  • Territorial integrity versus self-determination : the case of Kosovo before the ICJ

    Both the principle of territorial integrity of States and the principle of self-determination of "pepoles" (in a territorial sense) belon to the body of positive international law. In spite of the ... fact that in actual practice they sometimes exclude one another, it cannot be proved that one derogates another as a legal principle. This paper deals with the conflict of these principles in the light of the process of disintegration of the Yugoslav Federation (the SFRY) and especially in the secession of Kosovo from Serbia, wich was the subject-matter of the Advisory Opinion by the Interantional Court of Justice rendered on 22 July 2010.
