    The purpose of the present study is to draw a comparative analysis between Kosovo and Albania in terms of existence of provisions for human rights protection enshrined in respective criminal codes of ... both countries. Kosovo has gone a long way in creating its legislation, especially the criminal justice system. It has been worked on the harmonization of legislation with that of the European Union and then it is aimed at achieving its harmonization. These are legal prerequisites in the path of European Integration that our country must necessarily pursue. In 2012, the Criminal Code was adopted, which entered into force on 1 January 2013 and was also worked on the Code of Criminal Procedure. Thus, the legal basis for criminal justice has been established. The new penal legislation foresees many new institutions, new incriminations, punishment of punitive politics and other innovations. On the other hand, Albania also faces a violation of human rights. Although many legal provisions have been adopted, international acts have been ratified, there are still many problems, deficiencies and needs in this sector as well. Despite the above achievements, there are still many violations of human rights, which are in most cases caused by the public administration. The methodology used in the present research is a qualitative one. The research instrument is observation and comparison of laws and other documentary evidence, and also qualitative interviews with legal experts of both respective countries regarding the extent of implementation of the human rights protection provisions enshrined in criminal legislation of Kosovo and Albania. The findings of the present research are that human rights protection mechanisms although enshrined in the criminal legislation of Kosovo and Albania are not implemented to the extent as in other EU countries and that still remains to be done in order to achieve EU standards with regards to implementation of human rights mechanisms enshrined in criminal legislation of both countries. Nevertheless, the present study finds that there are slight differences between Kosovo and Albania in terms of implementation of human rights protection mechanisms. The study has great implications for policy makers and relevant authorities in Kosovo and Albania such as Kosovo Judicial Council to instill better mechanisms in the implementation of criminal legislation so the human rights protection mechanisms are enforced properly.
