By critically engaging with the practical and ethical implications of philosophical hermeneutics, Davey asserts that the importance of philosophical hermeneutics resides in a formidable double claim that strikes at the heart of both traditional philosophy and deconstruction. He shows that to seek control over the fluid nature of linguistic meaning with rigid conceptual regimes or to despair of such fluidity because it frustrates hope for stable meaning is to succumb to nihilism. Both are indicative of a failure to appreciate that understanding depends upon the vital instability of the "word." This innovative book demonstrates that Gadamer's thought merits a radical reappraisal and that it is more provocative than commonly supposed.
This book, first published in 2005, offers a radical challenge to accounts of the common law's development. Contrary to received jurisprudential wisdom, it maintains there is no grand theory which ...will explain satisfactorily the dynamic interactions of change and stability in the common law's history. Offering original readings of Charles Darwin's and Hans-Georg Gadamer's works, the book shows that law is a rhetorical activity that can only be properly appreciated in its historical and political context; tradition and transformation are locked in a mutually reinforcing but thoroughly contingent embrace. In contrast to the dewy-eyed offerings of much contemporary work, it demonstrates that, like life, law is an organic process (i.e., events are the products of functional and localized causes) rather than a miraculous one (i.e., events are the result of some grand plan or intervention). In short, common law is a perpetual work-in-progress - evanescent, dynamic, messy, productive, tantalising, and bottom-up.

Se exponen en estas breves líneas algunas ideas de Hans-Georg Gadamer en torno al leguaje y su articulación en el diálogo. Para el autor alemán, el lenguaje que se construye en una situación de ...diálogo da lugar al entendimiento entre personas creando un lenguaje común y, viceversa. El lenguaje se da en el diálogo que existe en la conversación, es ahí donde se realiza plenamente 'el comprender' das Verstehen. La incapacidad objetiva derivada de la inexistencia de un lenguaje común se traduce en lo que Gadamer ha llamado la <<incapacidad de diálogo>>. La 'palabra' Wort es, a la conversación, lo que es la compresión para el diálogo. Se concluye que para ser capaz de conversar hay que saber escuchar, este es el verdadero espíritu Geist del diálogo, reconocer que el camino de la verdad es el camino de la conversación y que <<comprensión>> es esencialmente <<diálogo>> hermenêutico. For the German author, language that is constructed into a situation of dialogue leads to understanding between people creating a common language and, vice versa. Language is given in dialogue that exists in conversation, that is where 'comprehension' is fully achieved das Verstehen. The objective incapacity derived from the non-existence of a common language implies what Gadamer has called the "inability to dialogue". 'Word' Wort is to conversation, what compression is to dialogue. It is concluded that in order to be able to talk, one must be able to listen, this is the true spirit Geist of dialogue, to recognize that the path of truth is the path of conversation and that "comprehension" is essentially hermeneutical "dialogue". Este artículo desarrolla algunos elementos hermenéutico-dialógicos de la pedagogía hermenéutica aplicada a la "formación universitaria" para una educación eco-relacional, pues donde hay relaciones, ...hay contradicciones; donde hay contradicciones, hay contexto; donde hay contexto; hay diálogo; donde hay diálogo, hay educación; donde hay educación, hay historia que interpretar; donde hay historia, hay aprendizaje y comprensión. Nos aproximamos a la formación universitaria desde la hermenéutica filosófica gadameriana para asumir al diálogo como fuente permanente de humanización, de superación de diferencias y de aproximación a la verdad, desde el cual proponemos un modelo dialógico eco-relacional cuyo eje es el lenguaje para la comprensión interhumana de una educación humanizadora fruto del cruce entre los elementos teóricos provenientes la hermenéutica filosófica, de las pedagogías críticas y de los requerimientos de la formación universitaria como comunidad de sentido.
Los trabajos sobre la comprensión e interpretación del texto y su significado continúan siendo temas de gran relevancia en una amplia gama de disciplinas como la filosofía, la literatura, la ...lingüística, la historia y la psicología. En el ámbito de la filosofía, el texto se convierte en un espacio ideal para la reflexión gracias a su capacidad para revelar ideas, valores y experiencias humanas. La hermenéutica se dedica al estudio del texto como objeto principal, pero sus aplicaciones se extienden a otras áreas como la filosofía del lenguaje, la antropología, la ontología, la teoría del conocimiento y la epistemología. Este trabajo tiene como objetivo analizar y comparar los planteamientos de Gadamer y Lotman sobre el texto, con el fin de establecer un diálogo hermenéutico que nos permita comprender mejor su concepción sobre este importante tema. Este análisis se aborda desde una metodología cualitativa, utilizando el método hermenéutico, concluyendo que este se centra en la interacción entre el texto, contexto y el lector. Para Gadamer, esta interacción es un diálogo entre dos horizontes de mundo: el del autor y el del lector. La fusión de horizontes permite una comprensión profunda del texto y su contexto histórico. Por su parte, Lotman define el texto como un sistema complejo con múltiples niveles de significado. Esta polisemia invita al lector a participar activamente en la construcción del significado, aportando su propia experiencia. En esta perspectiva, se evidencia una relación entre el concepto de texto-semiosfera propuesto por Lotman y la hermenéutica filosófica de Gadamer; ambas áreas de estudio se centran en la interpretación de símbolos y signos, así como en la elaboración de significado mediante la interacción entre el individuo y su entorno. Work on the understanding and interpretation of text and its meaning continues to be highly relevant topics in a wide range of disciplines, such as philosophy, literature, linguistics, history and psychology. In the field of philosophy, the text becomes an ideal space for reflection due to its ability to reveal ideas, values and human experiences. Hermeneutics is dedicated to the study of the text as the main object, but its applications extend to other areas such as the philosophy of language, anthropology, ontology, the theory of knowledge and epistemology. This work aims to analyze and compare the approaches of Gadamer and Lotman on the text, in order to establish a hermeneutical dialogue that allows us to better understand their conception on this important topic. The research is approached from a qualitative methodology, using the hermeneutic method. It is concluded that the hermeneutics of the text focuses on the interaction between the text, context and the reader. For Gadamer, this interaction is a dialogue between two world horizons: that of the author and that of the reader. The fusion of horizons allows a deep understanding of the text and its historical context. For his part, Lotman defines the text as a complex system with multiple levels of meaning. This polysemy invites the reader to actively participate in the construction of meaning, contributing their own perspective and experience. In this perspective, a relationship is evident between the concept of text-semiosphere proposed by Lotman and Gadamer's philosophical hermeneutics. Both areas of study focus on the interpretation of symbols and signs, as well as the creation of meaning through the interaction between the individual and their environment. The philosophy of Hans-Georg Gadamer interests a wide audience that spans the traditional distinction between European (continental) and Anglo-American (analytic) philosophy. Yet one of the most ...important and complex aspects of his work - his engagement with German Idealism - has received comparatively little attention. In this book, Kristin Gjesdal uses a close analysis and critical investigation of Gadamer's Truth and Method (1960) to show that his engagement with Kant, Hegel, and Schleiermacher is integral to his conception of hermeneutics. She argues that a failure to engage with this aspect of Gadamer's philosophy leads to a misunderstanding of the most pressing problem of post-Heideggerian hermeneutics: the tension between the commitment to the self-criticism of reason, on the one hand, and the turn towards the meaning-constituting authority of tradition, on the other. Her study provides an illuminating assessment of both the merits and the limitations of Gadamer's thought.
