  • Children's rights as a starting point for a new concept of preschool education

    Human and children's rights are one of the cornerstones upon which a new concept of preschool education in Slovenia is based. The article briefly and critically presents individual views on ... children's rights and also the right of parents to choose a private kindergarten and the pertaining right to raise their children according to their own religious, moral or philosophical beliefs. The basic dilemma accompanying the first right is whether the state should treat this right as a negative or a positive one. The realisation of the second right is problematic because it represents an antinomy - according to the General Declaration of Human Rights, a child's parents have the same right to freedom of thought, conscience and religion as their child has according to the Convention on Children's Rights. Since both children and parents have the same right, it can be asserted in education by both only when there are no differences between them. If, however, there are differences, either a child or his/her parents can assert it, not both. And even parents can assert it only when they do not differ considerably about (ir)religious education of their children. If they do, the problem arises since only one parent can assert his/her right and thus violates the right of the other parent.
