When the regime led by Slobodan Milošević came to an end in October 2000, expectations for social transformation in Serbia and the rest of the Balkans were high. The international community declared ...that an era of human rights had begun, while domestic actors hoped that the conditions that had made a violent dictatorship possible could be eliminated. More than a decade after the International Criminal Tribunal for the Former Yugoslavia initiated the process of bringing violators of international humanitarian law to justice, significant legal precedents and facts have been established, yet considerable gaps in the historical record, along with denial and disagreements, continue to exist in the public memory of the Yugoslav wars.
Guilt, Responsibility, and Denialsets out to trace the political, social, and moral challenges that Serbia faced from 2000 onward, offering an empirically rich and theoretically broad account of what was demanded of the country's citizens as well its political leadership-and how these challenges were alternately confronted and ignored. Eric Gordy makes extensive use of Serbian media to capture the internal debate surrounding the legacy of the country's war crimes, providing one of the first studies to examine international institutional efforts to build a set of public memories alongside domestic Serbian political reaction. By combining news accounts, courtroom transcripts, online discussions, and his own field research, Gordy explores how the conflicts and crimes that were committed under Milošević came to be understood by the people of Serbia and, more broadly, how projects of transitional justice affect the ways society faces issues of guilt and responsibility. International Criminal Law seeks to avoid impunity regarding the most grave and atrocious conducts that threaten the peace, the security, and the well-being of the world . These conducts, known as ...the core crimes of international law, refer to war crimes, crimes against humanity, genocide and aggression.
Neither the Charter of Nuremberg, nor the Charter of Tokyo, the Statute of the International Tribunal for the former Yugoslavia, or the Rome Statute of the International Criminal Court, establish terrorism as a crime of their jurisdiction; it is not either established as a crime of international law in the Nuremberg Principles. Only the Statute of the International Tribunal for Rwanda establishes in its article 4 the act of terrorism as a crime of its competence. Through a process of research and analysis of treaties, customs and international law, it is alleged that acts of terrorism occurred during the first half of the 20th century; the treatment that international criminal law gave (Nuremberg, Tokyo) and gives (International Criminal Court, International Criminal Tribunal for the former Yugoslavia and International Criminal Tribunal for Rwanda) to those cases is described as well. Allegedly, terrorism is not alien to International Criminal Law, neither from a factual perspective nor from a legal one. Whether its regulation as an autonomous crime of international law is necessary or not is a discussion that goes beyond the purpose of this paper directed exclusively to evidence the relation between terrorism and International Criminal Law from a factual perspective and a legal one as well. This is done with the starting point of the identification of facts that constituted terrorism, in a specific historical context, and the legal response given by the international society, through the International Criminal Tribunals.
Le droit pénal international s emploie à éviter l impunité des conduites les plus graves et les plus atroces qui « menacent la paix, la sécurité et le bien-être du monde ». Ces conduites, connues comme des crimes fondamentaux en droit international, sont les crimes de guerre, les crimes contre l humanité, le génocide et l agression. Ni la Charte de Nüremberg, ni la Charte de Tokyo, ni le Statut du Tribunal International pour l ex-Yougoslavie, ni le Statut de Rome de la Cour Pénale Internationale n établissent le terrorisme comme un crime relevant de leur juridiction; il n est pas non plus établi comme un crime de droit international dans les Principes de Nüremberg. Seul le Statut du Tribunal International pour le Rwanda établit dans son article 4 les « actes de terrorisme » comme étant des crimes relevant de sa compétence. À travers le développement des recherches et des analyses sur les traités, la coutume et la loi internationale, il peut être relevé que des actes de terrorisme se seraient produits au cours de la première moitié du 20ème siècle; le traitement que le droit pénal international lui offrit (Nüremberg, Tokyo) et lui offre (Cour Pénale Internationale, Tribunal Pénal International pour l ex-Yougoslavie et Tribunal Pénal International pour le Rwanda) y est également retranscrit. On ne peut ainsi prétendre, ni en fait, ni en droit, que le terrorisme est étranger au Droit Pénal International. Si sa réglementation en tant que crime autonome du droit international est ou non nécessaire, il s agit là d une discussion qui dépasse le but de cet article qui, lui, propose exclusivement de démontrer la relation entre terrorisme et Droit Pénal International dans une perspective pratique mais également juridique; ce, en partant de l identification des faits constituant le terrorisme, dans un contexte historique
spécifique, et de la réponse juridique apportée par la société internationale par l intermédiaire des juridictions pénales internationales.
