U tekstu se na osnovi zapisnika sa suđenja vješticama u sjeverozapadnoj Hrvatskoj od kraja 17. pa do sredine 18. stoljeća ukazuje na njihovu zajedničku neuralgičnu točku, a to je odnos prema tijelu i ...tjelesnosti. Analizom iskaza sa suđenja, kojima se pristupa kao osobnim narativima žena o njihovim životima, strahovima, projekcijama pa i fantazmama, moguće je iščitati da anksioznost povezana s manifestacijama tijela ima svoje izvorište u psihičkome strukturiranju subjektiviteta. Određeni elementi vještičjega imaginarija poput infanticida i antropofagije govore o strahu od majke koja subjektu priječi ulazak u prostor simboličkog, odnosno ukazuju na svojevrsnu zaglavljenost u liminalnom području između imaginarnoga i simboličkoga. Majka kao subjektov Drugi koji mu jamči život i identitet premeće se potkraj 17. stoljeća u monstruoznu vješticu koja prijeti poništavanjem cijele “ženske” domene – djece, doma, hrane, životinja, ali koja postaje i kolektivnim Drugim koji je poslužio za kanaliziranje sukoba, tjeskoba i nasilja u društvu.

This groundbreaking book offers the first full analysis of the long-neglected and controversial subject of female infanticide in China. Although infanticide and child abandonment were worldwide ...phenomena from antiquity down to the nineteenth century when massive numbers of children were still being abandoned in Europe, China was unique in targeting girls almost exclusively. Yet despite its persistence for two thousand years, little has been published on a practice that is deeply sensitive within China and little understood by outsiders. Drawing on little-known Chinese documents and illustrations, noted historian D. E. Mungello describes the causes and continuation of female infanticide since 1650 despite efforts by Confucian moralists, Buddhist teachings, government officials, and even imperial edicts to stop the practice. The arrival of Christian missionaries led to foreign involvement as well, with Catholic priests baptizing abandoned and dying infants in Nanjing and Beijing beginning in the early 1600s. Mission efforts peaked in the nineteenth century when the European-based Society of the Holy Childhood urged Catholic children to contribute their pennies to help neglected children in China. However, most of the infant victims were drowned at birth in the privacy of their homes, thereby escaping the scrutiny of the law and the public. Mungello brings this secretive practice to light with a nuanced and balanced analysis of the cultural, economic, and social causes of early infanticide and its contemporary manifestation in sex-selected abortion as a result of the government's one-child policy. Presenting female infanticide as a human rather than a distinctly Chinese problem, he estimates the tragic loss of girls in the millions.
This edited volume examines the performance of physicians, psychiatrists and other scientists as expert witnesses in modern European courts of law and police investigations. Its chapters discuss ...cases from criminal, civil and international law to parse the impact of forensic evidence and expertise in different European countries (Scotland, England, Germany, Spain, Italy, Russia, Portugal, Norway and the Netherlands) in the nineteenth and twentieth centuries. They show how modern forensic science and technology was inextricably entangled with political ideology, gender norms, changes in the law and legal systems. New scientific ideas and technology, such as blood tests and DNA, helped develop forensic science, but did not necessarily lead to a straightforward acceptance of expertise in the courtroom. Discussing fascinating case studies, the chapters in this book highlight how the ideology of authoritarian and liberal regimes affected the practical enactment of forensic expertise. They also emphasise the influence of images of masculinity and femininity on the performance of experts and their assessment of evidence, victims and perpetrators, for example in cases of rape, infanticide and crimes of passion. This book is an important contribution to our knowledge of modern European forensic practices, which, as several chapters underline, sometimes surprisingly diverge from institutional regulations.
The article examines the literary representation of infanticides in Scandinavian literary texts from the 19th and 20th centuries. While most research on infanticide addresses the problematic ...situation of the mother who has killed her newborn child, the role of the father has suffered unwarranted neglect. It is therefore the purpose of this article to give an overview over central Scandinavian texts about infanticides and to investigate more deeply how the father’s responsibility or guilt is discussed. Another important aspect to examine is how questions of law and justice are thematized in the texts. It is argued that the literary texts take into account the fathers‘ (joint) guilt in the child’s death more often than commonly assumed. Likewise, the article shows that the androcentric perspective of legislation is not taken for granted, but queried. It can thus be said that the literary texts on infanticides criticize social institutions and legal norms for being ignorant to their own shortcomings.
