The decision by the International Olympic Committee to grant the 2008 Olympic Games to the People's Republic of China is recognition of the considerable development of the Asian sports industry. The ...occasion gives rise to an opportunity to examine a factor, often overlooked, that will contribute to the quality of the Games and the long-term viability of the sports industry in Asia: sports law. It is quite easy to imagine the Olympic Games as a series of physical contests involving individuals or groups of individuals competing for victory in accordance with specific rules. While this may be understood as the essence of sport, we must turn to a study of the law of sports to comprehend the efficacy of the institutional structure that protects and promotes the spirit of competition, the fairness of the game and a multi-billion dollar entertainment industry.
The current system for the protection of trademarks through the domain name registration system in the People's Republic of China is not operating effectively. A number of disputes have recently ...arisen concerning domain name applicants who have succeeded in registering trademarks without the authorisation of the legitimate owner for their own commercial purposes. The development of the internet, to an appreciable extent, depends upon firms, organisations and persons being able to promote their authentic name through an internet website and computer users being able to link reliably to that website. Although the overall growth of the internet in China has been considerable, participation by foreign and domestic companies has noticeably lagged. The uncertain legal protection of a firm's trademark helps explain some of the resistance to further investment in China's digital market.
