El Centro de Investigación y Desarrollo de Medicamentos (CIDEM) es una empresa del Grupo de las Industrias Biotecnológica y Farmacéutica de Cuba (BioCubaFarma) que se dedica a la investigación y ...desarrollo de medicamentos genéricos, innovadores y de productos naturales, en diferentes etapas de su desarrollo hasta su escala industrial y la comercialización. El objetivo del artículo es caracterizar la gestión de la propiedad industrial del CIDEM en relación a las etapas del ciclo de vida del proyecto/producto. Estas etapas se dividen en I+D, registro y transferencias. Finalmente se muestran las estrategias de la propiedad industrial.

he objective of the research reported here is to ascertain what variables influence the behavior of the patents that receive the most citations. The literature recognizes the number of forward ...citations as one of the most important indicators for discovering an invention’s value. This claim is tested in a research population consisting of the set of Brazilian green patents registered in the Global Patent Index database. The following variables are used: applicant type, applicant country, number of inventors, International Patent Classification code, family size, renewals, Patent Cooperation Treaty applicability, triadic family, grant and number of citations. These variables are used to create a decision tree and a logistic regression with the Statistical Package for the Social Sciences, V.21, and MS Excel. The results show that, in the behavior of Brazilian green patents, family size and renewals are connected to the mostcited patents. Another significant variable, but one whose numbers were not significant enough to place it in the decision tree, was membership in the Patent Cooperation Treaty.

This article relates to the concept of intellectual property cases, which has recently been added to the Polish Code of Civil Procedure (CCP). The introduction of this concept has to do with changes ...in the CCP, which have been in force in Poland since 1 July 2020. From that date, intellectual property cases are dealt with by the courts under a new special procedure. Classification of a particular case as an intellectual property case has important practical consequences: an intellectual property case is heard in distinct proceedings; otherwise, general regulations will apply. The definition of intellectual property cases which is in the CCP is not obvious and raises doubts. The aim of the article is to analyse this definition and to propose certain directions of interpretation.
La presente investigación tiene por objetivo el estudio de la evolución jurisprudencial del Tribunal de Justicia de la Comunidad Andina (TJCA) en relación con el ámbito de protección territorial del ...nombre comercial: desde la jurisprudencia primigenia de la década de 1990 hasta la jurisprudencia actual, la cual retorna a la posición inicial del TJCA. Actualmente, la jurisprudencia andina precisa que la protección del nombre comercial (no registrado) debe tomar en cuenta “la amplitud de las operaciones” y el “ámbito geográfico” de su uso (Procesos 42-IP-2017 y 317-IP-2017). La metodología de investigación utilizada incluye los aspectos normativo, jurisprudencial y doctrinal, lo cual apoya la decisión del TJCA de modificar la posición —equivocada, por cierto— que se había establecido en el Proceso 99-IP-2014 (“el nombre comercial debe ser protegido en todo el territorio nacional”).

The article deals with the analysis of governmental system by sphere of the intellectual property in the conditions of the reforms being carried out at the present stage of formation of the state. ...The author presents and generalizes a short characteristic of stages of functioning of governmental system in the sphere of intellectual property during the period of independence of Ukraine. The article provides the analysis of operating system of the governmental administration by the intellectual property in Ukraine. The system and structure of the state bodies have been analysed, their powers have been defined, their characteristic is given and ways of interaction are pointed out. The importance of a direction of a state policy on elimination of duplication and dispersion of administrative functions in the intellectual property sphere has been defined. The necessity of improvement of quality and level of work of advisory and consultative bodies concerning formation of a unified state innovative policy, including in the intellectual property sphere has been specified. The formation of system of economic stimulus concerning creation and introduction of objects of intellectual property is an important task in this sphere of the public administration. The basic problems which demand their decision for possibility of improvement of system of the government intellectual property sphere have been defined in the article. The author reveals and points out the basic directions which development will allow to raise a level of innovations, to form a system of commercialization of objects of intellectual property and to form a civilised and legal market of such objects in Ukraine. It is established that reforming of system of the governmental administration in intellectual property sphere has led to the definition of additional directions and functions of bodies of public administration that should lead to construction of strategy of management by intellectual property in Ukraine at qualitatively new levels which will correspond to the international standards in the given sphere.
