, el artículo revisa la reforma de los tercios gallegos en 1715 y las modificaciones de la planta militar, prestando particular atención a los efectos del restablecimiento de la Intendencia en 1718. Dicho estudio permite concluir que las reformas efectuadas entre 1713 y 1720 se aplicaron con flexibilidad y dejando espacio a los particularismos, lo que otorga especial interés a dicha etapa y obliga a reconsiderar la imagen homogénea del ejército de Felipe V.
Esta pesquisa visa fornecer um estudo comparativo que procura projetar os impactos da Reforma Trabalhista brasileira sobre o desemprego. Como estratégia adotada, o estudo compara a reforma brasileira ...com reformas trabalhistas similares implementadas no mundo, como a reforma alemã (2003-2005), e a australiana (1994). Utilizando o Método de Controle Sintético, os efeitos de longo prazo sugerem uma queda média da taxa natural do desemprego brasileiro entre -1,17 p.p (efeito encontrado na Austrália) e -3,46 p.p (efeito encontrado na Alemanha). O estudo estima, portanto, que a reforma trabalhista pode ter efeitos expressivos em termos de redução do nível de desemprego brasileiro. Este efeito sobre a queda do desemprego, contudo tende a ocorrer de forma bastante lenta.

Al frente del nuevo Gobierno fue designado Pedro de Cevallos, que llegó a comandar una impresionante expedición militar de 10.000 hombres destinada a poner coto al avance portugués en jurisdicción técnicamente española desde el sur del actual Brasil. Fue por eso que el 7 de noviembre de 1773 partió desde Montevideo encabezando un destacamento de 1.014 hombres con rumbo a la región occidental de la Laguna de los Patos (actual Brasil), conocida entonces como Río Grande (figura 1), para evacuar por la fuerza los territorios ocupados por los lusitanos y proteger algunos de los puntos fronterizos más amenazados. Los historiadores brasileños, por su parte, se han interesado más por el estudio de la región riograndense en el período posterior a la firma del Tratado de San Idelfonso (1777). Por lo tanto, analizar esta expedición en particular es de sumo interés, pues el estudio del funcionamiento del dispositivo militar rioplatense puesto en marcha en aquel contexto permite penetrar en una coyuntura extraordinaria y observarla a ras de suelo, para entender las posibilidades de acción y la capacidad de ejecución de la administración colonial borbónica en el marco de un fuerte proceso de reforma, y en un momento en el que los viejos modelos de organización militar y los nuevos que intentan imponerse coexistían y se solapaban permanentemente.
The article analyzes the strengths, weaknesses, potential opportunities and threats in the process of forming and making appropriate management decisions to integrate health facilities into united ...territorial communities (UTC) infrastructure, or other options, in the process of decentralization. The basic package of new legislative and regulatory documents has been worked out, which envisages radical changes and systemic reforms, decentralization of power - transfer from the executive bodies to local self-government bodies of a considerable part of powers, resources and responsibilities. A number of reform changes have been identified, which may lead to the expected institutional, organizational and structural-functional changes of the existing public health management system in Ukraine and changes in the individual functional characteristics of the entities of this system. The differences between medical reforms in terms of administrative reform, the role of UTC in this process, in relation to a number of other European countries are considered. On this basis, possible options for the development of events in the context of territorial governance of these processes in the system of health in Ukraine have been proposed. In order to continue scientific research in this direction, the next stage of the evolution of the formation and adoption of appropriate management decisions in the UTC is to consider the cooperation of the UTC in the creation of joint infrastructure medical facilities, their governing bodies, implementation of projects of activity, financing and maintenance.
