  • The elusive notion of "peoples" in the context of post colonial self-determination claims : the case of Nagorno-Karabakh

    Self-determination in the post-colonial era is understood as a basic human right, recognised by the United Nations (UN) system, regional organizations and judicial practice. This Article tackles the ... underlying uncertainties when it comes to legal identification of a holder, i.e., "peoples", of the right of self-determination in the post-colonial context. It is suggested to interpret the term "peoples" broadly to include groups of people possessing certain common objective and subjective characteristics distinct from other groups of people within a given State. While in principle distinguishing "minorities" from "peoples", the article advances the proposition that a group of people once considered a "minority" can over time satisfy the relevant criteria of "peoples" and qualify as such. Nevertheless, any legal determination is inextricably dependent also on factual circumstances on the ground in a given time and is intrinsically intertwined with the international community`s political stance on the matter. To illustrate how those theoretical findings may be applied in practice, the article examines the self-determination claims of ethnic Armenians in Nagorno-Karabakh.
