Background: One of the most important features of international commercial arbitration is the autonomy of the will of the parties to a foreign economic dispute. Such autonomy consists of the ...possibility of independence to resolve issues of a dispute between the parties to such a contract and those issues that already arise during arbitration proceedings. One of the most significant issues that are the subject of autonomy of the will is the choice of the rules of procedural law. In this note, we studied the procedural rules governing the activities of international commercial arbitration, which influence the course of arbitration proceedings, since the arbitral tribunal usually refers to them when determining the number of key issues, starting with questions about whether to refer the dispute to arbitration or not, whether to determine interim measures and also with respect to the arbitral award itself.
Methods: This study was based on an analysis of Ukraine’s national law and some doctrine; examples of implementation of the New York convention were analysed.
Results and Conclusions: Although the parties’ freedom of choice is a generally accepted principle of international commercial arbitration, it can usually be limited by the imperative norms and public order of a particular country. The trend of moving the international arbitration practice away from using lex loci arbitri was underlined. This trend reflects the avonomy of the parties and can also be considered a significant challenge of lex loci arbitri.
The author analyzes various applications of the UNIDROIT Principles of International Commercial Contracts in the context of international commercial arbitration proceedings. In particular, the ...article provides a detailed overview of the situations in which the UNIDROIT Principles can be applied by arbitral tribunals proprio motu (when, for example, a choice of law clause mentions lex mercatoria or when the parties cannot agree on the applicable law). Additionally, the article considers the risks of annulment or refusal of recognition and enforcement of an arbitral award rendered on the basis of the UNIDROIT Principles.
Determining the law applicable to arbitrability is of paramount importance because the procedures taken by the legal system are very different. In this way, some systems principally recognize any ...disputes eligible for referral to arbitration, while some other legal systems have put an emphasis on the general inapplicability of arbitrability to the disputes and only accepts it in a few exceptional cases. The remainder of legal systems have taken a position in the middle of these two theories. Therefore, it is clear that determining the applicable and governing law can also pinpoint the ultimate arbitrability (or not) of the case. The main challenge of this research is to examine the law governing the practice of arbitration and how proceeds the arbitrability at the courts of arbitration. At the end of this study, it will be known that there are several criteria for determining the law governing arbitrability, including the lex fori, the law of the parties’ agreement, the law of the place of enforcement of the award, and the law of one or both of the parties. By the way, today transnational law principles seems to gain more importance. Each of these criteria has its own advantages and disadvantages. Moreover, the norms of human rights have also led to developments in the recognition and enforcement of foreign arbitration awards, in such a way that the tenets of human rights (in the domain of the recognition and enforcement of foreign arbitration awards) have also led governments to recognize acquired rights in foreign countries.
The article is of a scientific research nature and its main goal is to determine the legal nature, sources of regulation and key features of the law, governing the procedure in international ...commercial arbitration. The issue is analyzed through investigation of relevant provisions of international documents, national laws on arbitration and arbitration rules of leading permanent institutions. It is established that under the applicable procedural law it is possible to understand a single legal system only within a certain context, in particular, when referring to procedural rules of lex arbitri. Authors also substantiate the position according to which in the most general sense, the law applicable to the arbitration process should be understood as chosen by the parties or determined by the arbitral tribunal or by other authorized body procedural law of a state, with its own legal nature and instrumental purpose, which is usually the law of the place of arbitration (lex arbitri); and rules of procedure agreed by the parties by specifying the arbitration rules of a particular institutional arbitration or other similar rules in the arbitration clause.