El Derecho Penal Internacional busca evitar la impunidad frente a las conductas más graves y atroces que atentan contra la paz, la seguridad y el bienestar de la humanidad. Estas conductas, conocidas como los crímenes centrales del derecho internacional, son las constitutivas de crímenes de guerra, lesa humanidad, genocidio y agresión. Ni en la Carta del Tribunal de Nüremberg, en el de Tokio, en el Estatuto del Tribunal Penal Internacional para la antigua Yugoslavia o en el Estatuto de Roma de la Corte Penal Internacional, se establece el terrorismo como un crimen de la competencia de estos tribunales; tampoco se consagra como un crimen de derecho internacional en los Principios de Nüremberg. Únicamente el Estatuto del Tribunal Penal Internacional para Ruanda, consagra en su artículo 4, los actos de terrorismo como un crimen de su competencia. A través de un proceso de investigación y análisis de tratados, costumbres y jurisprudencia internacional, se logran identificar conductas constitutivas de terrorismo en la primera mitad del siglo XX y se describe el tratamiento penal internacional que a través de instrumentos y decisiones se dio a esas conductas; igualmente, se analiza esta figura a la luz del Estatuto de Roma, sin desconocer el tratamiento que los Tribunales Penales ad hoc del Consejo de Seguridad de la ONU le han dado. Así, se concluye que el Derecho Penal Internacional no es ajeno al terrorismo ni desde el punto de vista fáctico ni jurídico, contemplando en algunos instrumentos expresamente al terrorismo como un crimen de derecho internacional, y subsumiendo, en otros casos, el terrorismo dentro de alguna de las categorías constitutivas de dichos crímenes. Si es necesaria o no su tipificación como un crimen autónomo del derecho internacional es una discusión que trasciende el objeto de este artículo encaminado exclusivamente a evidenciar la relación del terrorismo con el Derecho Penal Internacional desde un punto de vista fáctico así como jurídico a partir de la identificación de situaciones constitutivas de actos terroristas en un periodo histórico específico y de la respuesta jurídica dada por la sociedad internacional a través de los Tribunales Penales Internacionales.

Elle permet d'évaluer le capital, la hiérarchisation thématique et la distribution en domaines scéniques de l'événement mettant en évidence les lois qui régissent la couverture de l'événement : proximité, spectacularité, partage de la compassion.
THE THEMATIC CONSTRUCTION OF THE CONFLICT IN THE FORMER YUGOSLAVIA BY FRENCH TELEVISION NEWS (1990-1994) The first quantitative analysis, based upon five years, of the French networks' treatment of the conflict in the former Yugoslavia has been conducted in the archives of Inathèque. It allows us to evaluate the capital, the thematic hierarchization, and the distribution of the event into scenic domains, thus demonstrating the laws that regulate news coverage : proximity, fascination with the spectacular, and the distribution of compassion.
LA « LIMPIEZA ÉTNICA » EN LA PRENSA. LLEGADA Y PROPAGACIÓN DE UNA FORMULA La expresión « limpieza étnica » apareció durante el discurso de prensa en el verano 1992. Analizando la utilización de esta ...expresión en un corpus de prensa, se observa : por una parte, que la « limpieza étnica » constituyá una palabra-acontecimiento, es decir un acontecimiento en el mundo de los objectos lenguajenos ; por otra parte, que constituye una palabra-atractiva, es decir una categoría nueva disponible para la descripción del mundo.
LA « PURIFICATION ETHNIQUE » DANS LA PRESSE. AVÈNEMENT ET PROPAGATION D'UNE FORMULE L'expression « purification ethnique » est apparue dans le discours de presse à l'été 1992. En analysant la mise en œuvre de cette expression dans un corpus de presse, on observe, d'une part, que la « purificiation ethnique » a constitué un mot-évènement, c'est-à-dire un événement dans le monde des objets langagiers, d'autre part, qu'elle constitue un mot-attracteur, c'est-à-dire une catégorie nouvelle disponible pour la description du monde.
«ETHNIC CLEANSING» IN THE PRESS. THE APPEARANCE AND PROPAGATION OF A FORMULA The expression « ethnic cleansing » appeared in the press during the summer of 1992. In analyzing the use of this expression in a corpus of press articles, one observes two main features : on the one hand, this phrase constituted a word-event, i.e., an event in the world of linguistic objects ; on the other, it constituted an attractor-word, i.e. a new category for describing the world.
