Tulisan merupakan hasil penelitian yang bertujuan untuk : (1) menggali dan menganalisis ratio legis pembentuk undang-undang menetapkan pidana pelatihan kerja sebagai pengganti denda bagi ana, dan ...: (2) menawarkan konsep pidana pelatihan kerja sebagai pengganti denda yangberkemanfaatan dalam perspektif perlindungan anak. Untuk menjawab tujuan tyersebut, digunakan metode penelitian normatf, dengan pendekatan peraturan perundang-undangan.Hasil penelitian menunjukkan bahwa ratio legis penetapan pidana pelatihan kerja sebagai pengganti denda dalam Undang-Undang No. 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak adalah sebagai berikut: (1)( pidana denda tidak dikenakan pada anak-anak di bawah umum, karena asumsinya mereka belum bekerja. Bila denda dijatuhkan pasti yang akan membayar adalah orangtuanya. Oleh sebab itu, tidak ada pidana denda di dalam Undang-Undang ini. (2) diharapkan agar lebih baik anak sendiri bertanggung jawab terjhadap perbuatan yang dilakukannya. Oleh karena itu, mungkin karena anak tidak bisa bekerja atau tidak punya uang, harus dicari alternatif lain supaya anak merasa dia bertanggung jawab terhadap perbuatannya yaitu pelatihan kerja. Selanjutnya, konsep pidana pelatihan kerja sebagai pengganti denda bagi anak yang berkemanfaatan adalah berikut ini. (1) Pidana pelatihan kerja sebagai pengganti denda bagi anak yang diberikan harus meminta pertimbangan dari anak, pertimbangan yang diberikan anak berkaitan dengan bakat dan minat anak; (2) Pidana pelatihan kerja sebagai pengganti denda bagi anak harus memperhatikan prinsip perlindungan anak sebagaimana tertuang dalam UU Perlindungan Anak dan UU SPPA dan juga harus sesuai dengan tujuan peradilan anak. (3) Pidana pelatihan kerja sebagai pengganti denda bagi anak harus dilaksanakan oleh lembaga yang berwenang dan berkompeten sesuai dengan bakat dan minat anak sehingga memberikan manfaat bagi anak.
Tulisan ini bertujuan untuk menggali, menganalisis dan menemukan urgensi dan pola bentuk kegiatan diversi anak pada tingkat pennyidikan yang mencerminkan politik hukum UU SPPA. Tulisan ini dibuat ...berdasarkan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan perbadingan (comparative approach). Hasil penelitian menunjukkan bahwa bentuk pelaksanaan diversi di Indonesia dapat dipertimbangkan melalui pengembangan pendidikan dan pelatihan bagi anak misalnya fasilitas bagi anak untuk 4 (empat) jenis aktifitas yaitu olahraga, rekreasi, assistance programs dan kesenian. Di Indonesia, kegiatan tersebut dapat dilakukan dengan menjalin kerjasama dengan dinas sosial dan LSM. Selanjutnya kegiatan yang diberikan pada anak disesuakan dengan karakteristik daerah dan menyesuaikan bakat dan minat anak.
The Indonesian government has enacted Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering, along with its implementing regulation, Government Regulation Number 43 of ...2015 on Reporting Parties in the Prevention and Eradication of Money Laundering Crimes. This regulation designates Notaries as one of the reporting parties in Suspicious Financial Transactions related to Money Laundering (TFM), obligated to submit reports to the Financial Transaction Reports and Analysis Center (PPATK). Meanwhile, Article 16 paragraph (1) letter f of the Notary Law states that in carrying out their duties, Notaries must maintain the confidentiality of deed contents. Here, there is a contradiction between legal regulations. This study aims to examine and analyze the validity and legal consequences of the additional professional obligations for Notaries as stipulated in the Notary Law, supplemented by Government Regulation Number 43 of 2015, designating Notaries as reporting parties in TFM related to Money Laundering. The research indicates that the confidentiality duty of Notaries is not absolute; in other words, the obligation to maintain confidentiality in the Notary Law can be set aside by other laws, in this case, the Law on the Prevention and Eradication of Money Laundering through Government Regulation Number 43 of 2015, a directly authorized implementing regulation. The additional obligation as a reporting party cannot be considered a violation of the principle of notary confidentiality but rather a form of protection, with Minister of Law and Human Rights Regulation Number 9 of 2017 serving as an implementation of the prudence principle for Notaries in performing their duties. Furthermore, the legal consequences for Notaries, if they breach their duty as keepers of official secrets, may include criminal sanctions based on Article 322 of the Criminal Code and Law Number 43 of 2009 concerning Archives, civil sanctions under Article 1365 of the Civil Code, and administrative sanctions under Article 85 of the Notary Law. Additionally, if a Notary fails to report suspicious financial transactions resulting in criminal activities, the Notary faces the threat of punishment as regulated in Article 5 of the Law on the Prevention and Eradication of Money Laundering, which includes passive involvement in money laundering crimes (Article 55 of the Criminal Code) and active assistance in criminal activities (Article 56 of the Criminal Code).
The abuse of narcotics and dangerous drugs in Indonesia in recent years has become a severe problem and creates a very worrying situation. Victims of drug abuse have expanded in such a way beyond the ...boundaries of social strata, age, and gender. Drugs have penetrated not only urban areas but also rural areas and beyond national borders, which results in very detrimental consequences for individuals, society, the country, and especially the younger generation. It can even threaten the nation's life and cultural values, weakening national resilience. The law functions as the protection of human interests. For human interests to be protected, the law must be implemented.