Zusammenfassung
Neonatizide (Tötung eines Neugeborenen innerhalb der ersten 24 h) werden am ehesten von Frauen begangen, die eine erhebliche Persönlichkeitsproblematik aufweisen, ohne dass die ...Kriterien einer krankheitswertigen Persönlichkeitsstörung erfüllt sind. Diese Frauen können bei ungewünschter Schwangerschaft keine üblichen Lösungswege einschlagen und Hilfsangebote annehmen. Die Schwangerschaft wird oft noch im 1. Trimenon bemerkt, sodass ein Abbruch möglich wäre. Der Prozess einer „gesunden“ Auseinandersetzung mit der ungewollten Schwangerschaft wird an irgendeiner Stelle unterbrochen; dies bedingt das Ausmaß der Negierung der Schwangerschaft. Kommt es dann mehr oder weniger unerwartet zur Geburt, kann im Rahmen einer Stress- oder Panikreaktion bzw. aus Angst vor Entdeckung die aktive Tötung des Kindes erfolgen. In anderen Fällen verstirbt das Neugeborene durch Nichtversorgung. Daraus folgt nicht automatisch die Feststellung einer verminderten Schuldfähigkeit im Sinne der §§ 20/21 StGB.
Gegenstand der vorliegenden Arbeit ist die Reformdiskussion und Gesetzgebung zum Tatbestand der Kindestötung gemäß § 217 a.F. StGB von 1870 bis zu dessen Aufhebung durch das Sechste Gesetz zur Reform ...des Strafrechts am 1. April 1998.

Hintergrund
Neonatizid beschreibt die Tötung eines Kindes durch ein Elternteil (meist die Mutter) innerhalb von 24 Stunden nach der Geburt. Ziel der vorliegenden Arbeit ist, anhand ...psychopathologischer, psychischer, sozialer und biographischer Charakteristika der Täterinnen eine Täterinnentypologie sowie einen Vergleich zwischen alten und neuen Bundesländern zu erstellen.
Materialien und Methoden
Von 63 Täterinnen aus ganz Deutschland, die von 1986 bis 2009 mindestens einen Neonatizid begangen haben, wurden die forensisch-psychiatrischen Gutachten und die rechtskräftigen Urteile anhand eines Erhebungsbogens zu den Charakteristika der Täterinnen (Primi- vs. Pluripara, Schwangerschaftsverarbeitung, psychiatrische Diagnose, Partnerschaft, Alter) mittels Clusteranalyse ausgewertet. Abschließend wurde mittels Signifikanztests untersucht, ob sich die Häufigkeit von Neonatiziden in den alten und neuen Bundesländern signifikant voneinander unterscheiden.
Ergebnisse
Es konnten 2 Prägnanztypen extrahiert werden: Erster Tätertyp: 32 Täterinnen, Primiparen, durchschnittlich 21 Jahre alt, lebten noch bei ihren Eltern, litten an einer akuten Belastungsreaktion oder waren nicht psychisch krank, heterogenes Bild der Schwangerschaftsverarbeitung (verheimlichten oder ignorierten ihre Schwangerschaft oder nahmen sie nicht wahr). Zweiter Tätertyp: 31 Täterinnen, Pluriparen, durchschnittlich 25 Jahre alt, lebten mit ihrem Partner zusammen, litten an einer Persönlichkeitsstörung oder waren nicht psychisch krank, verheimlichten ihre Schwangerschaft. Ein Vergleich von alten mit neuen Bundesländern ergab eine statistisch signifikante, höhere Inzidenz im Osten Deutschlands.
Schlussfolgerung
Bei der Beurteilung des Ursachengefüges von Neonatiziden sollte die vorgestellte Kategorisierung der Täterinnen in zwei Gruppen, deren Charakteristika nur geringgradig überlappen, berücksichtigt werden, wobei die Typologie der Täterinnen inhomogener ist als bisher angenommen. Die dargestellte Typologie und die Kenntnis der zum Neonatizid gehörenden Bedingungskonstellation schaffen bessere Voraussetzungen dafür, Risikopersonen eher zu erkennen und präventive Maßnahmen einzuleiten.
A partir de un caso de infanticidio ocurrido en la casa de una reconocida médica y activista feminista, este artículo aborda las prescripciones vigentes sobre género, maternidad, honor y emociones en ...la Buenos Aires de principios del siglo XX. El foco está puesto en la tensión entre la figura y el discurso público de la médica, con un fuerte contenido maternalista, y su reacción ante el crimen ejecutado por quien fuera su cocinera. Se vincula dicha reacción con la compasión, entendida como parte de un lenguaje de clase, y con la posición de la médica como patrona de la infanticida.
From a case of infanticide that took place in the house of a renowned feminist doctor and activist, this article addresses the prescriptions on gender, motherhood, honor and emotions prevailing in Buenos Aires at the beginning of the 20th century. The main focus is made on the tension between the doctor's figure and public discourse, with a strong maternalistic content, and her reaction to the crime executed by her former cook. This reaction is linked both with compassion understood as a language of class, and with the position of the doctor as the infanticide's employer.