Die seit 2012 existierende Europäische Bürgerinitiative (EBI) erhält ein Makeover. Die im Herbst 2017 von der Kommission präsentierte und am 12. März 2019 vom EU-Parlament bzw. am 9. April 2019 vom ...Rat der EU beschlossene Reform lässt die Bereitschaft der EU-Organe erkennen, die durch Gesellschaft, Politik und Wissenschaft erfolgte Kritik an der bisherigen Regelung aufzunehmen und so der EBI zur Entfaltung ihres vollen Potentials zu verhelfen. Die Reform beschränkt sich jedoch größtenteils auf formale und organisatorische Änderungen, insbesondere die Frage nach den „korrekten" Folgemaßnahmen einer erfolgreichen EBI bleibt unberührt. So lässt sich denn auch durchaus kritisch hinterfragen, ob die revidierte EBI-Verordnung die an die Reform gestellten Erwartungen zu erfüllen vermag. Dieser Frage geht der vorliegende Beitrag im Lichte bisheriger Erfahrungen und Rechtsprechung zur EBI nach.
This article seeks to analyze the time-being by means of the possibilities to reform public policies (at national and European level) which concern the economic and social area. The national and ...European social and economic well-being depends on the sustainability of the economic and social policies and on the determination to reform the system. We are considering the analysis of the evolution of the governmental policies regarding the status and evolution of labor force, the pension system and the assumption of the key structural reforms for economy and public administration. The economic resources required for the reform are affected by the new challenges emerged internationally: a potential new economic crisis, the management of the developments emerged on the energy markets, the management of the withdrawal of the United Kingdom from the European Union, etc.
Die vor kurzem beschlossene Reform des Gerichts ist mit weitreichenden Eingriffen in die Struktur des Gerichtssystems der EU verbunden. Sie sieht eine deutliche Erhöhung der Richterstellen in drei ...Stufen vor, die unter Einbeziehung des Gerichts für den öffentlichen Dienst und bernahme der dort anhängigen Rechtsstreitigkeiten erfolgt. Es sei daran erinnert, dass nach dem Vertrag von Lissabon Art. 19 Abs. 1 S. 1 EUV vorsieht, dass „der Gerichtshof der Europäischen Union … den Gerichtshof, das Gericht und Fachgerichte umfasst“. Dabei geht es um ein Organ bestehend aus mehreren Teilorganen. Dieser Beitrag ordnet sich in den durch das Thema dieser Veranstaltung - die herausgeforderte Integration im Lichte des unionsverfassungsrechtlichen Ansatzes von Professor Dr. Dr. h. c. Gert Nicolaysen, wiedergelesen in Krisenzeiten - gegebenen Rahmen ein, indem er ein Schlaglicht auch auf die politischen Hintergründe der Reform wirft. Mit der Reform haben die politischen Entscheider nicht nur die praktischen Schwierigkeiten des Gerichts bei der Umsetzung seines Rechtsprechungsauftrags anerkannt und hierauf in positiver Weise durch die Reform des Gerichts reagiert. Vielmehr kommt die Reform insbesondere den Unionsbürgern zu Gute, indem sie deren Rechtsschutzbedürfnisse, auch soweit deren Bürgerrechte betroffen sind, anerkennt und stärkt. Sie hat insoweit auch eine unionsverfassungsrechtliche Dimension. Ich werde im Rahmen dieses Beitrags nicht auf die zum Teil lebhaft geführten Diskussionen eingehen, die den Gesetzgebungsprozess zur Reform des Gerichts begleitet haben. Stattdessen werde ich mich darauf beschränken, zunächst die Beweggründe darzustellen, die den europäischen Gesetzgeber veranlasst haben, das Reformprojekt anzugehen. Anschließend werde ich die durch die Reform bedingten Änderungen selbst darstellen, bevor ich einen Ausblick auf die Herausforderungen gebe, mit denen das Gericht jetzt konfrontiert ist.
Cet article propose une définition de la région dans l’Union européenne sur le plan cartographique. La carte montre qu’il existe bien un modèle régional européen ; or la réalité qu’il recouvre est ...diverse. La région moyenne de l’Union européenne est plutôt petite avec une population dépassant légèrement 1,2 millions d’habitants. Elle est plutôt macrocéphale avec une agglomération urbaine centrale par région. Il existe cependant des régions très différentes de ce modèle standard. C’est en particulier le cas des nouvelles régions françaises que la réforme récente a encore plus éloignées de ce modèle. Les régions françaises actuelles ne sont ni de taille, ni de profil européen. Elles sont parmi les plus grandes de l’Union, relativement sous peuplées et très peu macrocéphales.