Monopoly is regulated in the regulation of State-Owned Enterprises (SOEs) as the right to regulate (bestuur) all state resources as mandated by the constitution of Article 33 of the 1945 Constitution ...and also the BUMN Law Number 19 of 2003 where one of them is a company that is an entity a government-owned business in the form of a limited liability company. The capital is divided into wholly or at least 51 percent of the shares owned by the Republic of Indonesia with the main objective of pursuing profit. In the case of SOEs, corporate actions are determined by the direction of state policies in their economy. Problem formulation based on the above background, is monopolistic and de-monopoly practices against SOEs, inconsistency of the government? This research used normative juridical with a quantitative analytical approach and examines literature studies that conclude. The study results showed that corporate action was not doubt or inconsistency in implementing a state monopoly. However, this holding was to increase the capacity and existence of SOEs as agents of development and the state in managing resources related to many people’s lives.
This paper examines the inclusion of verbally displaying sexual acts (commonly known as catcalling) within the framework of criminal law in Indonesia. It also analyzes the legal protections afforded ...to victims of such actions under Law No 12 of 2022 concerning Crimes of Sexual Violence (TPKS Law). Verbal sexual concealment, or catcalling, involves the non-physical expression of sexual acts directed at an individual's body, sexual desires, and/or reproductive organs. This undermines the person's dignity based on their sexuality and/or modesty. Under the TPKS Law, victims of verbal sexual harassment, or catcalling, are granted specific legal protections. These include the right to be shielded from acts of violence and the right to be free from any treatment that undermines their dignity. These protective measures encompass the fulfilment of ownership and the provision of assistance to ensure the victims' sense of security. The LPSK or other relevant institutions are responsible for carrying out these protective measures by the requirements outlined in the law.

This research is a legal research using the socio-normative approach. The data used are primary data and secondary data which were analyzed using quantitative analysis. The main aspect in tackling corruption crimes is to use a law enforcement approach, one of the approaches to law enforcement is to create a Corruption Crime Court as regulated in Law No. 46 of 2009 concerning the Corruption Crime Court as an institution in charge of examining and deciding cases of criminal acts of corruption. The position of the court for criminal acts of corruption actually has a strong legal standing in the Indonesian criminal justice system, and its existence is very important and urgent in tackling corruption crimes in Indonesia. The settlement of minor offences can be pursued by penal mediation called restorative justice approach. Restorative Justice focuses on the direct participation of perpetrators, victims and the ...community by interpreting criminal acts as essentially attacks on individuals and communities as well as public relations. Justice is interpreted as the process of finding solutions to problems that occur on a minor criminal case with the involvement of victims, communities and perpetrators to be important in efforts to improve, reconcile and guarantee the continuity of the improvement efforts. In handling criminal cases, penal mediation prioritizes the interests of the perpetrators of crimes and at the same time the interests of victims, so that a win-win solution is achieved that benefits the perpetrators of crimes and their victims. In mediation penal victims are met directly with the perpetrators of crimes and can bring charges so that the peace of the parties is produced. Through mediation penal case handling process is done transparently. This research is normative juridical law research intended to review the settlement arrangements of minor crimes by applying restorative justice.
Restorative justice is a preventive response to understanding crime in a social context. It is a challenge to unearth the roots of offence and crime to be able to break the cycle. This restorative ...justice is based on the assumption that the crime originated in a social situation and recognizes that the perpetrator of the crime has also been injured. Therefore, the community must take over the responsibility to improve the condition that has triggered the onset of evil and also work to cure it. International developments in the concept of criminal justice and procedures for handling criminal cases in several countries have been known penal mediation (penal mediation, mediation penal, mediation in criminal matters, Victim - Offender Mediation) which is part of the criminal justice system. Mediation, previously known only in civil law, has been frequently used in some countries to resolve criminal cases. Penal mediation is a manifestation of the concept of restorative justice, which seeks to restore the rights of victims. Thus, restorative justice is based on holistic philosophy. The application of holistic thinking can help strengthen the capacity of the existing justice system. The main challenge in its application in the modern world is how to promote community participation, and at the same time protect the rights and interests of victims and perpetrators who commit offenders. This legal research is normative juridical research, through statute approach, conceptual approach, so that it can get a comprehensive understanding of the construction of criminal case resolution law through penal mediation in the perspective of Restorative Justice.
This diversion is the process of resolving cases of violations of law that occur, namely by bringing together the victims and their families and the perpetrators as well as their families to sit ...together to discuss the settlement of cases in a family manner. Legislation on the juvenile justice system. To answer the purpose of the paper, normative legal research is used, using a legal approach used to examine the Child Criminal Justice System Act, while the case approach uses the determination of judges in the case of Children. The results of the study indicate that the juridical implication of the judges’ determination regarding diversion which violates the provisions of the law on juvenile criminal justice systems is that they can be canceled, which can still be carried out as long as no party submits a cancellation. This diversion effort is a manifestation of restorative justice which aims to avoid children from the judicial process. So when the diversion is successfully carried out and an agreement arises, it means that the goal of restorative justice has been achieved.
