Introduction. The article deals with the theory of law by Nicholas Luhmann as one of the most important conceptual and methodological sources of Western communicative theories of law developed in the ...context of post-metaphysical thinking in social theory. Theoretical analysis. In the social system of Luhmann, communication communicates, so the concept of Luhmann belongs to the number of non-subjective ones. The legal system in this concept is formed by the differentiation of communications, thanks to which a legal co de arises. On its basis, specific communications are redefined, being included in the legal system. The function of the legal subsystem is to stabilize other subsystems by normalizing the expectations of counterparties and “monitoring” all subsystems. Empirical analysis. Luhmann shows that the justification of law within law is impossible due to the paradox of self-application – law cannot determine whether it is itself a law. The logical paradoxicity of law does not cancel its functionality, since the basis of law is transcendent and is brought into the political system. Results. The Luhmann model of autopoiesis is not correlated with usnaturalism, since it is focused on the processes of social self-organization. It reflects the classical explanatory schemes traditional for legal positivism, since positivization is ultimately subordinated to the transcendent political basis of law.
In the late eighties of the 20th century, the methodological reflection of lesbian identity arose within the framework of feminist jurisprudence. Although the original intention was to include ...lesbian identity in a woman's identity, in a relatively short period there was a sudden break. Lesbian identity became a distinct identity considered to be the central position of lesbian jurisprudence. This study presents the peculiar features of lesbian legal theory. It tries to point out the historical and ideological determinants that led lesbianism to enter (legal) feminism. Lesbian separatism also took part in this development. It turned out to be the main reason for the separation of lesbian legal scholars from the feminist jurisprudence. The study presents the core ideological assumptions that constitute the theoretical nature of the lesbian theory of law, which is based on lesbian (legal) experiences.

In the legal literature, the traditional idea is that Soviet legal scholars until the early 1930s rationally expected the withering away of law as socialism was being built. In this regard, this ...article aims to critically review the views on this problem that existed in the USSR and to check if such a theory (group of theories) really existed. To do this, the author checked the internal logic and detailing of the views of some leading Soviet legal philosophers (P. I. Stuchka, E. B. Pashukanis, M. A. Reisner, and I. P. Razumovsky). Their views on the problem of the withering away of the law were also compared with other elements of their scientific theories and with the provisions of classical Marxism. It has been established that none of the considered works contains a full-fledged scientific theory of the withering away of law. P. I. Stuchka never supported this idea, and in his works, he wrote about the “withering away” of only certain liberal legal doctrines (freedom of contract, the autonomy of will, etc.). E. B. Pashukanis, known as the most influential Soviet legal nihilist, argued that the law would be completely replaced by technical norms, but did not provide any explanation for this statement. In many contemporary phenomena of politics and economics, he saw signs of the degradation of law but did not explain in any way how this would lead to the withering away of law itself. The replacement of law by technical norms was also predicted by M. A. Reisner, but his view was even more general — the law should have disappeared by itself when universal equality and justice would have been established in society. The philosopher I. P. Razumovsky also described the withering away of law only in general and, apparently, saw it as nothing more than an ideological stamp. The inability to formulate a detailed theory of the withering away of law, we believe, demonstrates the stability of the Western tradition in the face of many years of determined attempts to deconstruct it.
Abstract This article interrogates the misunderstanding about the inability of legal rules to influence relations between states in transboundary river basins. Building on the interactional theory of ...law, the author formulates three analytical frameworks for understanding the role of legal rules in the processes of cooperation and peaceful settlement of disputes in transboundary river basins. The article ultimately argues that law offers broader utility than previously envisaged to these processes. In conclusion, it teases out five such utilities of legal rules as demonstrated by four case studies in a broader study.
In den Selbstreflexionen der Rechtssoziologie sind wissenschaftliche Autonomie und gesellschaftliche Praxis in unterschiedlicher Weise jeweils einseitig besetzt worden und zusätzlich mit einer ...asymmetrischen Nützlichkeits-Fragestellung, also mit einem reduzierten Praxis-Diskurs gekoppelt worden. Das führt einerseits zu einem eher unterkomplexen Social-engineering-Modell der Rechtssoziologie, andererseits zu einer Sublimation wissenschaftlicher Autonomie und damit zu einer theoretisch nicht zwingend erforderlichen Immunisierung gegen Praxis-Diskurse innerhalb der Soziologie als Wissenschaft. Für die Rechtssoziologie, so die zugrundeliegende Vermutung, hat sich diese Konstellation als ein Hindernis für eine erfolgreiche Institutionalisierung erwiesen.
The goal to be achieved in the first instance is to make some reflections on the mythological models judge, brought by François Ost in your text Jupiter, Hercules y Hermes: three models juez, and ...their levels of discretion in their decisions. For this, each judge model will be contextualized and compared with its theory of law to which Ost bind them. As a result, will be sought-delineate these theories, the existence of advances in the control of discretion in the interpretation of the law, making it a comparative form between each mythological character, using the deductive research method for this.
Este trabajo revisa la institución del amparo dentro del Estado constitucional de Derecho, en la cultura jurídica del civil law. Se defiende la tesis de que la institución procesal del amparo no es ...teóricamente necesaria –en sentido lógico– para la existencia del Estado constitucional; las razones para justificar su implementación son entonces de tipo práctico. Se argumenta también que, con base en el constitucionalismo jurídico y tomándose en serio el proceso de constitucionalización de los ordenamientos, es posible estipular una concepción general del amparo e inferir un modelo óptimo, ajustado a las propiedades del Estado constitucional, que armoniza lo relevante de los actuales modelos europeo y latinoamericano y diluye sus problemas. Este modelo óptimo es el que deben tener presente quienes decidan implementar o mantener (con ajustes) la institución procesal del amparo.
