The purpose of the article is to reflect on the question to what extent a situation may arise in which codes of ethics are not needed or even inappropriately applied. The possible advantages of codes ...of ethics are relatively well known, and there is ample literature on them. Literature on the conditions for the adoption of ethical codes is also quite common. There are far fewer articles about the uselessness of ethical codes in a certain context of reality. Even less is said about the detrimental consequences of the use of codes of ethics in their partial use. Our contribution is an attempt to show in what situations a code of ethics can act as a useless institution with no real influence, and also that certain elements of a code of ethics can lead to detrimental consequences if they are adopted and implemented.
Australia II became the first foreign yacht to win the America's Cup in 1983. The boat had a revolutionary wing keel and a better underwater hull form. In official documents, Ben Lexcen is credited ...with the design. He is also listed as the sole inventor of the wing keel in a patent application submitted on February 5, 1982. However, as reported in
New York Times
,
Sydney Morning Herald
, and
Professional Boatbuilder
, the wing keel was in fact designed by engineer Peter van Oossanen at the Netherlands Ship Model Basin in Wageningen, assisted by Dr. Joop Slooff at the National Aerospace Laboratory in Amsterdam. Based on telexes, letters, drawings, and other documents preserved in his personal archive, this paper presents van Oossanen’s account of how the revolutionary wing keel was designed. This is followed by an ethical analysis by Martin Peterson, in which he applies the American NSPE and Dutch KIVI codes of ethics to the information provided by van Oossanen. The NSPE and KIVI codes give conflicting advice about the case, and it is not obvious which document is most relevant. This impasse is resolved by applying a method of applied ethics in which similarity-based reasoning is extended to cases that are not fully similar. The key idea, presented in Peterson’s book
The Ethics of Technology
(Peterson, The ethics of technology: A geometric analysis of five moral principles, Oxford University Press, 2017), is to use moral paradigm cases as reference points for constructing a “moral map”.
This research was conducted with the aim of knowing how the position of the mediator as an independent party in case dispute resolution and how the urgency of the mediator's code of ethics in ...violating the code of ethics. This research uses normative juridical research methods. the position of the mediator has an important role as a neutral party in charge of facilitating dialog between the parties to the dispute. and the Mediator's Code of Ethics has great urgency in the context of dispute resolution as an independent third party. By ensuring that mediators operate with integrity and neutrality, the Code forms the basis for ethical behaviour that supports a fair mediation process. The existence of this independent third party is critical in creating an environment that allows disputants to communicate openly and honestly. The Code of Ethics ensures that the mediator carries out his or her role with fairness, keeps information confidential and avoids conflicts of interest. With the Code of Ethics, the mediator not only acts as a facilitator but also as a holder of high standards in ensuring fairness and openness in dispute resolution. The Mediator Code of Conduct therefore plays a crucial role in upholding ethical norms that ensure trust and success of the mediation process.
The ANA Code of Ethics for Nurses, regularly revised since 1896, may not provide guidance in an era of pandemic and sociopolitical unrest.
This study explored whether the Code of Ethics ...comprehensively address current nursing challenges.
23 nurses participated in six Zoom focus groups to discuss whether provisions were applicable to their current practice. An iterative approach was used to review transcripts independently and then merge findings to identify ethical themes.
Provisions 4, 6, and 8 were most relevant. None of the provisions addressed the guilt secondary to isolating patients from support systems and not being “on the front lines” of COVID care.
The co-occurring crises of COVID-19 and social unrest created an ethical crisis for many nurses. The Code of Ethics provided a useful guide for framing discussion and formulating strategies for change, but did not eliminate distress during a time of novel challenges.
In recent years, attention to sustainability and corporate ethics has grown considerably. This highlights ethical codes as tools to promote ethical and honest actions and create greater motivation ...among employees. Ethical codes help implement organisational control by allowing companies to represent both belief and boundary systems. Despite the global relevance of ethics, the drafting processes, and the contents of ethical codes differ considerably between countries. This circumstance makes interesting the analysis of the influence of national culture on the quality of the code of ethics, still little explored in the literature. This study aims to fill this gap by analysing the impact of Hofstede's dimensions, as an expression of national culture, on quality of the code of ethics, from an organisational control perspective. Our analysis, of 191 international companies belonging to 29 different countries and five continents, shows that the quality of the ethical codes is related to five of Hofstede's six dimensions. This study enriches the literature by extending the field of antecedents of the quality of the code of ethics, which before this research included analyses only on internal determinants.
This study examines the Canadian Code of Ethics for Registered Nurses as a discursive mechanism for shaping nurses' professional identity using a Foucauldian lens. Nurses are considered essential in ...healthcare, yet the nursing profession has struggled to be recognized for its discipline‐specific knowledge and expertise and, as such, has remained the subject of and subject to the dominant discourses within healthcare and society generally. Developing a professional identity in nursing begins after the necessary education and training are achieved and embodies the profession's history, values, code of ethics, and expectations of the profession that distinguish it from other professions. Since nurses' professional identity is shaped through discourse, it raises the question of whether there are spaces to reconceptualize nurses' subject position within health care. Since professional identity is considered the embodiment of knowledge and practice, the code of ethics bears examination both for its effect on nurses' professional identity and as a potential site from which to challenge hegemonic assumptions. This article discusses the concept of professional identity in nursing and its development through the discursive formations in the code of ethics. The sources of power/knowledge are examined as both mechanisms of control and as spaces for change.
Objective
To appraise the evolution of the RANZCP’s Code of Ethics on the occasion of its 30th anniversary.
Method
We scrutinised its five editions, focussing on the revision procedure and changes ...made, and reviewed relevant literature.
Results
The procedure of revision has remained constant: incorporating feedback from college members, committees and faculties, and consulting professional medical bodies and mental health advocacy organisations. Seven major themes of change have emerged with respect to patient exploitation, recognition of family and carers, the special place of Indigenous Peoples, confidentiality, engaging patients in decision-making, multidisciplinary collaboration and the well-being of psychiatrists.
Conclusions
The code has proved to be a dynamic instrument in keeping abreast of changes in psychiatry and society, and promises to maintain a prominent role in promoting high ethical standards in the profession.
Violation of the law which includes ethical violations is actually an act contrary to the ethical rules of regulations for members of political parties. Still, these violations indicate an increase ...in public officials from political parties. As such, it is interesting to research how to determine the model of the code of ethics for members of political parties. It includes members of political parties who are involved as well as public officials. The type of research used in this article is normative-empirical with a statutory approach and is supported by field research. The data obtained were then analyzed qualitatively. The results of the research and discussion show that the enforcement of the code of ethics and party discipline is carried out through prevention and prosecution efforts. Prevention efforts are carried out through continuous guidance for ordinary members, members, and party cadres by the party honors division at each level of the party leadership council. Meanwhile, efforts to take action are carried out by the party ethics and disciplinary committee formed by the DPP, which is tasked with examining and proving any alleged violations of the party's code of ethics and discipline by party members. The party ethics and disciplinary committee is authorized to examine and provide recommendations on whether party members are guilty of violating the code of ethics and/or party discipline on the basis of reports, complaints, or information.
