As normas para a resolução de disputas se desenvolveram junto com a comunicação humana, literalmente milhares de anos antes da internet. A mediação surgiu como um sistema social que detém normas ...específicas de cada cultura e regras que as expressam. Até hoje, a mediação opera como um sistema de significados profundamente humano. Este artigo analisa se tais normas específicas para a mediação, testadas e refinadas com o tempo, serão transferidas, relativamente intactas, para o ambiente virtual. Para isso, será analisado como os designers constroem e implementam os ambientes virtuais e sua decorrente automatização tecnológica. Contudo, para realizar isso da melhor maneira os designers devem, em primeiro lugar, identificar, entender e respeitar os valores, a ética e o propósito implícitos nessas normas intergeracionais.
Mediation is one of the Alternative Dispute Resolution (ADR) that emphasises a mutually agreeable resolution and incorporates a win-win situation between parties. Mediation is not a rare concept in ...Indonesia and Malaysia. People in Indonesia and Malaysia have long used mediation in their daily lives as mediation has been proven to be effective since long ago. Due to its extensive use in Indonesia and Malaysia, a comprehensive study was carried out by the researcher to identify the comparison of mediation in Indonesia and Malaysia. In this paper, the researcher will review the practice of mediation in Indonesia and Malaysia via a comparison analysis where the researcher employs a qualitative approach via library-based research. Many reference sources and reading materials have been used by researchers to see similarities and differences between these two countries. The result of this study affirms that mediation practices in Indonesia and Malaysia are quite similar, despite being governed under a different law and regulations. In addition to having many similarities, one of the things that attracted the researcher's attention is that both countries have their challenges in carrying out mediation. Therefore, this aspect of the challenge also needs to be touched upon so that mediation can be conducted in both countries smoothly. It is also hoped that with this study, in the future, this study can also be used as a guide or manual in discussing mediation for both countries.
Violence against women is characterised by its universality, the multiplicity of its forms, and the intersectionality of diverse kinds of discrimination against women. Great emphasis in legal ...analysis has been placed on sex-based discrimination; however, in investigations of violence, one aspect has been overlooked: violence may severely affect women's health and access to reproductive health, and State health policies might be a cause of violence against women. Exploring the relationship between violence against women and women's rights to health and reproductive health, Sara De Vido theorises the new concept of violence against women's health in international law using the Hippocratic paradigm, enriching human rights-based approaches to women's autonomy and reflecting on the pervasiveness of patterns of discrimination. At the core of the book are two dimensions of violence: horizontal 'inter-personal', and vertical 'state policies'. Investigating these dimensions through decisions made by domestic, regional and international judicial or quasi-judicial bodies, De Vido reconceptualises States' obligations and eventually asks whether international law itself is the ultimate cause of violence against women's health.
The normal functioning of the justice system existing in the state, which should ensure the satisfaction of the private interests of the sub- jects of law, should be evaluated as an expression of ...public and private interests. After all, the well-being of the subjects of law is significantly determined by the existence of a flexible dispute resolution system and mechanisms, the correct formation and implementation of which guarantees the stability of the civil turnover and the satisfaction of the interests of legal subjects. Despite the importance of the issue, ensuring that the legal subjects are offered fast and affordable forms of dis- puteresolution, remains to be a challenge. Achieving the mentioned goal becomes more difficult, when the dispute is loaded with international private law elements, is characterized by complexity in this way and its resolution is connected with a number of peculiarities. That is why, on the one hand, it is considered important to make changes in the law of Georgia “On Private International Law”, which will eliminate the risks of its misinterpretation. On the other hand, it is important to emphasize the role and importance of mediation in the process of resolving international private law disputes. Accordingly, following the legislative amendments, it is also considered important to raise public awareness in this direction and improve legal culture. The above-mentioned, significantly helps the formation of a chain of effective means of dispute resolution, where, on the other hand, an important place shall be given to the form of remote proceedings.

This open access book introduces adaptive mediation as an alternative approach that enables mediators to go beyond liberal peace mediation, or other determined-design models of mediation, in the ...context of contemporary conflict resolution and peace-making initiatives. Adaptive mediation is grounded in complexity theory, and is specifically designed to cope with highly dynamic conflict situations characterized by uncertainty and a lack of predictability. It is also a facilitated mediation process whereby the content of agreements emerges from the parties to the conflict themselves, informed by the context within which the conflict is situated. This book presents the core principles and practices of adaptive mediation in conjunction with empirical evidence from four diverse case studies – Colombia, Mozambique, The Philippines, and Syria – with a view to generate recommendations for how mediators can apply adaptive mediation approaches to resolve and transform contemporary and future armed conflicts.
