    The article presents the key dilemmas appearing in the new European research and innovation policy. The author tries to give some overview of the basic issues related to the new European Research ... Area initiatives. His main thesis is that transition to the new European innovation policy has arisen already before Lisbon Summit in year 2000. Notwithstanding, he argues that after the advent of the ERA initiative some basic changes are occurring. He also highlights some controversies around the pivotal role of European Commission in the new RR- and innovation policy appearing in the last times. The main interest is devoted to the question of intellectual property rights. Specifically focusing on the patent systems, author tries to answer, what is the new EU approach to the complex issues of intellectual property rights.
