    The author describes basic features of the producer's liability for damage arising from defec-tive products according to the Directive 95/374/EEC. He presents the recent case law of the European ... Court of Justice concerning the directive and its impact on national law. The liability of producers in the Slovenian law is subject to two different regulations without delimitation: Articles 1 and 4-1 la Consumer Protection Act and Article 155 of the Obligations Code. Ac-cording to the European Court of Justice the Directive aims at complete harmonisation, there-fore preventing member states from keeping or introducing a higher level of consumer protec-tion. Above all, the author critically evaluates the idea of exhaustive regulation brought about by the Directive. The basic effect of the Directive and the case law on the Slovenian law is the prohibition of the application of Article 155 of the Obligations Code, according to which the wronged party is in a much better position than according to the Directive and the measure of its implementation- the Consumer Protection Act. To this extend the European tort law super-sedes national law.
