Histoire du droit pénal romain : de Romulus à JustinienJamais les Romains n'ont employé de formule pour désigner ce que nous appelons le ' droit pénal '. Devrait-on penser pour autant avec Theodor Mommsen que ' le droit pénal romain n'ayant jamais ... formé un tout, il ne peut être question d'en retracer l'histoire ' ? Non, précisément, car l'histoire ne saurait supposer un système doctrinal qui en déterminerait l'objet comme un tout. Depuis la fondation de Rome attribuée à Romulus (en 753 av. J.-C.) jusqu'à l'effort de reconquête mené par l'empereur byzantin Justinien (527-565 ap. J.-C.), des institutions et des normes relatives à la répression des crimes n'ont cessé d'être produites. À l'origine, un' droit de vie et de mort ' qualifie la place du père dans la famille, comme celle du magistrat dans la cité. Naît ensuite la ' République ' ou l'avènement de la libertas, c'est-à-dire essentiellement la protection du citoyen face à l'arbitraire du magistrat. Cinq siècles plus tard et au terme de longues guerres civiles, l'autocratie impériale se substitue à la ' liberté ': tout crime peut être désormais considéré comme une atteinte à la ' majesté du prince '; seul l'empereur peut décider de ' l'indulgence ' effaçant une peine ou recevoir l'"appel" d'un condamné.
